Brian Walshe’s trial for the murder of Ana Walshe was set to begin on October 20, but his attorneys requested the evaluation to determine if he was competent to stand trial, WBTS reported. Prosecutors opposed the delay.

So this, IMO, is simply more delay tactics on the part of the defense. They don't legitimately believe he has competency issues, it is more spaghetti to throw at the wall conveniently fueled by the attempt on his life in jail. Wish the judge would have seen through it for what it is, but I guess judge doesn't want to further any future appeal. :(

A "Competency Evaluation," not to be confused with an insanity (defense) evaluation, is fairly standard across the land. It simply requires a Motion/Notice from the defendant's attorney that said defendant is believed unable to participate in their own defense, and the date this first became evident to the attorney.

This actually falls upon an attorney's ethical duty to report, over any defense strategy. For example, better for the Court to have trained professionals report that under observation, the minor flesh wound sustained by Walshe has not impaired his appetite, sleep, or thought process...

In other words, all parties need to hear whether or not Walshe is faking from an independent, trained professional, versus an uneducated opinion! Since I personally think Walshe was behind his random stabbing, I believe the trial will resume shortly after the evaluation.

Let's not forget Walshe is a convicted conman! Long before he allegedly murdered Ana, I followed his federal case -- he's had a lifetime of practice. I trust the evaluators are wise to him. JMO

ETA: Should the Court rule Walshe "not competent," he'll be ordered to receive treatment to regain competency, and he'll return to Court when he's deemed "competent," and trial will then be scheduled to continue.

I'm going to guess he's impossible to work with, won't work with his own defense team.

He's competent, it's just his ego is too big for every room he's in.

To my knowledge, no such complaints thus far. Walshe is dangerously manipulative and can be very likable.

IMO, he began presenting with symptoms to his attorneys and did not improve, and as required, they provided notice to the court. Now we wait to hear if Walshe was faking his symptoms, so the trial date can be rescheduled.

"The defendant has made progress, but both mental and physical effects of the violent assault have continued to prevent him from being able to adequately participate in preparing his defense," Tipton wrote. "He has made great effort to do so but at this time it is evident that the trauma resulting from the unexplained and sudden attack continues to significantly impact on his ability to work with his attorneys in a manner required as his complex trial approaches."

This has audio of him speaking with the judge about the evaluation. As Seattle and others have pointed out, with his well honed ability as a premier “ con man” it’s more likely than not that this is just him working the system.
But a hurdle to cross none the less

Not competent but proceeds to answer the judge competently.

The judge is right to order the eval but sigh.

Was he assaulted in the head? Is he receiving pain meds? Or is he just bored and not cooperative?

And his attorneys just noticed this? convenient delay of trial...

wait til he finds out what real prison is like. When all is said and done, and trial is over and karma stops toying with him and just lets him have in full. He's in for a rude awakening. When I think of all the sleepless nights his children have had thanks to his selfish acts his own sleepless nights and nightmares can only pale in comparison with those of the children who lost their mother and their father. JMO

DEDHAM ‒ Prosecutors will hand over materials related to former state police investigator Michael Proctor collected as part of a federal investigation to defense counsel in five criminal cases, including the high-profile murder case against Brian Walshe.

Walshe, of Cohasset, is charged with murdering his wife, Ana Walshe, in early January 2023, dismembering her body and disposing of it in various dumpsters, according to court documents filed by the prosecution.

At a brief hearing Monday, Oct. 20, First Assistant District Attorney Lisa Beatty said her office reviewed all the materials provided by federal authorities investigating Proctor's conduct in the Karen Read case.

Proctor was fired after it was revealed that he sent crude text messages about Read while investigating her in relation to the 2022 death of former Boston police officer John O'Keefe.

Of the materials from the federal investigation, a subset was determined to contain potentially exculpatory evidence which the Norfolk District Attorney will hand over to defendants in five cases Proctor investigated, including Walshe's.

Beatty told Judge Peter Krupp that an index was produced of all the materials received by the Norfolk District Attorney's office, not just those materials designated as potentially exculpatory.

That index will be handed over to the defendants as well.

"The defense will know all of the stuff that you reviewed?" Krupp asked.

"That's the intention, so there's no big mystery about what the other materials were," Beatty replied.

Krupp set an Oct. 30 hearing to give defense lawyers in the five cases an opportunity to request other materials after reviewing the index.

Walshe's attorney, Larry Tipton, may call Proctor as a witness in the trial, according to a joint pretrial memorandum filed Friday, Oct. 17.

If Walshe is determined to be competent, his trial will start on Nov. 17, according to the case docket.

DEDHAM, MASS. (WHDH) - The trial of Brian Walshe, a Cohasset man accused of killing his wife, could once again be delayed as the 48-year-old is set to undergo further mental health evaluation.

According to court records, Walshe’s next hearing, which was set to start Monday, is now delayed or cancelled.

Walshe is undergoing a mental health evaluation at Bridgewater State Hospital ahead of his trial. The hospital requested an extension on his evaluation Thursday, and a judge granted that request.

His murder trial was expected to begin in November, but this could push it back.

It’s unclear if his trial will start on time.

A hearing on Monday to address the issue of whether Brian Walshe, the 50-year-old man accused of killing and dismembering his wife nearly three years ago, is competent to stand trial was canceled by the judge overseeing his case.

Judge Diane Freniere canceled the competency hearing at the request of Bridgewater State Hospital, where Walshe is being evaluated. The hospital requested more time than the 20 days Freniere originally allotted to complete the evaluation, court records show.

A hearing on the defendant’s competency was initially scheduled for October 27, but was cancelled after the hospital requested additional time to evaluate Walshe. A new order requires the defendant to present Walshe at a pretrial conference on Nov. 17.

The order means that the murder trial will be continued until the judge determines that Brian is competent to proceed.

The motion to continue also alleged that prosecutors conducted additional DNA testing — the results of which are still not available — without notifying the defense. It also accuses the prosecution of withholding evidence “favorable to” the defendant, but does not specify what that evidence could be.

In court records filed in Norfolk Superior Court, Walshe’s attorneys said that while much of the Internet history on his devices will be admissible, “he may/will certainly be objecting to a host of items, including, but not limited to, ‘pornography involving a cheating wife.’”

The defense was responding to a prosecution motion seeking to admit Walshe’s Internet history on his personal devices.

In denying Walshe’s bid to dismiss the murder indictment in August, a judge wrote that grand jurors heard testimony that his wife was having an affair with someone she spoke with via text and Instagram, and that Brian Walshe told police he could sometimes access his wife’s texts and Instagram account.
