From all the comments I've read by our esteemed verified attorneys here, grand jury testimony is sealed and cannot be released, even for perjury charges.

I haven't read through this thread but wanted to jump in here and say that I am 99.99% sure that portions can be "unsealed" and used for the purpose of impeaching a witness.


However, I can't see how Lippman's motion would relate re. impeachment because he would certainly not want his own client to be impeached.

(FYI: 'Beach knows I'm challenged when it comes to legal proceedings. I need to zip it. :silenced:)

I asked Mr. Hornesby his opinion about the motion filed and offered mine. I thought that perhaps Lippman could have filed a motion asking the judge to prohibit any contact or attempted contact from the defense or Casey during the trial--because of the two “yellow” notes at the end of the day (yesterday and today I believe it was) that were passed from Casey to JB to someone out of view... so, possibly a motion regarding witness tampering.

Mr. Hornsby was kind enough to reply and seems to think that it's about prohibiting the defense team "from insinuating George molested Casey until such time as someone has actually testified to it." and he elaborated a little more:

I'm confused again. I thought Lippman's motion would argue to stop the unsealing. If successful wouldn't that prevent his client from being impeached?

Sorry! I didn't mean to cause any confusion. I haven't read Lippman's motion, is it available to read yet? I don't know. Just jumped on and wanted to set the record straight about the exceptions to GJ testimony being unsealed for impeachment purposes.

ITA that Lippman will want it to remain sealed. He would have no reason to want it unsealed. IOW, I think we are saying the exact same thing, just speaking in different languages. ;)


fwiw, I tend to believe Hornsby is probably correct in his speculation about Lippman's motion. (see NoeticSoul's post.)

Richard Hornsby would be a good person to answer this. I believe that in the grand jury ----- > only the jury and the state attorney are in the room to review evidence and testimony. The judge is not present. However, he does preside at the hearing at the end.

We were just speculating that Lippman's motion was related to the unsealing of the grand jury docs because at the end of court today HHJP said he would go over the gj docs again and hear the motion Tuesday.

The grand jury docs are sealed. I'm assuming GA said something different in his recent testimony and to the grand jury.

The state has the testimony from George at the GJ, and always have had it. The defense did not get a copy because of it being sealed. They think he may have changed his testimony, but I can almost bet you that they will find it is the same. I don't think we will hear anything further other than the defense having a copy, and Casey appearing more pissed off the next day after she realizes her father had not waivers in his testimony. They will not be able to impeach him. IMHO

The grand jury docs are sealed. I'm assuming GA said something different in his recent testimony and to the grand jury.

JB is hoping George's GJ testimony is different from his testimony at this trial. JB doesn't know what George testified to at the GJ. He's fishing, hoping that their is a discrepancy. If there is, HHJP can release that portion of the GJ testimony to JB.

Oh okay. I didn't get to watch the end of the trial this morning so until I do, I'm going to take a page out of Kimster's book and just zip it :silenced:.


My opinion was based on absolutely nothing to do with what happened in court today. I will watch the videos later and see if I can make any sense of it. Earlier, I was just talking off my legal knowledge and thinking strategically. I can see every reason in the world Baez would want it unsealed and get to take a look, but absolutley no reason I can think of Lippman would.

LOL ok thanks guys I think she's lying too but was confused if George had conflicting statements or whatever just wondered what he lied about.
