DEDHAM, Mass. (Court TV) — Brian Walshe’s defense will get to review former Massachusetts State Trooper Michael Proctor’s communications in the Karen Read case for information that could help Walshe in his impending murder trial for the death of his wife, Ana Walshe. But the fate of the remaining so-called Proctor files – and documents from the Read federal investigation – is in the hands of a federal judge as a Monday deadline looms for their destruction.

In a Thursday hearing in Norfolk County Superior Court in Dedham, Assistant District Attorney Lisa Beatty told Judge Peter Krupp that “all the Proctor chats and communications from the Read case” have been provided to Walshe and other Norfolk County defendants whose cases somehow involved Proctor.

The document dump comes amid discussions between state and federal prosecutors over what can and can’t be shared from the Read federal investigation, material from which was sealed under a protective order.

The current proposal, as outlined by Beatty, would allow two designated attorneys from the Norfolk DA’s Office to review the remaining “non-grand jury” evidence and share materials deemed relevant and discoverable under Rule 14 provisions with Walshe and others. However, the Norfolk DA’s Office will need to seek permission from federal prosecutors or obtain a court order to share information related to grand jury proceedings.

Defense attorneys expressed cautious optimism regarding the proposal and concern if Judge Casper does not approve it. “In theory, this sounds like progress,” said Joseph Krowski, Jr., the attorney representing defendant Jovanni Delossantos.

Attorney Rosemary Scappichio, who represents co-defendants King and Johnson, asked if an agreement existed between the Commonwealth and the United States Attorney’s Office to preserve the documents before the judge’s ruling. Beatty confirmed the documents would not be destroyed unless Judge Casper ordered it so.

Walshe’s lawyer, Larry Tipton, pointed out that the clock is ticking as his trial approaches. Beatty offered assurances that prosecutors were “anxious” to bring the case to trial and would work to identify material that should be turned over to Walshe as soon as possible.

Judge Diane Freniere denied a defense motion to dismiss an indictment charging Walshe with first-degree murder on the ground that the grand jury heard insufficient evidence to sustain an indictment.

In the motion filed last week, lawyers claimed that prosecutors violated Walshe’s rights by not reviewing “confidential materials” that could aid his defense. Prosecutors, however, argued that they are unable to review these materials due to federal regulations, as they are reportedly tied to the Karen Read murder case.
In denying the motion, Freniere stated that evidence presented to the grand jury was “sufficient to meet the probable cause standard to believe that he intended to kill Ana and that he decided to do so after a period of reflection.”

During a brief 10-minute status hearing in Norfolk County Superior Court, Brian and his attorneys appeared via Zoom but did not speak. Assistant District Attorney Lisa Beatty provided updates on ongoing discussions between state and federal prosecutors regarding the controversial “Proctor files.”

The presiding judge highlighted a key concern raised by defense attorneys: how can they challenge the withholding of records if they don’t know what those records contain? The Commonwealth was asked to address this procedural dilemma before the next hearing.

The next status hearing is scheduled for September 15. The court will expect further clarification on the document review process and the Commonwealth’s response to defense concerns regarding the challenge of withheld evidence.

My understanding of the Order signed on 8/27 is that the info has been released but will remain sealed, and during the hearing on 8/28, they still need guidance on how to determine what they should receive if it's still sealed.

TBH, I think they are making this more difficult than intended! A little common sense can go a long way... Let's hope they remember to bring some to the 9/15/25 status hearing! JMO.

Okay - thank you for that explanation. So that Order will release "some" of the stuff in there - but it will still be sealed to the public. Let's hope they get it together for that next hearing! :)

Norfolk County prosecutors are urging a justice of the state’s highest court not to pause or delay Brian Walshe’s October trial to review his claims that police illegally obtained Google searches he made on his son’s iPad.

Not long after prosecutors say Walshe killed his wife, Ana, he searched, “how long before a body starts to smell,” “how long for someone to be missing to inheritance?” and “dismemberment and best ways to dispose of a body,” among other terms. Walshe is charged with murder in connection with his wife’s death. Her body has never been found.

Walshe’s lawyers filed motions to suppress the evidence pulled from his phone and his son’s iPad, as well as evidence prosecutors obtained after several search warrants. They claim police investigating Walshe went beyond the scope of an agreement with his lawyer about searching the devices.

But the judge presiding over his trial, Diane Freniere, denied those motions, a setback for Walshe’s defense.

In the wake of the denial, Walshe’s lawyers petitioned a single justice of the Supreme Judicial Court to review the lower court judge’s decision — a process that would likely delay the start of his Oct. 20 trial.

Prosecutors urged Justice Scott Kafker to deny the appeal without reviewing it on its merits.
