The attorneys have not reached an agreement on the text messages. They are now going to sidebar again so they judge can make a ruling.

The camera spent some time lingering on Brian's mom in the courtroom just now.

The prosecution has done a good job laying out the foundation of a budding relationship and how deeply troubled and distressed AW was with her situation. Not only missing her children and in her mind not being the kind of mother her young children deserved but also the situation with the art fraud case and the inability to have that case find a resolution.

Then there is the timing of it all leading up to New Year's Eve and AW's sudden death.

I'm eager to hear this next bit of testimony.

They made their own problem by going ahead with redactions which were not at all needed. By doing that they redacted whole sections and now I think she is having a tough time with the original date/time stamp of a text chain of messages. MOO

The packet of text messages between Ana and Fastow is 43 pages long.

Ana sent Fastow a photo on New Year's Eve. It was a picture of Ana, mutual friend Gem, and a minor child.

Fastow returned from his vacation from Idaho early on the morning of January 4th. They had planned to celebrate New Year's together on January 4th and discuss their future plans together. They had talked about what merging two families would look like. But Fastow had always told her she needed to figure out the relationship with Brian before making any commitments or decisions.

The last contact he had with Ana was a text message from her that said Happy New Year's around the stroke of midnight, east coast time. The following day he had sent her a photo of him teaching one of his children to ski. Then he sent other emojis and texts that all went unresponded to. He tried calling her on January 2nd and it went straight to voice mail. He tried a couple of times. Then called from a landline thinking she had perhaps blocked his cell. She never answered.

He was concerned.

Brian Walshe called Fastow on January 4th. He did not answer. He let the call go to voicemail. He thought that Brian had found out about the relationship and was calling to confront him. Brian called back a few hours later. Fastow didn't answer this either. This second call left a voicemail from Brian which has been provided to law enforcement.

The voicemail is basically "hope all is going well. Reaching out to everybody I could. Ana has not been in touch for a few days. Wondering if you've spoken to her recently or the last two days. If so let me know or if you know anyone who has had contact with her. Sorry to bother you."

He called Brian back and told him he was concerned that Ana had been missing that long. Fastow was driving at the time and said he could drive by the DC townhouse and see if Ana was there. He did stop by, getting in through a garage code provided by Brian. He entered the garage bay and Ana's car was not there. He checked the door leading into the house and it was locked so he could not enter. He saw no damage. He called Brian back and let him know that there was no sign that Ana was at the townhome. He returned later that evening and checked the garage again in hopes that she might have shown up in the interim.

Fastow is shown a photo of a Gucci pendant necklace that he identifies as one Ana wore frequently. He also identifies her Cartier watch that is her primary timepiece and her engagement ring.

Cross-examination begins.

Just like Brian "accidentally" visited porn sites when he only meant to look up his favorite actress, he was interested in KH's divorce -- celebrity buff that he was -- and I guess the topic was contagious or sumpin.... so.... just ignore his Google searches, just internet misunderstandings. I hate when that happens.

1, 3,5, and10 year plans !! To discuss what a life together would look like.

He seems so grounded.

Through cross, the defense asks Fastow about whether or not Brian was suspicious of him. It turns out that at one point Brian called Fastow while Fastow and Ana were out to dinner. He showed Ana and Ana received from Brian the explanation that "one of the children" had gotten ahold of his phone and somehow called him by accident. But Ana never told him directly that she thought Brian knew about the affair.

Katie H. pulled off an impossible mission ( pun intended) when she left with her young daughter and filed for divorce from Tom Cruise. TC had all kinds of security measures in place to keep her from “ escaping “ the marriage. Allegedly.

It's easy, from the cheap seats, to say 'why didn't she just leave him? or judge her harshly for having an affair...

But Brian is capable of murder. I imagine he was difficult to communicate with (understatement)... plus, we just heard that his house arrest was contingent on being the children's primary caretaker. I think she was treading water. If his case ended in a prison sentence, she could deliver the news (divorce/boyfriend) to him behind bars. Clear sailing. If no sentence, she'd have to tell him straight up. Safest to wait to see if he's imprisoned before breaking it to him.

I wonder if she told him on New Year's -- who, what, how long going backward and and how long going forward -- 1, 3, 5, 10....

He destroyed her so she couldn't have the future she deserved.

What did Brian bring to the table? A hustler.

The defense is trying to insert reasonable doubt in their cross.
Explaining away the fight AW and BW over finances and money because all couples fight over finances and money. Even WF and his wife during their marriage had a fight over finances and money.
Explaining or creating doubt that AW did not have any plans to 'blow up her marriage and return to WF over NYEve.
Explaining away that all circles that AW and WF traveled in had no one that knew BW so he must not have known about the affair.

My daughter's are at the age they are looking for a husband. Their partner. This guy is yards and yards away from so many of the men they meet. Obviously they are younger but so many younger men are in their Peter Pan phase of life.
When WF said the 1, 3, 5, 10 year plan I was like Yes this is the kind of man with a plan. A future. Made me so sad for AW.
