Jose Baez Press Conference - Wed., 1/21/09

If JB wants people to quit questioning his "ethics" he needs to provide answers to some tough questions-

1. Who is the anonymous donor that bailed KC out the second time? Why is it a big secret, if it is not someone media related or a media outlet? (I beleieve WS traced something back to the Nashville outfit that TB is connected to...?)
2. Who paid the bail to get KC out on the check charges? Granted, it was small amounts, but KC has no funds, nor did CA or GA mention paying these bonds. Where they posted by JB? Where'd he get the money?
3. Is KC receiving money for licensing fees, etc? Does JB have some sort of client account for her, like the lady lawyer had for Larry Birkhead in the ANS fiasco? Does money go to that account and then checks are written to pay JB and his "experts"? (didn't JB say something recently along the lines of KC has not been convicted of a crime and therefore is entitled to receive fees?)
4. If not getting money from media fees, funneled through a client account, WHO is paying JB and the experts, PR people, spokesmen, etc.? And why would that entity pay for KC's defense if there's nothing in it for them (like exclusive interviews after the trial, etc.)?
5. What exactly is his relationship to GR? Did GR's production co. or Fox pay above normal licensing fees for photos, etc? (Let's remember Rupert Murdoch's Fox network is only part of his media empire- including the tabloid The Sun, and who knows what else)

I know there's more, but I'd settle for these answers for a start.

Oh he is NOT pulling the ethnicity card. HAS HE HEARD OF ALBERTO GONZALES? The former ATTORNEY GENERAL? I'm sure he's had a few big cases.

Oh puleez, the race card? Is that all ya' got Baez? Well, we KNOW you don't have much with this defendant. Stop yer whinin'.

It seems kind of funny that the same day JB deny's any financial wrong doing, the public heres about a British Prod. Co. already making a movie. These may be separate issues but could be wise to investigate the production co. if we have a name.

That's one of the things that got me started on Rupert Mudoch and Fox....Murdoch owns the infamous British tabloid "The Sun" (remember Prince Harry in the Nazi outfit?- that was them)

I was speechless (quite a feat) when I heard him play the race card--first hispanic attorney to handle a high profile case, my eye. :furious:

You know, I'm not so sure that "unprofessional" or time wasting press conference or being on the Today Show or Geraldo's show are really going to be grounds for a new trial/appeal for ineffective assistance of counsel. He's filed lots of motions, he's got experts retained, he trying to conduct discovery (although he's not really effective at it) so I'm not really sure there are any grounds for ineffective assistance of counsel at this stage of the game. I'm thinking you'd have to wait till the trial is underway for that to rear its ugly head, and I suspect it won't happen.

I've heard about ineffective asst of counsel grounds arising from attorneys sleeping during a trial, failing to call witnesses to testify but not for making stupid unprofessional mistakes.

I've heard he should pick a venue where that is unfavorable towards law enforcement. Does anyone here from Florida know if that applies to Miami?

Since when does an attorney choose the location? I thought that decision was up to the judge.

KC and KC's lawyer seem very much like two peas in a pod, don't they? When listening to each of them talk, one could infer that, as far as they're concerned, it's all about them. Memememememe.

one thing casey forgot to do on her puter searches was look up decent lawyers for her future case. imo

He is saying he has been attacked personally by certain tabloid news media and it doesn't personally bother him...but affects him when it affects those close to him. He says he took an oath as that of a defense lawyer.

He says he feels very strongly about going through him to get to his client. Doesn't care what kind of speculation is out there, but gets to the point where it is getting inflamatory...

Oh! I'm a day behind on this. lollol
so, he feels personally attacked by a certain media----but it doesn't personally bother him...

high profile case aka a case that I have no hopes of winning but it won't make me look bad because NO attorney could have won it!

You are right. It is extremely difficult to get a mistrial from ineffective counsel. There must be an error of law made. This applies to the judge for example reading the wrong instruction to the jury. The fact that a lawyer is not that good or even sorry doesn't matter. Its kind of luck of the draw. That is why is pays to get a good attorney. Unless you can prove your attorney did nothing, Like never returned your phone calls the defendent has nothing.

I am not sure why he would play the race card anyway. South Florida is mainly hispanic. Not sure if Orlando is really considered South FL, probably not but either way FL has a lot of hispanic and many are well respected. That is the biggest garbage I have ever heard.

Honestly, I have been appointed losing cases before and you just do the best you can with what you have. You make sure the law is applied correctly, the rule of evidence is followed. You make proper objections and try to show your client in the best light possible. For instance, yes my client is guilty or murdering her daughter but she doesn't deserve the max sentence. She has not prior convictions, she is a good citizen. She is very sorry about the situation, etc.

I still can't understand the whole she is 100% innocent line. Does he mean innocent of 1st degree murder in other words it was an accident. Or does he mean she didn't have anything to do with her daughters death? Big difference. Sorry to rant.
