thanks AZlawyer :)
Now that I'm thinking about it, it makes sense that Juan didn't want to be the one to call Lisa and open that door. But now that the defense opened the door by calling her themselves, the defense wouldn't be able to appeal on that issue, since they opened the door.

Personally, I don't think the prosecution needs to address the stalking issue now, it's already out there, let the jurors come to a conclusion.

She's doing a pretty good job painting herself as a stalker.

Continue here:

Rule Reminders:

1) Keep the religious debate off of the thread please.

2) Do NOT call names or otherwise bash the defense team.

3) Take a moment and read every post above this one.

The comments about Mormonism with respect to this trial are relevant BUT only in so far as the topic guides JA defense strategy. The defense wants to show that TA was in no way an “angel”. In demonizing TA they “humanize” JA and in doing so the defense garners sympathy for JA. Mormonism plays a role here only in showing relative deceit and hypocrisy exhibited not only by TA but clearly by JA also. They both espoused religious/ moral principles – law of chastity - but then proceeded to violate them. In this case the unsavory conduct was sexual in nature. Had TA been running a deliberate “con” game or engaged in drug traffic he still would have violated Mormon principles of decent living but these transgressions would not nearly have been salacious enough. The forbidden sexual practices TA and JA engaged in also speak to the “manipulation” and “control” TA allegedly used to procure “favors” from JA. These factors speak to alleged “abuse” and by implication JA “state of mind”. This complex maze of interlocking circumstances contributes to crime mitigation which is the whole point of the defense efforts.

I believe the Nurmi trial strategy has served his client well however unsavory “trashing the victim” appears. Sex, lies, audio tapes, and Mormonism are all part of the mix.

Having said that, HOWEVER, I believe Nurmi et al have vastly overplayed their hand on this point and have in essence bludgeoned the jury and audience with too much sex, lies, and audio tapes. Nurmi could have conducted a much improved, tightly constructed, more coherent narrative and done so over 2- 3 days MAXIMUM.
Also , as has been amply discussed in this forum, TA’s “sins” against the Mormon religion in no way justify a savage murder and likely will have nothing to do with the “self-defense” story. The defense elongated story of manipulation and abuse most likely will serve ONLY to prevent a jury from condemning JA to death.

I think she gathered her weapons in the weeks prior because she had yet another mental breakdown. Her long e-mail about just being friends, and that she was hurt when all the other girls got mentions and she won't (I actually believe due to Travis' stature in PPL and how beloved he was, he had quite the cult following) In her immature mind, she became obsessed with him because he was charismatic, and going places and she would go with him, he was the center of attention with friends and at work, and she will zip tie herself right to him.

When this broke down in what I consider a very short relationship between them (because they went TOO FAST and got into too many very edgy things sexually too soon, too much too fast - man, they left nothing for the honeymoon) this crash and burn occurs and she was unstable to begin with.

There are clear signals the last 3/4 weeks she was a volcano about to erupt. (even friends saw it) I think the fatal trip to Mesa was her LAST attempt to see if this is it? Is it really it? You and me, we are done? right? no more? for sure this time? Because I am off to Utah next to grind with my boring new potential husband? So tell me now? you and me, girlfriend boyfriend yes or no?

I think she did not drive there "to kill him" I think she drove there to see if this is really it?

Why in god's name he let her in.

Once in, I am obsessed with what happened next? What was his tone, what did she say? That first few moments in time in how he reacted to seeing her bought him 12 hours more of "life". Again she had a tiny glimmer things will turn around, he will say to me that he doesn't want to be without me.

If he had, that gun & knife would never have come out.

But he didn't, he somehow said and did things that dragged this fateful event another 12 hours until she was told again, its over, he had sex with me, he is seeing me off to Utah and he is in the shower, he is talking about how we each have someone new in our lives.

Not what she wanted to hear.

also re: yesterday morning hearing with Sky H..... does anyone else think that Nurmi put her on subpoena so she couldn't watch the trial/help Juan?

I don't think he would be THAT stooopid that he would call her as a defense witness???

EXACTLY---he more or less admitted that one...

  • #868
Yes, I agree. I hope he uses more graphic words, though, like "murdered" and "slaughtered" and "butchered" - so the jury keeps in mind the matter at heart.

Exactly right.

  • #869
I don't think it would have been an appeal issue even without the "door opening" testimony; it's relevant to her motive (jilted ex). In an abundance of caution, I could see why he wouldn't want to get into it--but I wish he hadn't explained the reason out loud, because now if he does follow up on her "opening the door," Nurmi will cry mistrial again.

But hopefully the judge would use the old Belvin Perry Line "that the defense has opened a door the prosecution can drive a Mack Truck through"!!!

I don't post a lot, but I just wanted to say I really appreciate all the info you all provide. I homeschool my kids so I can't listen and participate as much as I'd like. I peek here and there on breaks and try and play catch up at night but I can't watch or listen to the trial as it is happening so I just wanted to thank you all for the info and links you post during all of this.

Ugh!! I wouldn't step inside his motor home for all the 'director rings' in China. He makes my hair stand on end.

I knew it was time to turn off HLN when Gus started in with his, "I've been able to accomplish in 90 days what takes others two years -- blah, blah, blah, blah..."

Is it just me, or does this Gus guy remind everyone of the actor, Wallace Shawn? I can't stop thinking about it!

I demand that you go to the grave of Wallace Shawn and apologize and put a HUGE wreath of flowers on his grave. :snooty:

That is so insulting. I hope to God none of WS's family members read here.

very good article on how psychopaths speak...about murder

here is a snip (great article)

To examine the emotional content of the murderers' speech, Hancock and his colleagues looked at a number of factors, including how frequently they described their crimes using the past tense. The use of the past tense can be an indicator of psychological detachment, and the researchers found that the psychopaths used it more than the present tense when compared with the nonpsychopaths. They also found more dysfluencies — the "uhs" and "ums" that interrupt speech — among psychopaths. Nearly universal in speech, dysfluencies indicate that the speaker needs some time to think about what they are saying.

With regard to psychopaths, "We think the 'uhs' and 'ums' are about putting the mask of sanity on," Hancock told LiveScience.

Psychopaths appear to view the world and others instrumentally, as theirs for the taking, the team, which also included Stephen Porter from the University of British Columbia, wrote.

As they expected, the psychopaths' language contained more words known as subordinating conjunctions. These words, including "because" and "so that," are associated with cause-and-effect statements.

"This pattern suggested that psychopaths were more likely to view the crime as the logical outcome of a plan (something that 'had' to be done to achieve a goal)," the authors write.

And finally, while most of us respond to higher-level needs, such as family, religion or spirituality, and self-esteem, psychopaths remain occupied with those needs associated with a more basic existence.

Their analysis revealed that psychopaths used about twice as many words related to basic physiological needs and self-preservation, including eating, drinking and monetary resources than the nonpsychopaths, they write.

I can't possibly keep up with these threads and how fast they move, although I try my hardest! I have to skip 5 pages at a time sometimes and always feel like I'm at least 10 pages or more behind in reading.

I just have a quick question, I suppose for a mod - How is it decided which trials have their own forum? I think it would be so much easier if this trial was its own forum and we could have discussion threads about each day (like these threads are); threads to discuss specific items like contradictions, theories, autopsy and medical stuff, threads for specific people (Gus, Chris & Sky, etc...), video thread (links or embedded videos), photo thread, "funnies" thread (for the great photoshoppers out there who give us a much needed chuckle through this horrific murder trial).... I know we already have a thread for legal questions, and timeline/no discussion, etc., but it seems like one forum with all of these threads would be so much easier for the posters to keep up with specific events.

Thanks in advance for the mods/admins consideration of letting us have a forum for this trial. :please:

ETA: I alerted a Mod so they would see this post, I hope that's okay.

ETA2: Thanks to Nurse for the reply, and all of the hard work you Mods do!

ETA3:  I just found out this IS a forum and I haven't done enough searching!!! Sorry!

Did anyone ever go back and catch the name of the person that they could not get a hold of during the open hearing yesterday? Ms.??????
I wonder if that is who was in the car with Gus?

I hope we're not subjected to more bad poetry today. That crappy poem of her made "Beans, beans the musical fruit" sound genius.

  • #878
All this jury needs to come up,with to sentence death in this case is if the crime for which they have convicted her is especially cruel, heinous or depraved. They will have no,problem linking those definitions. IMO

It's not in their instructions if they find her sympathetic. It's very well defined and cut and dried.

Gus said she lost it.

Arias said shespilledhotchocolateinhercupholderanditmadeahugemessandshesetherphoneinitanditruinedherotherphonethehotchocolatethatissogusgaveheranewphone

If she lost it was it the same trip she CALLED ta from the u-haul and he flipped her off?

I am re-watching the testimony from yesterday - 2 thoughts come to mind:

1. Where is she finding these "pamphlets" to give Travis for his sexual problems? Am I to believe that "pedophile" pamphlets are just laying around?

2. She said Travis was reading her gmail because he had her password. If that was so bad, why not just change the password....? Answer: because she was flattered he cared enough to read her emails!

She did say she got some pamphlets from the mall.

Also "having" Travis's password to his gmail account....she could have easily wrote emails back and forth to herself. :moo: (of course)
