Jodi Arias on the stand, day 3 of her testimony
--Counsel are asked by the judge to approach the bench.
--Exhibit #428, audio between Jodi and Travis, is entered into evidence. no objection from Martinez
--October 2006, town of Erinburg (spelling?) was a small town, middle of the desert, in CA but on the border.
--Jodi was driving out there to be with Travis. No plan for going to a park or a lake.
--Arrived at the hotel and made out with Travis within minutes of arriving.
--Travis had the room key so he opened the door. Took her hand, walked her willingly to the bed, started kissing, it got more intense and passionate, soon we were both nude on the bed. There were certain things that he said...we didn't have intercourse, there was oral sex that weekend, we did what he called "grinding", being together but not actually having intercourse, a lot of Mormons do it but they aren't supposed to.
--No vaginal intercourse, no anal intercourse, just oral sex. This was Thursday evening, they spent two nights there and Travis had to leave on Saturday.
--Jodi was both giving and receiving oral sex.
--They stayed in the room that night, watched some game shows, Deal or no Deal.
--When they woke up the next day they tried to find some way to spend the day. They drove to Blythe and watched as movie, went to Sizzler and got something to eat. Doesn't remember if they engaged in any sex before going to the movie.
--Engaged in more oral sex after the movie. It was mutual.
--Jodi saw this as a romantic weekend but it wasn't turning out to be that. When they weren't having sex Travis seemed "checked out", he was distant. Jodi thought they connect a lot over the phone but in person it was diffrent. Over the phone they talked about things of a spiratual nature, pleasant things, discovering things they had in common and ways they were different. When they went to the hotel she expected the same but it was only a physical connection.
--Did not consider herself to be in a committed relationship. It was not defined, definitely not boyfriend/girlfriend.
--Total of three sexual interations in the hotel. Oral sex and grinding.
--Travis expressed a desire to engage in anal sex with Jodi. Did not express a desire to have vaginal sex. Jodi declined his desire to have anal sex.
--Travis expressed his desire to have anal sex other times.
--Other than sex, movie, going out for dinner, Travis made music CDs on his computer. Shared more things from the book of Mormon with her. Travis also watched TV.
--By that time Jodi had already received several visits from missionaries, the vow of chastity was mentioned but not in detail.
--Jodi's understanding of that vow, it was glossed over by the missionaries, Martinez objects, wants to know what Jodi's understanding was. Says what the vow meant was no premarital sex. Says it was explained to her by Travis. Martinez objects. Says her understanding was that vaginal sex was off limits but everything else was okay. Says Travis gave her that understanding.
--Travis and Jodi left the hotel Saturday morning, got breakfast at the neighboring truck stop. Says there wasn't a connection, not a lot of conversation. After breakfast they checked out. Jodi took a photo of Travis, he was in a suit and tie, he was going to a PPL meeting.
--Palm Desert is three hours from Eerinburg (sp?). Jodi says when they parted there wasn't a lot of affection and she felt "bummed out" and felt "stupid". She was replaying that weekend and wished that things would have gone differently. Wished that they had more of a connection, a meeting of minds, she didn't dislike the physical part, it was missing the emotion and the mental connection, being on the same page.
--Did not feel any emotional connection, did not feel like they had grown closer, says that Travis seemed like he had grown more distant. The sex didn't feel like too much too soon as they had gotten to know each other and she had developed feelings for him.
--It was confusing where the line should be drawn. To her sex is sex and there are just different ways to have sex and it seemed like Travis sort of had the Bill Clinton version and it seemed like oral and anal sex were sex to her but not him.
--The line had to do with the vow of chastity.
--Jodi considered her own actions as it relayed to her vow of chastity. She trusted what she was told by him. She felt a little bit used but knew she had gone there on her own willingly. Travis is giving her a lot of attention during sex but not other times. Felt like a prostitute. Does not feel Travis mistreated her but did not treat her as well as he did for that entire month.
--Jodi called Travis on that Saturday evening but he did not return her call. She called again Sunday evening but he did not return her call. This was not normal. She had wanted to know if he had made it home safely.
--Travis usually called late at night. By Monday morning he had not returned both of her calls.
--Jodi was trying not to over analyze it, or think about it much. (her feelings about the weekend).
--Says she called him because she had feelings for him. Not in love, was stronger than a crush.
--Her feelings for him were stronger than her feelings for being used.
--re: feelings about being used. Travis had not returned her calls and she felt stupid, that Travis had got what he wanted and wasn't interested in her anymore.
--Says she wasn't thinking of writing him off at that point. If he was moving on she would have like to have known.
--She heard from Travis on Tuesday evening when she was at a business briefing. He left her a very nice voicemail. Jodi called him after the meeting.
--The nature of the call was reassuring to her.
--Did not express her feelings of being used. Did not want to make him feel bad. She was telling herself maybe it was all in her head.
--The same phone call routine and subject matter continued. The calls were spiritual, sexual and other things.
--Next saw Travis right before Thanksgiving. Reason for the meeting, Travis was on his way to Riverside and he stopped at her house for a while and then continued on to Riverside.
--November 26, 2006 Jodi was baptized into the Mormon church by Travis.
--The baptism was after Thanksgiving.
--When Travis came to her home in Palm Desert, she thinks Daryl was living in the house but was at work. This is the first time Travis had seen the house, she walked him around the property, Travis wanted to see the pool. Travis' dog jumped into the pool and Travis jumped in to save the dog. Travis was soaking wet and jumped into the shower, Jodi put his clothes in the dryer, they were intimate again...oral sex/grinding, Travis asked to have anal sex with her. Says it was more like teasing and she said no. Travis ejaculated and left shortly thereafter.
--Nurmi asks to approach Jodi. Shows her exhibits 393 & 394, photos of Travis' erection. Says they were sent to her via his phone. Martinez objects, no date on them, objection is sustained.
--Nurmi gives Jodi the photos of Travis' erection and she looks at the date. They were sent before he came to her home in Palm Desert. Says it was November 11, 2006 when the photos were sent.
--Photos came to Jodi unsolicited, she didn't expect a photograph but they were flirting. Says she was in Anaheim at a super Saturday and she was listening to speakers and her and Travis began to text back and forth. It turned flirty, then sexual and it went on for hours back and forth, trying to top each other's comments. She was at a restaurant when her phone beeped, she had not received photos on that phone before. She didn't know how to see it, had to go in another folder, had to close her phone.
--It appears the photos are different, they were sent consecutively.
--Says that Travis wanted her to reciprocate with photos. Jodi did not on that day. She was at a restaurant...says she didn't want to reciprocate. says she didn't want to, says she told him no. When asked how Travis reacted she says that he had been asking for photos for a while at that point. He wanted naked pictures of her, did not specify body parts.
--Jodi says she had not sent Travis any naked photos at this point.
--Says she did not want to disapoint Travis.
--re: Baptism in November 26, 2006, Nurmi asking Jodi about the process. The first week the missionaries came they invited her to church. Somebody was giving a talk and what the person said was very impactful. The person spoke of acceptance and tolerance of all faiths in the world. Jodi found that aspect in line with her own personal beliefs.
--She was able to ask Travis about Mormonism as she wasn't comfortable asking two twenty year old guyes (missionaries). It was in alignment with her values, family values, marriage and families. She did not like the no coffee rule as she drinks it every morning and sometimes in the evenings. No alcohol but that didn't bother her. Everything seemed to line up for her, the beliefs and the lifestyle she was interested in leading.
--Missionaries asked her if she were ready to be baptized and she was set up to be interviewed with an elder who checked to see if she was ready to be baptised. Doesn't remember the date but it was close to her baptism date.
--What was the subject matter of the questions she was asked? Doesn't remember because it was so long ago. Remembers about Jesus Christ, Josephy Smith, obeying the word of wisdom, law of chastity...her understanding was different.
--re: law of chastity, if she obeyed. Her understanding was abstainging from vaginal/penile sex and therefore believed that she was abstaining. Based on the belief of things Travis was telling her.
--After the interview, she wasn't approved right away because Daryl still lived in the house and he was an ex-boyfriend and somebody who was the opposite sex. Church wanted to make sure they were in separate bedrooms, Daryl was planning on moving anyway.
