I am just guessing, but legally it would almost have to be done before the defense rests. So.....soon?

It was in the CW opening statements IIRC - so has it been stipulated to I wonder?
Because the CW has rested and I believe they would be resp to introduce.

Or maybe Judge will announce at the end ? Or while giiving jury instructions before the jury retires to deliberate

edit to add - was it also acknowledged in the D opener ? Maybe that falls on them ?

I think the Defense will rest tomorrow, without a Defense (unless BW humbly testifies).

In closing, they'll suggest SUDS (with no support for it), and that will be that.

If the Defense puts on a defense, the Commonwealth gets to rebut it.

I am 75/25% they don't put up a defense.

What's left to say?

No expert can say Ana died of SUDS, only genetically that sometimes people do, but the Commonwealth could level testimony like that.

I think they'll rest.

Unless he speaketh.

So Brian Walshe and co want the jury AND THREE INNOCENT LITTLE BOYS to believe that Ana ( Mommy) just died unexpectedly, and Daddy just cut her up in pieces and hid her, and cleaned up the house real good....to protect them. MMMkay ??

It's just as preposterous as it sounded in the beginning.

Now the mother and her brother will need to move close to a prison somewhere so they can visit Brian.

And if there is any justice she should never see those grandchildren again. So much high level dysfunction

I am suspect of the fortune teller. I think the PI told his Mom of the affair, Mom told Brian and then Brian phrased it like that about the F teller to Ana to see if she would come clean.

Ana spent Christmas Eve with WF at a yacht club and spent the night with him that night. Wonder if BW was aware or not.

That is probably why he reached out to Kirby.

When Kirby said she didn't know where Ana was, he knew Ana wasn't with her... so. Texted her back to say he'd found Ana (when he probably hadn't) because he didn't want Kirby to get involved, go to Ana's DC house, reach out to Ana, etc, so he told her he'd found her.

I fear he will be found not guilty. The commonwealth didn’t do a good job, especially with witness preparation of Gem today.

I can see him testifying tomorrow because of his ego, not because of his lawyers’ advice.

Speculation only of course on my part, but they will put on a defense. We know and they know too, that there is really is no defense for what has happened, but they need to play the charade out so they are not crying "Uncle!/I give up ! just yet.

They at least want to have the appearance of a defense. That's what all this nonsense blah blah has been about from Tipton and the other D lawyer - just the appearance of a defense, bc of course there is none.

They will call a sudden death person/expert defense expert - SUDS /sometimes called Sudden Arrhythmic Death Syndrome (SADS). Whatever the expert has to say really has no bearing imo, bc of course it's possible, anything is possible, but it's possibiity is negated in this case by BW's subsequent actions. Hacksaw and all.

If she died suddenly a normal person calls 911. Tries to get her heart going etc.
If he was drunk and afraid to be blamed, and felt a panic and had to hide the body why not just put her in a a garbage bag and bury her somewhere.

Was he still panicked the next day when he bought the hack saw and tarps etc and brutally chopped her up.

Let that sink in. He bought the coverup materials the next day, strolling the stores happy as a lark. He then went home and went to work. Kids at preschool?

He needed the body gone forever so noone could examine it and find out it was a homicide. At his hand.

Mommie Dearest, I am confident, has been eyeballing the jury the entire trial looking for a weak link. If there is just one she thinks her son can 'con' he will take the stand.

As in every trial, the jury is and will be the wild card. They just need one juror to have reasonable doubt , however unreasonable that is to me.

The best he can hope for imo is a mistrial. They wont get a NG and the most likely is Guilty.
