"Jersey" and MW #3

PLEASE THANK THIS POST BEFORE POSTING

The Lisa Irwin forum appears to be made up of cliques. You know, the type you have in high school before you begin to understand that there are a lot of interesting people and places in the world and your fear of such limits the personal boundaries you set for yourself. The disrespect between the two cliques is tiresome.


That being said, we need another review of the rules (which is really just a curtesy as everyone should know them or how to find and read them by now): This is NOT hard. Post YOUR thoughts, theories and interpretations (easy enough right?). Read the thoughts of others (not hard). Respond to those that may be of a like mind (okay, that should work). If you disagree with another poster and cannot post nicely, MOVE PAST THEIR POST (how hard is that?) If another poster gets under your skin, PUT THEM ON IGNORE (only takes about a minute). If you must refute their post - then use a link and state the fact as YOU see it (you all know this case, it can't be that hard). THEN DROP IT! That's it. See, not hard. If a post offends you, ALERT it, DO NOT RESPOND TO IT, and MOVE ON. It is okay to disagree, but it is NOT OKAY to attack or make fun of others. AND THE SNARK...well, that needs to just STOP.



It is our hope this gets the message across. There are many good posters here and no matter what opinion we may hold on who we feel is responsible we all are here for Lisa Irwin and want her to come home safely and soon.

In California , Auto Theft is called Auto Theft. In Missouri it's called Tampering. I'm not sure why it's called that but it's right there in Sec. 569.080 of the Missouri Statutes.

John Tanko AKA as Jersey is an interesting person.

Thaer Alkhaezraji lives just a block up on North Lister from baby Lisa's home.

Alkhaezraji said he has called the police on Tanko two or three times, claiming Tanko was breaking into the house across the street.

"He caused a lot of problems," said Thaer Alkhaezraji. "We chased him one time over here but he never lived here," said Alkhaezraji.

Alkhaezraji said Tanko would break into the house through a window which could be why police were wanting to talk to him.

At a glance, it seems maybe the tampering charge is used for knowingly taking possession/selling/destroying a stolen vehicle vs. the actual stealing of it. Theft of a vehicle seems to be covered under this statute: http://www.moga.mo.gov/statutes/C500-599/5700000030.HTM (It defines what stealing is and in subsections indicates it's a Class C Felony to steal a motor vehicle, boat, aircraft.) I think tampering vs. theft are not interchangeable offenses. JMO.

I agree. I think he isright where he should be. He is not someone I wouldlike to get to know better. Haha I'm sure the neighborhood is glad that he's relocated.

Well it says in Sec 569.080 (2) He or she knowingly receives,possesses,sells,alters,defaces,destroys or unlawfully operates automobile etc. without the consent of the owner thereof is committing the crime of Tampering.

The "possesses" part is what gets the car thief in trouble if caught in the car. The other parts can come into play in other circumstances.

Not saying you're wrong...the above was just my take on it. Maybe one of our lawyers can help us decipher this stuff. :)

I think a lawyer would be helpful. Here's Missouri statute 570.030
570.030. 1. A person commits the crime of stealing if he or she appropriates property or services of another with the purpose to deprive him or her thereof, either without his or her consent or by means of deceit or coercion.
. Notwithstanding any other provision of law, any offense in which the value of property or services is an element is a class C felony if:

(1) The value of the property or services appropriated is five hundred dollars or more but less than twenty-five thousand dollars; or

(2) The actor physically takes the property appropriated from the person of the victim; or

(3) The property appropriated consists of:

(a) Any motor vehicle, watercraft or aircraft; or

I'm not sure of this statutes inclusions and limitations.

LIBERTY, MO (KCTV) - A man who did odd jobs in the neighborhood from which baby Lisa Irwin went missing was sentenced Friday on an unrelated charge.

John "Jersey" Tanko will spend the next 5 years in prison after he was convicted on a charge of felony tampering with a vehicle.

Tanko was arrested Oct. 14 in connection with an Oct. 13 incident.

Tanko was arrested Oct. 14. He did odd jobs in the Northland neighborhood from which 10-month-old Lisa Irwin went missing five months ago. Neighbors also accused Tanko of committing crimes in the area.

Police questioned him about Lisa's disappearance but Tanko reportedly cooperated with investigators and ultimately they said they "moved on."

"He cooperated with us and we are satisfied with what he told us," said Capt. Steve Young, a spokesman for the Kansas City Police Department.

(is this snippet referring to a repeat of the dr phil show? shouldn't it say so? or is this most of an old article that was re-worked for the update on jersey? grrr.)

Question : How long will Jersey be in :jail: ?

I have not kept up much with Jersey and the charges, etc. against him because I do NOT believe he was involved in Baby Lisa going "missing" ...

JMO ... but I think Deb and her defense lawyers were looking to make him the "scapegoat" in Lisa's disappearance ...
