Not to worry. All this testimony and positioning will fade away. In 20 years Jodi will still be sitting in a jail cell. NONE of her dreams will ever come true. She'll never have anything more than a prison 'gal pal' and maybe some pen pals. She'll never have a family. She has no life to speak of. It's all very exciting while she gets to pretend she's a victim, but this trial will end, people will go back to their daily routines, new cases will be talked about, and Jodi will be nothing but a footnote in history, fading further and further away each year.

That's exactly what I thought about the "trial of which we do not speak of".

Speaking of that it reminds me one time when I was in my 20s my girlfriends talked me into going to see the Chippindales or whatever they were called.

I have never laughed so much in my life. Oh my gosh all those women were running around like crazy oversexed women putting their hand all the way down in the guys g-string thingy.

Some had to be grandmothers.:floorlaugh: They were raking their backs and butts with their fingernails leaving red claw marks all over them and grabbing them and kissing them. Some jumping up on tables and screaming for one of the guys to come over there and well never mind. Talk about being treated as a piece of meat.LMAO!

I just lined up against the wall watching it all unfold. I told them they were more entertaining than the very studly hunks in the show. I still have pics of the guys and the women acting so crazy. First and last time I ever did that. I thought I was going to get trampled in the stampede.:D

I was shocked that women acted that way.

When my hubby and I dated we went to a lounge one time that had a stripper in it. She did her striptease act but none of the guys tried to grab her. They did the wolf calls and put money in her g-string but thats it.

Interesting. I have never gone to anything like that.

Where I live, I helped write the law that limits where these activities take place. We used other constitutionally challenged laws as the guidance for our law.

You cannot prohibit them ,but you can identify where they can be and other things.

The law is that one cannot touch the performer in our ordinance.

Either sequence of events meets the legal standard for the aggravating factor the State is using. The judge has confirmed this upon rulings for JOA and mistrial motions.

However, the very human element of a jury voting to sentence a person to death may well require the State to go above and beyond the legal standard. It suits the State if Travis' murder was the most brutal, bloody, violent possible allowing for no chance of him being unconscious at any point.

In the same vein it suits the defense to cause the jury to doubt such a sequence the prosecutor has put forth and infer that Travis was likely unconscious and therefore could not feel pain, fear, or their impending demise the same way a conscious person would.

This is now a "sticking point" for me. I know that there is a possibility of another pinellas-type jury but I like to look on the bright side and presume a certain level of intelligence for most. So, given that, I think this odd discrepancy (outlined by the prosecution) will confuse a presumably intelligent jury. Hopefully, they will move beyond it; but unfortunately, they might not. It makes NO SENSE that she stabbed him repeatedly and then decided to shoot him. I have a gun. I have a knife. I will stab 27 times before I take out the gun? HUUHHH???

For the second phase....death penalty do they need to be unanimous ? Or majority rules?

I've been reluctant to follow a case ever since "that" trial. I'm a bit scared to follow this one now.

Verified Lawyers - Can she be found "not guilty"??? Even if she has admitted that she killed him?

ETA - I realize that she can get LWOP or the DP - but can she come out of this with neither?

Oh I'm sure Jodi will tell us exactly how it happened. Kinda like her Ninja interrogation performance. Unless of course she opts for I cant remember a dang thing.

Any juror in their right mind must see that hardly ever does Jodi have suicidal thoughts. She hasn't described any heart wrenching depressions or any time she couldn't get out of bed - there's hardly any bad moods where love was such a tragedy of abuse.

She never thought of committing suicide.

She lied about the reason she said "No Jury will. . ." She said those words meaning them and it's a challenge. Jurors will make her eat those bitter words. Trust in Juan Martinez, he will get Justice for Travis.

So much so, that I think it is time to revisit the system and how it works. The trial that won't be named was shameful and embarrassing. (Made the whole judicial system look stupid and ineffective.)

FLORIDA STATUTES 775.082 AND 921.141 - THE DEATH SENTENCE AND CAPITAL FELONIES
Florida Statute 775.082 permits a punishment of death for a person convicted of a capital felony in Florida. This statute also addresses what should happen in the event that the death penalty in a capital felony is held to be unconstitutional under the Florida Constitution or the United States Constitution. Interestingly, the Florida legislature maintains a distinction here between the determination of the unconstitutionality of the death penalty itself, and the determination of the unconstitutionality of a method of execution.

The sentence of death must be the result of a penalty phase proceeding carried out according to the procedures set forth in Florida Statute 921.141. The penalty phase proceeding is the second part of a two-part capital trial system in Florida. The first part, called the guilt phase proceeding, results in the jury verdict (i.e. guilty or not guilty) on the capital felony charge. If a person is found to be guilty of a capital felony, a penalty phase proceeding is subsequently conducted to determine the sentence - either life in prison or death. The same judge and jury panel is used for both the guilt phase and penalty phase proceedings. However, the verdict in the penalty phase differs in two important aspects. First, whereas the guilt phase verdict must be unanimous, a sentence of death only requires the recommendation of a majority of the jury.
