I think they knew, but what can they do? There's no way to get it excluded.

Nurmi sure seemed to be looking at the notes intently if he'd seen them before. Maybe he was looking at the pretty photos though. I get that magazine myself and the photos are gorgeous in them...haha

More "thinking out loud"…it's my understanding the jury isn't supposed to know that Jodi has been in jail for 4 1/2 years, but didn't they learn this via the "magazine" debacle yesterday?

Well, JM couldn't just TELL the jury that JA had been in jail, because it's totally irrelevant. But it's not like they have to HIDE that fact if it happens to come out unavoidably in the course of relevant testimony.

The original special action petition was filed 1/28/13 with the AZ Court of Appeals and denied 1/30/13--the court decided not to wait for the state's response.

The case is not showing up on the AZ Supreme Court website yet, so I suspect the petition to review the Ct App's denial was filed along with the stay request today. I don't believe the AZ Supreme Court has actually denied the petition yet--I think they have only denied the stay request.

The stay request was just to prevent the penalty phase from going forward until there is a ruling from the AZ Supreme Court. The court might figure that, at the pace this trial is going, it will have plenty of time to rule before a verdict is reached. ;)

That was my understanding from the articles linked above. Only the stay has been denied, and the appeal has not yet been decided.

I just figured he was stalling to interrupt the flow of the cross examination. I could be wrong, but I don't know how the defense would not know about this. Of course, you never know when you have a client who is lying to you.

ETA2: I just don't see why you would make a show in front of the jury about being worried about what is, in fact, pretty dang bad evidence for your client. If anything, you would be like, oh, this silly old magazine thing, I shall just toss it to the side like so much nonsense... ;)

Someone like Jodi is not going to able to get along with the co-workers, and as a waitress, I can't believe she would get along with the customers. Any back-talk, and she would be livid.

Maybe we should check around for missing customers of these restaraunt s who perhaps complained about thier food....or service....

He picked them up that day the tech guy was on the stand.. we didnt get to see them.... but we will!!! :great:

I'm still convinced the penis pictures were of JA's ex darryl.
Perhaps Juantastic will enlighten us on that possible fact..

I was actually half kidding. I also think he was stalling. I just think that it's quite possible that these magazines were part of discovery, but that this DT didn't catch the hidden notations. Either way, it was a really powerful presentation and can't wait to see what she comes up with over the weekend to try to lie her way out of the real meaning.

IMO, that's the biggest nail in her coffin so far. Attempting to tamper with witness' wouldn't sit well with me if I'm on a jury. JMO

I agree, it was very compelling. And the more I think about it the more I think it's possible the defense really did not know what was in those magazines because Jodi was lying to them and never told them about her witness tampering through coded messages.

FWIW - Jodi is a lawyer's worst nightmare because she is not forthcoming and lies even to her attorneys as part of her pathology to always present herself as flawless and not responsible. This leads to "surprises" like this in court.

Hiya, everyone! Not sure if this has already been discussed...(oh, who am I kidding - you guys already thought of this, dissected it, and moved on, by the time it crossed my mind!) - but regarding the magazines she was attempting to give to her friend...

So given the description that she stated of the attempted transfer of property (magazines) the procedure appears to be similar to that in Cook County - you fill out a form, signing your property over to a friend/family member/visitor, who has already been cleared to receive the documents/papers/property (with a signature by a C.O.) A guard flips through the magazine and gives it to the visiting room officer (or fill in the proper title here...you get the gist)...and then the visiting room officer ALSO flips through/checks the property before handing it to the visitor (at the conclusion of the visit - on their way out. It is NEVER given in the room with the inmate.)

My question: Her friend, evidently, never received this property. At some juncture in the process, the writing was caught by an astute guard, who then would (according to Cook County Jail procedure, unsure of in AZ) notify the inmate that their property was being confiscated for..and there are a litany of things that could occur over (writing inside, thus attempting to pass a message...inappropriate photographs/nudity...sexual content...gang content...etc)

So, Jodi SHOULD have been ready for this (magazine thing). But she didn't seem to be. At least, her attorneys appeared to be taken aback. Did she simply forget/refuse to tell them? Or did she think that, sheerly by writing in the magazine (in Cook County, even writing 'I love you blah blah my little love muffin' would be grounds for not authorizing the property transfer, because all written correspondence MUST be properly checked by the officer in the mail room.). So, did she imagine it wasn't a big deal, that the prosecution didn't catch it? Did she bring up the notations she made, while on the visit with her friend - and then, the C.O. doing the monitoring of the visit checked out the magazine, after Jodi made reference to notes in that same item?

Basically, I'm thinking that her grandiose thinking did her in, in this instance - that she thought they didn't pick up on it, that she was free and clear. Otherwise, why didn't she try to come up with some b.s. to cover it, like she did, blaming the guard for the interview?

My thought was her attny's were verifying what they knew of the evidence. Like making sure there wasn't any extra wording they didn't know about. Thats why it was taking so long.

My guess is they knew all about it and didn't want a part of it because their client was calling set up by guards to frame her, she knew nothing about it. Thats her story and she is evidently sticking to it. They had nothing to work with at all to put a spin on the magazine/witness tampering stuff.

I live in the D.C. area and it often surprises people to find out how bad our summers are. It is not uncommon for a weather map of the U.S. to show it hotter in D.C. than anywhere in the country -- except, you guessed it, Arizona. That was sort of what prompted my question.

Not that we have the worst weather. It does get miserable here, but we don't have as many days of it as the deep South/Texas.

I'm in South Carolina but worked with some guys from Mesa who contracted for us during August one year. They told me AZ was hot but our humidity made our summers worse than theirs.

That is an insult to all average pedestrian type grifters! :notgood: They have a reputation for moving around a lot, but not killing.

Chihuahuas feel insulted too, and want no part of any connection to Jodi. :D

Psychopath fits, like that movie Psycho, being so similar of her deeds.

I've read so much about this trial it's becoming increasingly more difficult to remember what has been covered in the actual trial. Were the "slashed tires" incidents actually entered as evidence? Does the jury know about these incidents?

That's what I wondered, they did look puzzled, they went through each page of it. My thought is they knew about them but really never looked at them, maybe didn't realize what was in them until yesterday. I would have looked and acted casual about it because I think they drew more attention to them by taking so long to look them over...

Yep, it's a dry heat, yada yada. August is GD hot here. I don't care who you are.

What happened in August again? I can't focus with JVM screaming at me. But of course I can't turn it off.
