After McClintic said yes, Gowdey asked her would it help to review a portion of that statement.
“I recall it clearly, but I could review it, yes,” she said.
McClintic took about a half an hour to review the statement. She was then asked if, after reviewing the statement, she’d like to change her testimony of this week.
No, she replied. “It was myself that, in fact, committed the murder.”
That led to McClintic and jurors reviewing segments of her May 24, 2009 video statement, and answering Gowdey’s questions.
At times, McClintic cried as she watched herself sob and struggle in the video to make sense of the killing. Some of Tori’s family watched in tears and others with grim looks on their faces.
McClintic’s video statement released more graphic details of how she and Rafferty tossed Tori’s body near a pile of rocks.
Gowdey suggested to McClintic that every interpretation of her video statement put her away from the scene while Rafferty did the kicking and the killing.
He also asked why McClintic couldn’t tell police on May 24 2009 how many times Tori was kicked and then struck with the hammer, if she did it herself.
“Your efforts to implicate Mr. Rafferty were thought through so carefully that you would make up a story that didn’t even have the exact number of blows? Is that what you are saying?” Gowdey asked.
“I guess so,” McClintic replied.
