Personally, I believe Mr. Martin and I believe he is truly innocent. And he just, imo, revealed a motive for Joan to do harm to the Phillips. In stating Mr. Phillips was key to proving Joan a liar and there was no basis for a Court Martial.

He locked up his Glock that was in his Tacoma the night of Nov 19th. Said his attorneys, etc. told him to lock it up as Joan had keys to the truck.

Mr. Martin is now testifying he got one of his German Shepherds back, of the two Joan took, when Mr. Buckner called him, the dog had lost half his body weight and had a broken leg. The Vet stated to Kit it was horrible abuse.

Sarge, the one he got back abused was reportedly his dog. The other one, Captain?, was Joans. It just follows that she would treat her dog better.

Not sure if the state is winning any points with the Jury with the attitude and line of questioning she is pursuing...any other thoughts about how this cross is going?

The defendant seems in control!
How is he ALLOWED to elaborate on his answers?!
He asks the state questions instead of answering!
IMO defendant comes off arrogant.
He did look like he was going to be ill when she got down to the murder timeline. He looked not-comfortable.

Does anyone know whether or not in Kentucky the Defense can comment on Joan and her Son invoking their 5th Amendment right to remain silent and not incriminate themselves? Because they should. If I were the Judge, if I had the discretion, then I would allow it because the State did nothing to investigate their whereabouts or exclude them. If the State had evidence that showed they were in another State or out of town or ANYTHING, then the unfair prejudice might outweigh the probate value. But, I gotta say that the jury should hear the fact that they BOTH lawyered up. And the State charged complicity. Kit did everything he could possibly do to prove his innocence to include doing the State’s job. I’m not going to blame Kit if he looked arrogant after spending 768 days in jail due to these charges under these circumstances. I would be pi$$ed.

I had a Court-martial where my client’s wife appeared to have a borderline personality disorder and she threatened to kill his dog, among all kinds of chaotic behavior that he recorded surreptitiously. She talked about how her abusive her ex-husband was. She tried to hit him with her car. She threatened to ruin his career when he filed for divorce. Joan sounds very similar. I would bet that she has a BPD. Big indicator is fear of abandonment.

I believe, and someone correct me if I am wrong, that they can not mention that they have taken the 5th Amendment. I can not remember if this is a Kentucky law or if it was something that the Judge ruled on at the time of his decision.

I can understand why that would apply to the State for co-conspirator witnesses, but in a SODDI defense case, the defendant should be able to call the witness and make them plead the fifth to each question that would incriminate them. Kit would not have had to take the stand.

JMO I thought the defense did a good job in their case and didn’t need to put him on the stand. I got the feeling that he wanted to do it…especially after seeing his interviews.

I thought he rambled on too much and his attorney had a tough time trying to get the answers he was looking for… it took some work.

I missed the cross, but sounds like it was about what I expected from this prosecutor. I find her pretty scattered.

Although there are still closing statements I believe tomorrow, my best guess right now is that there will be a hung jury or he will be acquitted. If it is hung and declared a mistrial, I question if they would retry this after this trial.

This trial is weird. Something is not right.
If he didn't do it, then who did? His alibi was that he was with her...so she didn't do it either?
She and son plead the 5th but no one can say that?
The only person I can think of who would be in a car with the 2 of 3 victims is her.

Said her son's father was dead before he was born but then wasn't?
Abuses a dog?
Pleads the 5th...for what?

And he has security info at his house that he shouldn't?

They're both sketchy.

Any humane dog owner would be nice to both dogs with zero abuse. Underweight and broken leg....that is abusive and no real dog lover would do that.
Something wrong there.

I had to leave due to an appointment at 2:00 so set the DVR and watched the prosecution when I came home. That prosecutor is a first class B. Just about as bad as Joan Harmon.

What/who was the judge glaring at when Martin got back to his seat at the defense table? I have nothing to do the rest of the week so will be here watching.

I hope Joan Harmon is still around and quaking in her boots about this testimony today. DO we think she is still being investigating for her part?
