Well, DCF records can not be released if there is an open investigation. The most that could be released would be any court filings with redactions unless it's under seal. Since another child was also taken into protective custody too I seriously doubt the records will be released right now. Until this is charged as a death due to child abuse or mistreatment then it's not subject to an open records request. You have to remember that DCF records aren't considered public records, only under specific circumstances will it be released. I hope I answered your question, I do go off on a tangent sometimes Has the ME released the cause of death?

I really really wish that family members who know stuff is going on. But they’ve done all they know to do. I wish they knew that in Kansas you do have other options. There is a way around waiting for dcfs to investigate. I know I didn’t know thankfully I knew a social worker who worked with Dcfs . She herself said The system is flawed , but told me what I could do without dcfs even being involved yet. Sometimes waiting isn’t the answer or cases can’t be proved. It’s so sad seeing all these grandparents hurting , feeling so hopeless. Not knowing what more they could of done. I was in that spot but thank god this friend gave me solid advice. I really believe it is because of her advice actually it’s because of Lucas I kept searching for answers and she told me what I could do. Because of Lucas I did it. My guy is thriving he lived to see his 3rd birthday. He will also make it to 4 in a couple months. These family members who have to go on after children they loved suffered abuse in the hands of parents. They are so much stronger then I am. I hope they find some sort of peace. I hope they don’t spend the rest of their life’s playing the “ what if” game. Because no one informs us of options. It’s always make a report. But you can make report after report. You can take them to doctors. But it’s still not always enough.

I also think that in some cases more investigation needs to be done, when a parent loses custody of older children. Then has more or is a care giver to other children. They need to make sure it’s a case of one parent better suited etc with the other kids. Make sure it’s not a case of mom or dad actually lost custody was proven unfit or had prior abuse cases open. It might mean nothing but in so many cases you see this. Mom has a new baby yet doesn’t have custody of others. Because the case was involving the other children. But past behavior is a indication of future behavior. I just think these situations should at least be followed up on. If you only have supervised visits with one child , then you are sent home with no questions asked when you have another. Well that’s concerning. This was also my daughter , she could only see her then 3 year old son when I was present in my house twice a month. His dad preferred the visits be under my watch then at a center. Anyway she gets a new man and has a new baby but she’s free to do whatever. Or she was until I stepped in. This type of situation seems really flawed imo

A man and woman have been charged in the death of their 3-year-old son and with injuring the woman's infant child in south Wichita.

Patrick Javonovich, 28, and Brandi Marchant, 22, were each charged Tuesday with first-degree murder, two counts of child abuse and one count of aggravated child endangerment.

It amazes me how these parents act surprised about the charges. WTH did they think was going to happen with their dead son in that home for 2 days. Plus the 4 month old being is critical shape. I just don't get the stupidity of some people. jmo moo

Didn't they say the infant also had injuries? I may have that wrong though.

So most likely the 3 year old was beaten somehow, and then left to die in his crib all alone?

It doesn't sound like he died from being neglected or starved to death, although I have no doubt they also maltreated both of their boys with both being greatly malnourished.

I imagine the autopsy will find trauma (new and old) throughout his body with possible brain bleeding, and brain swelling.

I will never understand why so many parents or a parent, and/or a live in, gang up on their tiny children, and unleash such unimaginable pain, prolonged suffering, and brutality against them.

So many would have loved to have had a chance to be able to raise, nuture, love, and care for all of these little abused children BEFORE they wound up dead, or injured.

I totally get the frustration and anger you are feeling. Just as a perspective on the other side tho, most states don't have a database of parents convicted of abusing their child. And the ones that do, those databases aren't open to just anyone to see. Unless someone reports that a mom is pregnant again to CPS, no one will know there is a child who needs protection. Hospital staff will only report a mom who is under the influence while giving birth or the baby has drugs in their system. And since babies born drug exposed often are premature, sick and going thru withdrawal, the baby will remain in the hospital long enough to get the courts involved. State laws in Kansas won't allow for long term removal of a child unless the parents is charged with child abuse or neglect. You can remove for 72 hours into protective custody but if no charges are filed during that time then the child often returns home.

I do want to say I don't agree with the logic or the system, but it is what it is. We have to know what's broken before we can fix it. And we especially have to work within the laws of each jurisdiction. It starts with the laws in my opinion because policy changes won't work if they aren't allowed or supported by the right laws.

Police confirm DCF had contact with the Javonovich family.

"We that know DCF has reports or have been involved. I'm not going to go into detail with those. I haven't seen those reports," says Captain Brent Allred.

Zaiden's grandma calling them herself.

"He wasn't gaining weight. He was 2 years old and he couldn't wear size 2 clothes. We called on them. I called on them myself for a welfare check," says Donna Lloyd.

We reached out to DCF. They aren't able to comment on Zaiden's case yet, but they gave us this statement:

Eyewitness News is learning more about how the Kansas Department for Children and Families was involved with two-year-old Zaiden Javonovich and his parents prior to the boy's death.

In response to a Kansas Opens Record Act request filed by Eyewitness News, DCF said it completed its investigation surrounding Zaiden and found substantiated physical abuse and physical neglect in his case.

The agency said it investigated two previous allegations in relation to Zaiden's mother, Brandi Marchant.

The first documented claim was on November 5, 2017. DCF was called in to investigate the "allegation of emotional abuse arising from allegations that Brandi was making homicidal and suicidal statements in the presence of children."
