They took it down so they could play it on TV this Saturday? Or is this a new one?

I predict eventual mistrial. There is too much time buring this "hiatus", and then ratings-grabbing CBS is broadcasting this during that break. It's very taunting, and I think somehow someone on the jury will be exposed to something they shouldn't.

Oh but wait, they have alternate jurors...well maybe they have a shot then.

We never saw any text messages . . . . I guess I expected to see some of those 82K . . .. maybe it was because the technology didn't exist to obtain them until 2010?

I think they were smart not to show them... only the calls that pinpointed her location (that she lied about) and the one where she was checking his voicemail with her phone.

Last witness helped defense. I hope judge refuses defense request for a directed verdict and that she allows felony murder to stand. I do not think the prosecutor was tough on the witness. I think he was just emotional. He was representing Travis!!!

I agree. In any case, much less a death penalty one, two weeks between the prosecution's case in chief and the defense seems like a flawed schedule. There is a "recency" effect, and IMO, that would make the trial unfair. Granted, the prosecution can rebut and do a compelling closing argument, but this gap in time screams "unfair" to me.

If she's convicted, I bet this would be a ground for appeal somehow.

I agree. Frankly, I'm shocked by this. How realistic is it to expect that all the jurors and alternates will be going back to their lives for 2 weeks with no exposure to the newspapers and broadcasts? That, for 2 weeks, no one will try to engage them in conversation about the trial? That's really expecting a lot.

Does anyone know of other DP cases that had prolonged breaks like this?

ok, ok, how about this idea? the state's done for now. there will be a hell of a rebuttal after the defense is done?

is that possible?

If it is being used in the trial and the prosecution already rested, is it safe to say by the defense then?


Kinda what I am thinking as Flores was sure the gunshot came first.

Someone asked earlier if this was an appropriate place for the state to rest and IMO it was. Think of the evidence we've seen:

-denials of being present
-same caliber gun missing from Jodi's home and Jodi's refusal to answer where she got the gun to kill Travis
-2nd story of intruders and Jodi's escape
-turning cell phone off as leaving California so ate can't be tracked
- changing the color of her hair after she rented car, changing it back again before she returned car
-renting inconspicuous car 90 miles from her own home
- subsequently admitting to killing but not reporting Travis' death, acting like everything is fine with new love interest a few hours later
-leaving voicemail after Travis died, pretending like she still thinks he is alive
- her own words that she needed to move on from Travis because he had found the person he was going to marry
-hiding/disposing of murder weapons and clothing
- indications of obsession before the murder
-waiting to assert self defense for 2 years, and only when the evidence disproved her other lies
-killing him 3 times over

That's a lot of evidence of premeditation, and thats really all they have to prove in this case. I think they put on all the evidence necessary to eliminate reasonable doubt about premeditation and the cruelty qualification.

They don't have to put on any evidence about self defense until after the defense put on their case.

JMO, said to relieve my stress.

No doubt in my mind, Travis didn't want Jodi there that night. She just sprang it on him, even the way she tells it. He needed to get ready for his trip. He was cleaning his house and preparing to go on an exciting trip. When she got there, he was more interested in watching some silly nonsense videos, and she felt ignored. It was all in her mind that he wanted her and her nasty sex! JMO

Agreed.

Me for one ..
Well in no way am I on TEAM Jodi BUT >>>. If I was on a road trip that many miles by myself I would have pepper spray and a gun JMO

Didn't JA admit that her phone was not working. That she was on her way to Utah and not Arizona. So how are they to convince the judge that TA knew she was coming if he never received a call from her? No one knows how she got in (unless she used the doggie door) and obviously his roommates did not know she had been there. The person who could confirm she was invited is dead. jmo


JA sort of "admitted" that her phone wasn't working... but only as part of her lie(s) -- to Det Flores in the interrogation when trying to explain that she was nowhere near Travis (her phone "died" as she got within range of Mesa and magically turned on when she left the area). The phone wasn't working as she was driving around lost but then she found the charger under the passenger's seat. The "JA rule" - 7% truth 93% BS.

Sorry if Someone said this but even in JAs fake call to Travis after she killed him at 1130 pm
She was saying how she got lost etc etc invited him to othello play-so how would that go along with Travis "expecting" her visit? She was making like she'd never been there at all hours after she killed him where's the evidence he "expected" her?

I think she established that Jodi was the same ole Jody.. right after she murdered Travis.

If she was abused, etc wouldn't you think she would tell her best friend that she talked to all the time? The same friend that she shared that she was having a sexual relationship that was forbidden?

I think the jury got it too... they asked how many times the two talked/communicated (her answer was too many to count).

A directed verdict can't be guilty in a criminal case. The defense is asking the court to acquit her without consideration of the jury citing the State has failed to meet its burden.

That's my understanding but my legal knowledge is sketchy at best. ;) Not gonna happen in my opinion.

Is court done for today? I had to step out and when I returned i just heard the judge say something about January 28 and then the state seal come on. :-) Sorry, I'm lost. ;-)

no way that flies here. they know it too.

I dont know. I am really worried that the DEFNESE will just not call any witnesses and say they changed their mind because the state has not proved she killed him.

The defense can say that Jodi was so scared of LE that she made up all the stories because she was afraid of them.

I just wish the state would have called a lot more witnesses to show that people thought she was a nut case. The more people that show she had the capability to do this.

Also show that she visited the other guy the day after murder. That is critical.

I think the defense is not going to call hardly anyone to prevent the state from doing rebuttal.


bbm - Ryan Burns? He testifed. He talked about their romp, or mini romp, their history, their communication, the cuts on her fingers, her fiesty-ness, her six pack, etc. Was there another guy she visited the day after the murder?

My brain kinda melted when the State rested. When is this trial supposed to resume?

Even though I think JA is guilty I think it is outrageous that the Court leave soff for a few weeks with the defendant claiming innocence still incarcerated and the victim's family in limbo over justice for Travis.

I already forgot if the trial is to resume January 22 or February 22....
