Not sure if I'm answering your question, but people are allowed to video call inmates; it's considered remote visiting. This is why Anna is video logged as having called Josh so many times. She is not allowed, however, to make phone calls to him; he has to call her.

@Cool Cats in your #730 post in paragraph #4 it says Anna made 2 calls to him on Christmas day totaling 27 minutes. The paragraph following also said she called him. That’s where my question originated from. Am I confusing it?

I still think he was calling her, never heard of anyone calling inmates in jail, State prison or Federal prison.

Josh sits in solitary, no way to take calls.

But like @mickey2942 says it could be special calls for the holidays.

Perhaps, it was a special event, for the holidays. I believe that jails and prisons have made more access for video chat, since in person visits have been suspended indefinitely in many prisons and jails due to Covid-19.

I changed my post, I don't think she normally calls him but I think you could be right that it was special for the holidays only.

Generally, holidays are depressing and lonely in jail or prison. I wouldn't be surprised if Josh has already had a psych evaluation for sentencing, probably from two different psychologists, one for the defense, one for the prosecution.

It wouldn't be surprising if Josh Duggar was depressed. Maybe he has been allowed more calls, or video chat based on recommendations from his team.

Josh Duggar asked a judge for a new trial in a motion that tried to blame a former employee for the child sexual abuse material found on his computer

Duggar's attorneys filed a motion Wednesday evening asking the court to acquit Duggar of downloading and possessing child pornography, and complaining that their client was unfairly prevented from calling a "necessary witness" during the seven-day trial.

That witness was a person who had worked at Duggar's used car lot in Springdale, Arkansas. Duggar's attorneys said in their motion that the former employee — who was also a registered sex offender — had "regularly used the desktop computer in the months and weeks leading up to May 2019."

Duggar's attorneys said that former employee, who had previously been interviewed by federal authorities and prosecutors, sent an "unsolicited email" to a prosecutor shortly before the trial. The email stated that the former employee had been "completely mistaken" when he told investigators he had not been at Duggar's used car lot, according to the motion.

The former employee said in his email that he had been in Arkansas between May 8 and May 11, 2019, days before Duggar's child pornography downloading activity, and that he did not recall whether he used Duggar's computer during his trip. The former employee also sent a number of text messages, travel information, and receipts showing his various travels that month, according to the motion.

While Duggar's attorneys acknowledged that the former employee hoped his email would "establish that he was not at the car lot on certain dates in question," they accused prosecutors of improperly concealing the email until three days before Duggar's trial started.

They alleged that the former employee sent another follow-up email after the trial started, which included the social media passwords of several other Duggar siblings. Duggar's team said this information would have helped them show the jury that multiple people had password access to various Duggar-related accounts.

"In this case, Duggar was deprived of materially exculpatory evidence until the evening before the Government rested its case," his attorneys wrote.

Isn't it incumbent on the defense to establish this information? They knew of the employee in question, and his hours of work. I don't see anything that the prosecution withheld from the defense.

This is what I thought his defense should have been all along, and I was surprised that they didn't bring this up previously...seems a bit late to me.

I agree. I think that the defense was aggressive in the beginning, and then seemed to just shrug, and go through the motions. Wonder what dynamics occurred?

My BIL is in jail. We send him $$ and there is an app we can call him on. We can video chat or phone chat or just email. But we can set a time and call him.

I hear what everyone is saying and agree his legal team should have investigated and brought up this witness at trial. What I don’t know is discovery rules. Was the state required to turn over the communication from this employee to JD’s legal team? If so, what is the legal timeline? For the record, yes, I think he is guilty. Curious if the government made an error here.

They didn't present the case of the other employee who may have downloaded the material. No doubt in my mind that the guy is a pedophile who downloaded this material. But, ineffectiveness of counsel is often a reason for appeal even though it is usually not successful.

In the face of unimpeachable evidence, Josh wouldn’t take a plea?

How did this sex offender ex-employee come to be employed by Josh? Did they meet on some CSAM site? Did they ever share materials?
