Monday, November 16th:
*Sentencing Hearing – (@ 1pm CT) – IN – Boy (5) (found in running washing machine, Aug. 16, 2019, Indianapolis) - *Heather Mae Oliver (30) (GF of father) arrested & charged (12/18/19) & arraigned (1/6/20) with level 5 felony neglect of a dependent resulting in bodily injury. Plead not guilty. $10K Surety Bond.

9/8/20 Update: Plea agreement received & filed. State appears by Deputy Prosecutor, Jesse Miller. Defendant appears in person & by counsel, Kyle Noone. Defendant is sworn, advised of her rights, & examined as to the Plea Agreement filed this date. State presents summary of evidence. Defendant plead guilty to Count I: Neglect of a Dependent Resulting in Bodily Injury, a Level 5 Felony. Comes now the Court & takes tendered plea under advisement. Defendant waives the right to be sentenced within 30 days. Pre-Sentence Investigation Report ordered & shall be filed on or before 10/12/20. Sentencing set for 10/19/20 at 9:00am. Defendant is notified of said date in open court & is ordered to appear. The No Contact Order is modified to allow visitation directed by Defendant's case with CPS.
10/19/20 Update: Due to the Court's unavailability to conduct in-person hearings on 10/19/20, this matter is rescheduled for sentencing on 11/16/20 at 1:00pm. Defendant is ordered to appear.

This matter comes before the Court for sentencing hearing. State appears by Deputy Prosecutor, Jesse Miller, in person. Defendant appears in person and by counsel, Kyle Noone, in person. Defendant is sworn & examined as to the Pre-Sentence Investigation Report. Plea of guilty and plea agreement accepted, judgment and conviction entered. Sentencing hearing held. For Count I: Neglect of Dependent Resulting in Bodily Injury, a Level 5 Felony, the Defendant is sentenced to Indiana Department of Corrections for a period of 4 years. Credit for 3 accrued days (12/18/19-12/20/19) plus earned credit of 3 days. Defendant and Counsel acknowledge the accuracy of the accrued credit time as reported in open court. 2 years are ordered served on Home Detention. The remaining 2 years are suspended to formal probation. Abstract of Judgment issued. Probation for 2 years with terms and conditions as set out in written sentencing and probation orders, including successful completion of Home Detention. Fees and costs assessed against the Defendant: court costs $185; $10 fine; $100 administrative fee; and $90 probation user fee. No Contact Order is modified to allow for contact in accordance to DCS recommendation with exception of full reunification. Defendant is ordered to report to Home Detention as directed JUDGMENT.
