I haven’t seen her in this thread, but Gitana is a verified lawyer. I saw her over in the Turpin thread (the 13 abused kids in CA).

So is SBHack, but I’m pretty sure her baby is due right about now!

I am sickened by all of these photos of this battered little boy. In my opinion, every single person in this little man's life failed. Failed miserably at protecting him.
Can someone help me understand why the abuse was reported to NM & not KS? I am unclear on this piece of information. For example, if you smell gas do you report it to the gas company in another state.

It’s my understanding that it was reported to both agencies. The reporting family member was in NM.
 
Absolutely kkdj. I will leave room for my opinion to shift on my conviction of JH's reaction to the progression & severity of the abuse. Once all the facts come out pics are with reports, the contact made are known. I'd have an opinion on JH's reaction vs reasonable expected response. Looks like he had plenty of time to get his house in order. I just cant say for sure, yet


Adding: I'm not legal literate so help me out if I'm saying it wrong. What I mean is I am still open to JH being charged with a low penalty crime all the way to saying JH is culpable negligence walking. Did JH have reasonable information & time to know EG was capable of murder? He should have kicked her to the curb immediately!!!! We all agree.
Yet CPS left Lucas with EG as well. Are we really already willing to say the is no more need to be receptive to new facts? Whichever way the pie crumbles, I'm not.
 
I don't know... I know that that one article said that Lucas's bruises happened more often after EG and JH would fight, but I honestly think we're just dealing with a couple of unstable adults with anger management issues. I think violence was just the norm in that house, hence why JH didn't see anything wrong with Lucas being bruised all the time. AND why he'll take EG back now. AAAAND why he said "no, there's nothing that indicated that something like this would ever happen." No, of course not... because their family just yelled and smacked each other around... they weren't the type to let it escalate to killing each other. Except that smacking each other around is not ok, and no one thinks their situation will escalate... until someone ends up dead.
 
I have similar questions in terms of the charges on something like that. Is it a crime to steal the pad and then another one every time it's used? Is the pad considered one item, or is each separate page considered an item (since there could be a theft using each one)?

It would be one charge, with every time it was used being a count......so it would be 3 counts of forgery if it was used 3 times for example.

Good thoughts. But, wouldn't Lucas be telling his daddy if he went to the Dr, if his injuries were from EG smacking him around, throwing things at him? He told others. Wouldn't he be telling his daddy?

No, sadly children who are abused learn pretty quickly what not to say and who not to tell. Their world is unsafe and they figure out how to survive in it by staying silent. If it weren’t the case abuse wouldn’t happen on such an epidemic scale. It crushes my soul to know Lucas cried and found no comfort. At least in a house run by his tormentor.

All of this! I am glad you said this. Family can only do so much before they make themselves into criminals too, in the eyes of the law. I feel that LH's family did everything they could, and the system failed them, and failed Lucas. And people saying otherwise to them doesn't help...these people are dealing with a tremendous loss, and I am sure are questioning if they could have done more, even though deep down they know they did everything they could have.

I agree Wildcat. I feel they have been let down just as much as Lucas was. That is tying their hands without actually tying them.

Every single time I see posts of people saying that everyone in his life failed him, I can’t quite work out how that person can be just so selfish.

No, they would have to do it all then for that specific incident. But if she stole another letter or pad for example on a different day then that can be charged again. However, the DA will usually chose which charges they will have the best chance of winning in court and not charge the other ones. There is a thing called malicious prosecution, which is kinda subjective, but if time has passed and another incident comes to light, they can charge them again.

I believe it was because they were visiting at the time in NM as they had family there that noticed and reported.

Especially since so many literally sacrificed their relationship with Lucas (and the whole family) trying to help. They reported it knowing JH and EG would cut them out of their lives. It's just devastating.

So the charge against KE is from 1/11. Are we thinking the alleged crime is that she stole the rx pad or whatever on that date? Forged her first note for whatever on that date? Subsequent use of the pad on later dates are irrelevant to this charge, but once this charge is played out, they can then charge her for any other forged notes-including notes that are possibly in relation to Lucas?

Please know that this isn't directed at you, but I have seen folks question the timing of the possibly theft of the doctor's RX pad and such.

I believe that that was when it was noted it was missing- Jan 11. At that time, they might not have known who stole it until after Lucas was missing. Perhaps they used it at a later date to excuse his absences from school and perhaps she got caught when a note was written with the doctor's name and letterhead on top..

He denied any abuse, was home that we are aware of at least two times when the school called that Lucas was ill and needed to be picked up, yet EG is the one who picked him up both times. He saw the bruises and injuries. Maybe I am just so angry at this point, but IMO JH chose EG over his children, therefore I cannot muster one ounce of sympathy for him at this point.

I don’t think that’s a fair statement to the family members who tried to help by calling CPS in NM and KS. I’m sure they will forever live with their own misplaced internal guilt at not being able to save Lucas. They don’t need added guilt from the general public.

More then one family member on both sides of the family reported suspected abuse - in NM and KS

I reread my post. I see I made it sound like only family in NM reported. I was simply referring to the NM report being by family in NM. KS family also reported. Thanks for giving me the opportunity to clarify what I meant.
