I thought Judge Stephens questioned them all?

Is there a length of time a case can go on until it expires?

I totally agree this would be the worst case scenerio.

I'm also thinking that whatever she may have allegedly said may not even amount to a hill of beans.

I love the way the motion is framed- that juror misconduct is not the issue, that it's a given, but rather that it rises to the level of grounds for mistrial. DT is dismissive of any argument regarding culpability. Either this is more of the grand deflection and dramarama so savoured by the DT, or they're saying the juror has been already found guilty of misconduct. But how is the latter true, when the motion was filed on Sunday?

What I'm really wondering is why has DBs sister Laura not testified for either side. I think it's more proof of premeditation than the gas cans. Jodi first tells Flores that she did visit Laura but when asked for her number, Jodi quickly says she waited for Laura to get back to her and when she didn't is when her plans changed and she decided to visit Travis.
If there was proof that she tried to get a hold of Laura but couldn't why wouldn't DT bring her in to testify? I don't think she's on Juans rebuttal list, why? It's really bugging me as I believe this is essential either way. Any body agree with this?

What would Laura testify TO, exactly? "No, I didn't see or hear from Jodi". Thanks, no further questions.

You posted questions twice, and I answered them.

You dismissed my points twice, so I let you go with your opinions.

I told you twice that the family works closely with Juan Martinez--and the judge said that he spoke with them before the tape was played.

So, I guess you could be correct--Juan Martinez played the tape for them, they refuted it was Travis, he then played it in court.

It was such a personal, sexual, and embarrassing recording, I think if Travis' family doubted it was Travis, then Juan Martinez would not have fought to get the entire thing played in court.

Well they did get each other off twice so it made him alert enough. ;) She also waited while he washed up after one. But he's obviously tired in the sex tape and sighs audibly at 3:18. But he's not the same throughout, to me, he's more animated at some spots than others.

If you listen to him at the 1:40 mark in the following video, and again from 2:23 to 2:42, then listen starting at about 3:28 in the sex tape and again at 1:00:58 where he sings, you'll hear that it's Travis, without a doubt.

My surreal take on Mr. Nurmi's motion tomorrow:

Nurmi: I want to talk about that juror's misconduct, she clearly thinks my client is guilty! I filed a motion about Mr. Martinez's misconduct last week and now I find a juror contributing to the overall misconduct of this trial.

Judge: Mr Martinez?

Juan shrugs: Sure, Mr Nurmi wants to talk about everyone's misconduct, except his client's.

Correct. The sealed interview was originally about the alleged prosecutorial misconduct (i.e. the picture taking incident). It appears that Juror No. 5 said something during that interview (with the Judge and Attys present I thought Jodi was also present but others are saying no. I still think it's possible Jodi was in attendance). But since they do not indicate anything regarding the original PM motion I gather that what this juror allegedly said is separate from the picture taking incident.

I think she has even aged since the trial started. Imo she looks homely now.

Wendi Andriano did too. When she murdered her husband she was a very attractive young woman but by the time she went to trial she was anything but.

Now I know a lot of this is planned by the defense. They want them looking plain and downtrodden with no makeup hoping to fool the jury.

I was thinking the very same thing this morning. HLN was showing different photos of Jodi from the beginning of this trial to present and the change in her appearance is very obvious. She looks five years older since this trial began.

Flores is awesome don't get me wrong, maybe I watch to much true crime tv. Maybe a rougher approach with JA would have been more effective.
I'm not saying Flores isn't effective, it's just that his soft spoken calm demeanour was what kept her calm.
Maybe she needed an aggressive approach! The scare the crap out of her approach.

:floorlaugh: I was serving as a juror on a capital triple murder and rape trial and was rushing to get to the juror room prior to the start of trial one morning, ran to catch the elevator, jumped in and hit my floor and turned to apologize to everyone in the elevator and saw to my horror, that I was sharing the elevator with the accused, his parents and the defense attorneys. Very awkward! I was wondering why there was dead silence as soon as I entered the elevator.

Yes trial teams are told to AVOID jurors at all costs. You can't communicate with them at all. One trial I went to we waited for another elevator because we saw one juror get on. Our whole team just stood in the hall and let the elevator go.

I'm thinking that this juror #5 will be dismissed tomorrow. This judge is very cautious and will not risk this juror being a factor in an appeal.:twocents:

He may think, as many do, that this trial was a big waste of money. All she had to do was confess and tell the truth. Ask for a bench trial and beg for mercy. She could have easily said she brought the gun to scare him and it went off. Then she just lost it and stabbed him in a rage. When Jodi came to her senses, he was dead and she tried to cover up the fact that she was there.

I just do not get RS saying that he and Nurmi had a breakthrough moment when she admitted it was self-defense. Nurmi had to have known her lies could be proven by the State. It's just asking for the DP. That not the game a defense attorney should be playing. So in that respect I can see someone being disgusted with this trial. jmo

You're right, of course, lambykins. But I don't believe for a moment that this defense is Nurmi's idea. This is all Jodi's show. It reeks of her narcissism, which has left her so blind to her own transparency that she simply cannot imagine anyone failing to believe her brilliantly crafted self-defense-against-the-domestically-violent-pedophile-Travis strategy.

I may not like the things the DT does at times, but I do not believe they are stupid. There's a reason why Nurmi wanted off of this case. And leave us not forget, Ms. Arias would love nothing better than to defend herself. No, I say this is all her strategy.

Knowing Nurmi's track record of embellishing I don't think it is nearly as drastic as he makes it out to be.

She will probably dismiss this juror who seems to be against the defense arguments. While she may have been vocal imo he needs to worry about every juror on there. I don't think there is one of them that is buying what they are trying to sell. She may have complained about how long it is taking the DT to put on their case. It could be that simple.

IMO

Nurmi would claim bias if anyone did.

Also--I didn't mean that you can't have your own opinion! I just meant that I haven't heard either side in court or here discuss whether or not it is Travis.

Since I'm just expressing my opinion, I could be wrong about it not being discussed here on WS!
