I think that Josh's attorneys have told his parents to say nothing about his charges.

Finally! The plug is pulled on the Duggars. And Josh is going to drain JB's savings...a trial in November? Cha ching, cha ching for those billable attorney fees.

It is sort of ironic. Josh always seemed to be the "favored" child. Now, not only has he derailed the TLC money train for the 2nd time, but he is also costing JB a LOT of cash.
Hitting his dad in the wallet is the least of my worries. He is a full fledged creep and will continue to get away with this. Cancel the series and lock him up indefinitely. That might be a show I would watch. IMO

Josh’s legal issues could cost his parents every penny they have. What a shame.

Would JimBob be obligated to pay Josh’s legal fees?

Would JimBob be obligated to pay Josh’s legal fees?

No parent is obligated to pay a child’s criminal attorneys’ fees. I think @nyvictoria is presuming that Josh’s parents are footing the defense bill - a reasonable assumption IMO.

Not simply because the parents might be embarrassed if their son requests a public defender, but because his request for a public defender could lead to scrutiny over assets (and how they are titled) which, in turn, could lead to potential tax liabilities. All JMO.

It could get rather interesting if a civil suit arises.

Josh isn't a minor but I'm willing to bet that daddy signed on as guarantor with the lawyer, which then makes him financially responsible.

That’s a good point. In their motion for 6-month extension, the defense team indicated voluminous discovery. That’s easily a solid 5-figures IMO - wise for Josh’s team to get a guarantor.

  • Attorneys for the former 19 Kids and Counting reality star say the government is withholding details regarding a screenshot that belonged to Duggar
  • The screenshot was gathered by local authorities, and Duggar's defense is looking for details about when it was taken and how it was obtained
  • Duggar's attorneys say prosecutors have refused, and that the details could be vital to his defense
  • Duggar was arrested on federal child 🤬🤬🤬🤬 charges on April 29, and has pleaded not guilty
  • His trial is scheduled for Nov. 30, and he could face up to 40 years in prison

Ugh, the info in the article is difficult to read and absorb. If Duggar's wife is aware of any of this and still wants to stay with him then I can only hope she guards her children well.

I can't see any way Anna could continue to believe Josh didn't download and view this material. She may be willfully ignorant but I doubt mom and dad Duggar are as gullible. MOO.

I feel sick to my stomach. And Anna is a complete fool if she continues to allow him access to her prepubescent daughters. This is some high level sick stuff he's into. I also hope someone has interviewed the girls to find out whether he has abused them.

I find this whole case so intriguing!!! I mean come on! We watched this super religious family grow up before our eyes, preaching about how the girls should dress a certain way so as not to stir up the sexual desires in the boys. Well how’s that working out for you now? <modsnip>
And nothing was ever said about how the boys are being taught to be respectful of people’s space, and how they are being taught sexuality and not to touch other people, or how we send our kid for deep psychological evaluation when we know he’s sexually assaulted his own sisters?

OMG, it’s a whole chapter in Psychology 101! What’s next? There’s just hundreds of these gold nuggets of info left to uncover in the Duggar saga. Get out your pens and paper boys and girls, here comes some some lessons to learn in the next episodes of “How Not to Parent your Children” by J & M D. <modsnip>

Adding - MOO

Prosecutors in Josh Duggar's child 🤬🤬🤬🤬 case say his attorneys are on a 'fishing expedition' for additional info

Now, this is interesting. I may be reading more into this, but it looks like Josh's attorneys are trying to flip this to state court. They want information about the "Arkansas LEO" who downloaded the material from Josh's computer. I think that the next step here is to make this a jurisdiction issue. And flip the case to the State of Arkansas.

If they can manage that magic, it eliminates "mandatory minimum sentences". I must say, that JB is getting his money's worth with these attorneys. Very clever maneuver, in a case that looks pretty cut and dried. It is obvious that they don't have much to work with here. So, this is a last ditch effort to save Josh from federal prison.

Can you explain more? My brain is fried and my civil procedure texts are in the attic.

"Whether child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬 charges come from the state or the federal government may depend on whether it was state or federal law enforcement officers who carried out the arrest. However, a person arrested by state or local police can still be charged in federal court, and federal child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬 sentences are often more severe than State sentences.".

So, I don't think that this will work, because even if local officials are part of the arrest, charges can still be federal. I didn't add link, it was a commercial site I copied that from.

But, it is creating wriggle room for negotiations. And I am guessing that the attorney is trying to get the charges against Josh state charges. This is all a guess on my part. But it looks like the only viable option here when the evidence is ironclad.

So if he used the same password for this as he did for banking and other benign activities…that’s a rather strong piece of evidence against him, right? Is he going to claim that he was “hacked” and the hacker used his password to access/plant CSAM but left his bank account and social media untouched? I’m curious to see how he’ll explain the password.
