I just don't understand why the Defense team would want this to be a part of their case. I can see why the Prosecutor would present it into evidence, but the DEFENSE? Huh?

She claims that Travis asked her to tape it. Now why would he do that? Trying to keep his love life a secret he's going to ask her to tape it? She called him super human and complimented him a lot. I think most women would have used the tape to set him up as a pedophile or abuser but since that is not the case, I have no idea why she even bothered to tape him.

Yeah, and if he really wanted it taped he would have done it himself, imo.

10:30am MST - Gus Searcy and Skye Hughes will testify at a sealed hearing.

11am MST - Jurors will return for continued testimony.

Seen on Beth Kara's twitter that it's scheduled for 10am, but either way it's a closed hearing, which I think is odd considering we heard the beginning of the motion, it was sealed.
Would definately be interesting to hear the 'rest of that story'.

I agree. And I cannot believe he would want it taped. It was a closely guarded secret he was having premarital sex. He was not proud of it. I cannot believe that he would EVER want his freaky ex to have a recording of his sexual fantasies. :what:

So has anyone figured out who Esther is yet? That was when I had to leave and have been trying to catch up this last hour or so. I'll have to watch the end of today in the morning.
I don't understand why the defense was so adament that this recording be played. I will listen to it again tomorrow (unless someone has found a transcript of it?)

Either a lubricant or a woman still haven't figured it out.

"Smooth" would not impress my husband either but he does not manscape..at all. TA did not like body hair and was smooth "down there", so for TA, it might have felt awesome when JA went on about his body being so smooth.

WEll I think she wanted only part of it played....the 12 year old girl part. NOT the whole thing and I don't think defense wanted the whole thing played either...IMO.

And the "tied to a tree part". Oh yeah, and what about the goose (was it?) beak in the rear-end?

This tape seems like one of those pieces of evidence the prosecutor wanted played in open court, but wanted to manipulate the Defense team to present it.

Why did theDefense fight so hard to have it played?

It was used as a threat when the defense wanted a plea deal. I think they continued to use it as a threat hoping until the last minute they would get a plea bargain, figuring the DA would rather deal than embarrass Travis and the Church with the sex tape. DA called their bluff and the defense had to play it. That is why Jodi cried. She really didn't want to have it heard.
That's my theory. Or at least all I can figure.

For anyone that missed Trial Day 15 with the drunken woman scene, it starts at 03:00. Then later is the Valentine melted chocolates. This would cover Feb. and up to March 31, 2007. But I was really searching for Esther, and when I thought she was mentioned, but I didn't find it. I'm going back in.

I concur. The idea that he wanted, no, demanded that the calls be taped just doesn't add up considering what's discussed above AND to me the fact that... she dominates the conversation and she and also brings up a bunch of non-sexual chatter.

I hate to be crass but it's like, "Oh baby, be sure to tape yourself prattling on about karaoke and Abe..."

Does anyone ever read over on the Jodi is innocent site? Read the comments from posters to see what "the other side" thinks of the days court proceedings? I wonder sometimes if there might be one or more jury members that think the way those posters do. It worries me when I read things like how some people think Jodi is coming across as earnest, articulate, bright and normal. That some people think Jodi is doing well on the witness stand and that her tone and affect are right on. They also hate Juan with a passion, calling him a horrid prosecutor but as long as Jodi keeps telling HER truth then she should be okay when decision time comes. I just haven't seen any of that in any of Jodi's testimony but who's to say that someone on the jury does see it? I certainly hope that the jury is seeing through Jodi's lies and don't let this killer walk free.

Which takes me back to the same question I've had all along, why was he sitting in the bottom of the shower like that, if she hadn't forced him to do so? Plus, the photos that are in tandem with the Psycho movie right before this one. She had to be involved in those poses as well, IMO.


I'm moving more and more toward a post by Minor, in his being the 'victim' that we see in so many of the cases that are gender reversed.

Victim is made to shower, at gun point, after sex (or, rape).

BTW, I wanted to bring up the two photos of Travis on the bed, nude, with the KY. I know that it was brought up about Juan pointing to the TV and wondering what that was all about. I think I figured it out. (Since the audio was off.)

I think Juan was not actually pointing out the television, he was pointing to where Travis's hand may have traveled.

Take a look at the photos again. The first is of Travis asleep (at least his eyes are closed) and relaxed. The KY bottle is next to him, with the blue lid pointing towards the southeast.

The next photo is of him and his hand up, what looks like a peace sign. Only, I believe it is the photo of his hand in motion. The KY bottle is then next to him, like he picked it up and sort of 'tossed it' to the side. Take a look (don't know how to post the photos) at the photo. Everything seems to be in focus, except for the hand and the ky bottle (like they were in motion when the camera took the photo). Also, notice the bottle is now lying with the blue cap facing in the northeast direction - like it had just been tossed there.

Perhaps Juan was pointing this out (he is so smart) and perhaps it was to show that Travis wasn't necessarily a willing participant. (like, he opened his eyes, turned and say the bottle and her with the camera and tossed the bottle to the side, like "are you serious"?).

Yep, Minor's previous post about the genders being reversed is making more and more sense. We naturally believe that he was willing. What if he wasn't? What if she did have him at gun point the entire day?

I can't get past the inkling that this phone call between them was staged. Too many topics and back history they both already knew - why bring it up?

I don't think she'd send it to the church, and I don't think he'd stand for monitary blackmail. So here's what I've come up with.
I think the "blackmail part" was her threat of sending it to Mimi, or another Morman who may not turn him in. It sounds like she's trying to "rub it in" to someone that they are intimate...

Jodi totally staged that phone call she recorded. Who sits on the phone with an ex and strolls down Memory Lane, point-by-point? It was too important to her to dredge-up EVERY sexcapade and whatnot. Nobody does that.

I'm thinking she may have even written out an "itinerary" of all the junk she wanted to get him talking about (i.e., unwittingly confessing to).

He did NOT ask her to record this conversation. He was a proud motivational speaker who would NEVER want to be recorded sounding so tired, mumbling and out of it.

She was hurting for money and that relationship was clearly OVER. I think she thought she could blackmail him. Maybe she actually did. Maybe that's where the money she bank-deposited came from.

Maybe the problem was, as Lisa said, he really didn't HAVE much hush money to give her. Perhaps she was further insulted that he wasn't taking her blackmail attempt seriously -- giving her a measly $100 here and there. So she became unhinged. The plan was failing.

I heard that Jodi contacted one of Travis's sisters after his death, to stress that Travis meant for her to have ownership of his BMW, and notify her that Travis owed her some money.

So that's what I suspect her #1 goal was at the end. She wanted financial gain / recoup. She was flat-broke and blamed him for all her troubles. The least he could have done was invited her to Cancun for free. But she was dissed at every turn.
