I am listening right now to the trial as it resumed---no jury, just witness being crossed-- about the picture of his supposed gang sign


Baez asks if he is a gang member...Cape Verdian Outlaws....

'NEVER' , he replies...

Baez trying desperately to get these gang signals into the the trial before the jury...they think someone else shot the victims , it was a gang shooting they claim...

Judge= " I am not satisfied the defense has demonstrated the 3 fingers means definitively that using that hand motion means one is a member of that gang...Defense can inquire about gang affiliations of the detectives---but i see no foundation to permit gang affiliation to come in substantively at this time..."

I think his problem is going to be that none of these guys had any criminal histories to prove any gang ties. That will be a big hurdle with this judge.

Judge allowed defense to ask Cummings of probe into Cape Verdean gang after voir dired, although there didn't seem to be much there. Cummings is a great witness, answers questions clearly and assuredly. He is on the stand now being questioned by prosecution.
