Crown now up for re-exam. When a detective approached Liberatore in May 2013 and asked about garage rap, he said he didn't remember. Why?

Liberatore didn't want to have anything to do with the situation so he didn't want to tell police about the rap at first.

Under cross-examination, Liberatore's reliability as a witness is being tested by Smich's lawyer Thomas Dungey.

Dungey has gotten Liberatore to admit he had "memory fog" the day he said Smich showed him the rap song about burning a woman's body.

Dungey also revisited Liberatore's original statement to police, when he said he smoked himself "into oblivion" -- a reference to marijuana -- in those days.

Liberatore also agreed with Dungey that rap lyrics aren't always true and can be considered "entertainment."

Liberatore's statement to police also came while he was in custody for another matter. Dungey asked him if he gave police the information about Smich in order to "make a deal." Liberatore agreed.

I can't for the day that smoking weed isn't seen as giving you some sort of false reality. You can be stoned out of your mind but still know what was said. I hope the jury are marijuana savvy people.

I wonder if the Crown feels the need to explain the Eliminator and DM's story of why he needed it? Could DM's uncle have to testify again? Now that could be interesting.
 
Even though Liberatore's reliability as a witness is being tested, the fact that he told LE about Smich's RAP in 2013, and charges were not laid until 2014 does give the story some credence.

Oh, I believe him. The problem is that he's perfect for pointing out unreliability and creating doubt. I have faith in the Jury. They will see through the smoke and mirrors.

This trial has a very skanky, dirty feel to it. DM and MS's lives are really being seen for what they were. No smoke and mirrors will clean this up.

I can only shake my head and send strength to the Babcock's. If only Laura had never met DM. If only.............

Good question, why wouldn't they have to rehash the whole elimator story to this impartial jury? It's not like they can just show them the transcripts from the last trial can they? How does this work? Is this jury supposed to be ignorant to the fact that these two are already convicted murderers? :waitasec:

Exactly! They aren't supposed to know anything so I can only assume that we are going to have to go back down that path to explain how he explained the Eliminator and what it's supposed use was to be. I mean, this is where the Eliminator first comes into the picture.
 
I can only imagine what the first jury is thinking after hearing more facts like the rap by MS. A lot of stuff the police knew and the Crown but we did not know. The whole gang involved with those two just a cesspool of vile , uneducated, dregs to society. CN was educated but her character is so shady that I don't want to imagine her as a dr.

I'm trying to figure out where that timeline overlaps with the events around Laura Babcock. From the article, the engagement photos were taken in Spring 2011, however how long was the whole realationship?

They were predators DM preyed on LB and knew she was a vulnerable person and then when she started getting out of control probably due to drug use, he planned to kill her. They lured people on the buy and sell sites, and I sure the other two that they responded to the ad, just lucky that they did not choose them to kill.
 
Smitch is showing his true colours at this trial... none of the scared, young man, traumatized that DM shot TB...... that he was trying to get us to believe.... here we see his true self.... doing the deed and bragging about it.... JMO.

I'm actually disappointed by this. Blame it on my compulsive need to see good on people but I had really wanted to believe that the story he gave on the stand during the Bosma trial had some truth to it. That he was just idiot who went along to steal a truck as part of some equally stupid gangster fantasy they were all living and that DM killed Tim without MS's knowledge.

I'd really hoped that MS was only charged in Laura's case because of assumptions made from his proximity to DM. But from the opening statement onwards that pretty much went out the window.

Its sad. DM is clearly some sort of sociopath but I'd hoped that MS was a decent human who went horribly astray but there was still hope would be rehabilitated while in jail. It seems to me that by hitching his horse to DM he essentially committed suicide in a way.

DM's uncle seemed rightly annoyed at DM for involving him in the last trial. I wonder if DM will want to cross examine him or if he'll defer that one to a lawyer?
