Crown Cameron says Rufolo was asked to only analyze the photos through the lens that they may be deer bones, but he noted the bones could potentially be human.

Cameron, "Nowhere in your report does it say that it could be a human radius."

Rufolo says it was not in his report, but in "subsequent communication to Ms. Sherman" - she is counsel assistance to Millard - he made note of it.

Rufolo said he said "it's possible it could be human bone" but there were features that he found were more suggestive to deer.

His initial reports did say it was possible some of the bones were human but they may not be. Court didn't hear that initial analysis. #LauraBabcock

If he's wrong about the tibia, the rest of his analysis is wrong, he agrees. He has a question mark next to tibia in his notes. Also noted could be human femur, based on Dr. Rogers report. He can't be certain. (Nor could Dr. Rogers) #LauraBabcock

He was asked if any bones "could be a deer bone," initially, so his opinion is that if that bone in the picture is a tibia it could be a deer tibia. That was the basis of his examination. Was not directly asked if the pic showed human bones. #LauraBabcock

Ding....ding....ding! Only asked if it was deer bones. DMs lawyer forgot to ask him to compare to human. Then his “forgotten” notes he actually questioned if they were human....I say he’s paid by a certain Rabbit!

This crown is knocking DMs “expert” right outta the field!!

Looking at comparison of the deer and human humerus bones (If you write it that way you don't have to figure out the plural of humerus). Rufalo says if the bone in the pic was flipped over it would look like the bone in the blurry photo. #LauraBabcock

Crown needs to end with him saying it could be human bones. Otherwise his yo-yo response to questions will just continue. MOO

Identifying human bones is not your area of expertise? No. He's never consulted with police on a murder case. He's never looked at incinerated bones to compare, he agrees. When he prepared his report he didn't know he was going to testify. It would have been more professional.

Identifying human bones is not your area of expertise? No. He's never consulted with police on a murder case. He's never looked at incinerated bones to compare, he agrees. When he prepared his report he didn't know he was going to testify. It would have been more professional.

LOL! The request from a lawyer never tipped him off?

I'm confused, I thought he left his notes in Ottawa. What notes are they referring to when they say there is a question mark next to tibia? I was assuming that the 3 pages of notes on the hotel notepad were just notes he threw together last night when he got to Toronto or something. Does that mean even in the last 24 hours he was questioning whether it was a tibia?

Edit: also, at what point did DM's legal assistant ask if it could be human? Only after he submitted the report?

Cameron, "When you prepared your report, did you know you were coming to court to testify?"

He did not.

Cameron, "You'd agree with me your report is more casual, had you known you were being called to testify? You would've included measurements and methodology in your notes?"

He agrees.

Cameron says, "No doubt these are bones?"

Rufolo, "I have little doubt they are bones."

Cameron, "Possibly human?"

Rufolo, "Possibly yes."

Possibly one of the least favourite days and tasks of his career. For a researcher, Dr. R. might have thought to do a little more research before answering questions and providing a consult.
