Mr. Martin is now testifying he got one of his German Shepherds back, of the two Joan took, when Mr. Buckner called him, the dog had lost half his body weight and had a broken leg. The Vet stated to Kit it was horrible abuse.
I think she is making a boob of herself. MOONot sure if the state is winning any points with the Jury with the attitude and line of questioning she is pursuing...any other thoughts about how this cross is going?

I had a Court-martial where my client’s wife appeared to have a borderline personality disorder and she threatened to kill his dog, among all kinds of chaotic behavior that he recorded surreptitiously. She talked about how her abusive her ex-husband was. She tried to hit him with her car. She threatened to ruin his career when he filed for divorce. Joan sounds very similar. I would bet that she has a BPD. Big indicator is fear of abandonment.Sarge, the one he got back abused was reportedly his dog. The other one, Captain?, was Joans. It just follows that she would treat her dog better.

I believe, and someone correct me if I am wrong, that they can not mention that they have taken the 5th Amendment. I can not remember if this is a Kentucky law or if it was something that the Judge ruled on at the time of his decision.Does anyone know whether or not in Kentucky the Defense can comment on Joan and her Son invoking their 5th Amendment right to remain silent and not incriminate themselves? Because they should. If I were the Judge, if I had the discretion, then I would allow it because the State did nothing to investigate their whereabouts or exclude them. If the State had evidence that showed they were in another State or out of town or ANYTHING, then the unfair prejudice might outweigh the probate value. But, I gotta say that the jury should hear the fact that they BOTH lawyered up. And the State charged complicity. Kit did everything he could possibly do to prove his innocence to include doing the State’s job. I’m not going to blame Kit if he looked arrogant after spending 768 days in jail due to these charges under these circumstances. I would be pi$$ed.
I can understand why that would apply to the State for co-conspirator witnesses, but in a SODDI defense case, the defendant should be able to call the witness and make them plead the fifth to each question that would incriminate them.
