I wonder if DM is trying to introduce that his insomnia caused a visit to the doc, which resulted in being prescribed some sleeping pills, which LB got her hands on...

I suspect given all of legal arguments whatever he's trying to bring into evidence is of borderline relevance or is an attempt to completely denigrate LB or MS character.

So far he's got the SL interview that was explained in his testimony, the fact that he and MM crossed the border (but nothing that shows MM brought ammo across) and the fact he complains about being tired a lot.

Possible he could hurt MM credibility if he can show she did bring ammo across but not sure who can help there beside MS so doubtful and even if successful she didn't have much that he didn't document himself in photo and texts.. The other stuff seems like shots in the dark.

DM is now rolling on his $25 mattress, "thinking" whether he should testify or not.

I noticed that dumb people have really hard times staying put. Somehow, for them doing something is automatically better than not doing anything. Even if it's absolutely wrong.

But for DM it seems to be all over. He may try to make sure MS goes with him, though.

Not quite.

The defence must disclose 30 days in advance if they plan to call expert witnesses.

Also, the judge ensures that any defence put to the jury must have an "air of reality," which would exclude some of the more fanciful theories tossed about here on Websleuths.

The jury was seated. Millard rose.

How he played with us all, like a puppet master who pulls the strings with those strangely long fingers of his. There was no opening statement, no outlining of what evidence he planned to introduce in his own defence.

With frequent apologies to the jury, Millard spent almost an hour reading each text aloud. “We got through it. Thank you for your patience,” he said when he came to the end. “Your Honour, that’s all I have for today.”

What does it mean? It seems we have to stay tuned for yet another day when all focus is on Millard.

I have no trouble believing that DM was very tired...

...tired of LB interfering with him and CN, so he killed her.

If he had a conscience I would say that was keeping him up at night, but IMO we all know that's not true.

Final issue :Telling DM to cut to the chase>then perhaps some more defence 10 am tomorrow.

Why the short day? DM had all weekend to prepare, so he should be ready. There were legal arguments in the morning, that took hours. So, why was the day cut short?

Lunch was starting late and then more legal arguments, so the rest of the day was basically filled.

ETA: That phrasing, "perhaps", leads me.to believe that maybe the issue they were dealing with this afternoon was about whether or not to allow Millard to present certain evidence. "Perhaps" we'll hear more tomorrow.

yes when was all this bad sleep....before or after July 3rd?
If he had a conscience I would say that was keeping him up at night, but IMO we all know that's not true.

Good for them...although it will never bring TB back, I hope it gives them some form of comfort

For some reason today is the first day I noticed that DM is now the same age as Tim was when his life was taken. From here forward DM will always have more life than he allowed an innocent stranger. It’s a sad, unjust milestone.

Legal aid gives you any lawyer available. Not one of your choosing. As the case would be with Dungey. MS is paying for his services.

I don’t think this is true! I got to choose my lawyer for custody battle. And it was through Leagal Aid. My daughters friends got my daughter into trouble and her leagal Aid Lawyer was chosen by us. So unless it’s all changed, leagal aid is not a court appointed lawyer. But there is a list of lawyers that accept legal aid, not all lawyers do.

They are still trying to find a business venture. !?!
DM's BIG revelation! ( it seems like to him) is selling moonshine.
This is nowhere near airplanes or a traveling Pet crematorium. DM shares it like it's a legit thing...more than missions stuff.
I need to go to be I am tired.

And DM is away for quite a bit more of April

Maybe Rabbit has snuck her chicken in a more comfy mattress. My good gosh, I seriously hope Rabbit realizes now her Tiger had more serious problems than sleep deprivation. He needed to see more than just a doctor. What a weirdo, freak, piece of work. He just likes to hear himself talk and nothing he says now will help his case. I'm just waiting for the finger pointing to start.

Good to know his worries will soon be over and he he'll have plenty of time for sleep in his quaint little cell.

It was just a comment, I have no idea about such things, I just thought I had seen it before in some high profile cases.

So do you think he’s being paid for by the family?

IIRC it was stated quite awhile back during TB's trial MS was receiving legal aid. Why would MS's family pay for Dungey to represent him when he is entitled to legal aid if he cannot afford a lawyer? If MS was a minor, then yes his family might be held financially responsible...if they could afford it. MOO.

All this speculation on Smich's lawyer situation is pointless because the possibilities are endless. Yes, Smich likely does qualify for legal aid, but his father appears to make a good living as a professional engineer. I'm sure his dad would do whatever it takes to ensure that Mark is one day a free man. Dungey on the other hand is benefitting from this case. It is high profile, which means Dungey's name will likely be recognized for decades to come. You can't buy that kind of advertising, so there is a good chance that Dungey is working at a reduced rate, possibly taking legal aid and money from Smich's dad. He could also be working pro-bono, again, building his firms reputation. These high profile cases come along only once in a blue moon and I'm sure that lawyers are lined up out the door to represent guys like this.

I don't think Dungey would do pro bono work for some punk kid who cremates people for fun. Give me a break.

Its a high profile case. I'll bet the Smich family is getting some sort of a deal.

I don't think MS's mother or father have any obligation to pay for their sons legal representation. He's not a minor- and there's nothing to suggest what his father would or wouldn't do. Other than that, I agree with everything you've said. :)
