Was the Crown treating TLM as a hostile witness today?

Is the Crown "allowed" to call in the Statement of Facts etc. from TLM's "trial"?

Nurse I know they have shown the video from outside of HD but the Crown also claims there is further ones from the PetroCan showing MR getting out and back into his car, after he had used the ATM machine. These videos I am hoping will be much clearer and closer up to positively ID MR and hopefully TLM sitting in the passenger seat of MR's car. :moo:

I wonder if there is video footage of him at the Tim Hortons?

What year did MR move to and leave Guelph? What I am trying to establish is how far back he lived in Guelph and how long he may have been involved in drugs.

There doesn't necessarily have to be a correlation there. He could have been involved in drugs long before he moved to Guelph, long afterward, or (if TLM is lying), not at all. None of the places he's associated with are that far apart. People travel and can work in different towns from where they live. BA was said to be (have been?) a real estate agent. I suspect she covers more than Guelph and could have easily traveled to Woodstock, Toronto, etc. According to TLM, MR bought drugs from her in Woodstock. BA was obviously not his only connection to alleged drug buying.

This, to me, clarifies which "version" of the story came first.

She blames MTR first, she confesses she did it secondly (and currently).

In testimony at Mr. Rafferty’s trial here, Ms. McClintic has told Ontario Superior Court Judge Thomas Heeney and the jurors that she pointed the finger of blame at Mr. Rafferty for the murder because at the time she couldn’t face up to the fact that she had done it.

Thus Friday, Mr. Gowdey was questioning her about what, as Judge Heeney later told the jurors, “is known in the trade as a prior inconsistent statement.”

Because Ms. McClintic didn’t “adopt” that earlier statement, the judge said, the jurors can’t treat it as evidence, but must use it solely to assess her credibility.

The legal language and niceties did nothing to soften the impact of the 21-year-old’s testimony.

I never saw it tweeted that she was treated as a hostile witness today or in days past (and to be truthful there was hardly any testimony with the jury present today?)

Where did the crown say this? Im curious as very close to the HD in Guelph there is a drive thru ATM. I am wondering if the trio was captured on camera during this transaction.

Most kids drive automatics these days. It's like playing video games. In view of all the other illegal things these two have done, I doubt if driving without a license or insurance would have been any big deal.

I'm wondering what medications TLM is currently on? I have heard from people actually INSIDE the satelite court room that she is incredibly slow in giving her responses to questions, and that she speaks almost inaudibly. At times she is slower and quieter than others, and I wonder why? Perhaps she is being drugged in the jail? Anti psychotics? Anti-anxiety? A little sleeping medication to help her get to sleep then something to wake her back up perhaps?

If she is presently taking any prescribed medications can her testimony later be called into question? Can the defence then argue that she was under the influence of mind altering drugs, and therefore could not give concise, clear, accurate testimony?

Just my opinion and something I'm wondering about.

I doubt it. It is up to the jury to assess her credibility and demeanor. As long as she is coherent, she can testify. I'm going by rules in the US, but anyone can be a witness. The capacity standard is very low - as long as they have first-hand knowledge and can express it, they can testify to it, basically.

Great questions WG. Let's hope they are allowed to bring her SOF into evidence. I wonder if TLM is suffering from irreparable brain damage from all the drugs she's done over the years, and starting at such an early age when brain development is so vital. Maybe she doesn't really know what she attested to during her first and second interview with Det. Smyth. In all likelihood, now receiving counselling and therapy, she wants to believe the impact of her past life and traumatic childhood could have caused her to do something this wicked. JMHO.
