No one took the fifth yet. Hearing going on about JH and her son who would if called by defense. Arguing still going on.


Judge just changed his mind and is going to quash the subpoenas.

'Had to go to the law library to settle this!

Lt. Smith is testifying for a hearing in front of the judge (no jury). Smith says the shell casing found in the victims’ home matched the gun seized from the defendant’s house. There was also a military dog tag of the defendant’s found in the victim’s foyer.

IMHO and I just signed up to post... <modsnip> She and her son look like they are going to testify but invoke the fifth amendment.

Why would he place his dog tags high on a shelf to not be found by CSI's but found quite a while later by relatives cleaning out clutter?

Are you talking about Martin's dog tags? I thought they were found at the Phillip's home

They were. Six feet up on a shelf in the back of the house near the back porch/kitchen. Nobody even looked at them.

I think the defendant had told J H that he was going to divorce her/move on since JH was still married to another man so was not legally married to him. He already had a new fiancee. And it sounds like she was already living with him.

ETA- J H said she would ruin his life.

This case is a doozy!

The judge gave him 3 mil cash bond, so they must have enough on him. Lots of other questions though.

I almost think the wife/exwife bigamist and/ or son may have done the killings and planted the dog tags to frame the defendant.since she would lose his pension and other benes if he divorced her. She and her son look like they are going to testify but invoke the fifth amendment.

The CSI's missed at least 2 significant pieces of evidence. Namely, a shell casing found in the back porch under building debris and the defendant's dog tags on the shelf about 6' up. Pretty cluttered up house,though.
In my life about 29 years ago,I lived in an old ( 1890)Victorian that was in a perpetual state of repair so I can see how they missed them.

OOPS, this Commonwealth witness just let it slip that Joan Harmon was “prosecuted” [as in, her bigamy case] which the judge ruled shouldn’t come in…in favor of a prosecution pre-trial motion. Did the jury notice? Parties are now in sidebar. #KYvMartin


The Major is done testifying. His last response confirmed Kit Martin’s court martial sentence in 2016…90 days incarcerated and dismissal (not a dishonorable discharge) from the Army.

Court adjourned for the day.
