Regan just rattled off a litany of things #PhilipChism claimed about the voices in his head.

Jill Harmacinski ‏@EagleTribJill 6m6 minutes ago
Reading from an affidavit, Regan said #PhilipChism heard voices that at times told him he was a ninja

Julie Manganis ‏@SNJulieManganis 6m6 minutes ago
Regan then submits an affidavit and reads it. Says #PhilipChism thought he was an anime character or a ninja. Voices were in control.

allison manningVerified account ‏@allymanning 5m5 minutes ago
#PhilipChism voices yell back and pull him "deeper and deeper." Didn't remember much of childhood. Didn't think it was him.

allison manningVerified account ‏@allymanning 5m5 minutes ago
#PhilipChism doesn't want to have contact with parents. Cares about sisters more than his own life.

BTW - All of these statements in the affidavit are things Chism told Dr. Dudley during his forensic review. Defense is trying to get around the hearsay rule and around putting Chism on the stand to get these statements to the jury. Apparently the only evidence the defense has for their insanity plea are statements made after the murder, there is no evidence at the time of the murder.

Jill Harmacinski ‏@EagleTribJill 6m6 minutes ago
Regan is formally objecting to court not allowing certain experts to testify

Bob Ward Fox25Verified account ‏@Bward3 7m7 minutes ago
Regan is objecting to Court order not allowing evidence of size of #PhilipChism brain and schizophrenia. The order made yesterday.

allison manningVerified account ‏@allymanning 8m8 minutes ago
Defense: Dr Dudley would testify that all these things formed his opinion that #PhilipChism psychotic disorder began when he was 10.

allison manningVerified account ‏@allymanning 7m7 minutes ago
Sounds like if defense loses, they think they will have plenty of points of appeal.

Julie Manganis ‏@SNJulieManganis 6m6 minutes ago
Even if the #PhilipChism statements can't be told to jury they're now in the court of public opinion

Ethan Hartley ‏@Ehartley_DH_BC 6m6 minutes ago Salem, MA
Regan is really fighting hard about this. How Dudley can testify must be an incredibly crucial part of the defense strategy

allison manningVerified account ‏@allymanning 7m7 minutes ago
Case could be finished Tue/Wed. Dudley would finish today. One doctor on Monday for defense. Prosecution's expert Tuesday?

Bob Ward Fox25Verified account ‏@Bward3 6m6 minutes ago
We are taking 20 minute break. Dr. Dudley will be back on stand at 10:50A

#PhilipChism mom just told an attorney here to view the trial he can't sit near her

Jill Harmacinski ‏@EagleTribJill 3m3 minutes ago
Under the court order, #PhilipChism family gets 6 seats in court each day. Chism mom is usually accompanied by 2 women

allison manningVerified account ‏@allymanning 23m23 minutes ago
This will be our tenth day of testimony in front of the jury. These are all four-ish hour days, not the typical 7 or so.

The livestream has been in and out this morning so there may not be a trial video for this morning.

40 minutes into dr's testimony, no mention of #PhilipChism. Def laying extensive groundwork to have court recognize him as an expert.

allison manningVerified account ‏@allymanning 1m1 minute ago
We're done laying the foundation of Dudley's qualifications. Recess so he can finish reading #PhilipChism competency report.

Julie Manganis ‏@SNJulieManganis 1m1 minute ago
Judge will now take a break to let Dudley finish reading reports from #PhilipChism evaluation. Meanwhile another motion from defense.

Was in a meeting and am just catching up. Is he reading the reports because he was hired at the last minute after the judge rejected the other expert?

Julie Manganis ‏@SNJulieManganis 2m2 minutes ago
Defense wants Dudley to tell jury what #PhilipChism told him about past experiences. DA objects and calls it "self-serving hearsay"

How ridiculous. Either Philip testifies or he doesn't. I'm glad the judge didn't let the defense sneak in his statements without the ability for the prosecution to cross-examine him.

Back in session. Dr. Dudley is on the stand. Jury is in the box

allison manningVerified account ‏@allymanning 50s51 seconds ago
Dr. Dudley was asked by #PhilipChism defense to do an evaluation of him in Feb/March 2015. Paid $300 per hour.

Jill Harmacinski ‏@EagleTribJill 39s40 seconds ago
Dudley direct observation is important part of process, would also review records and documents about the crime and from family members

#PhilipChism as result of mental disease lacks capacity to conform to law Dudley says

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Dr. Dudley #PhilipChism suffered unspecified schizophrenia or other psychotic disorder at time of murder

allison manningVerified account ‏@allymanning 1m1 minute ago
Dudley: As a result of a mental disease or defect #PhilipChism lacks substantial capacity to conform his conduct to requirements of the law.

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Dr. Dudley: #PhilipChism illness started at age of 10.

Julie Manganis ‏@SNJulieManganis 1m1 minute ago
Dudley gets the word "schizophrenia" to jury, says he had "unspecified" disorder within the same category in the DSM 5.

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
Delusions and auditory hallucinations are part of this diagnosis

Maria CramerVerified account ‏@GlobeMCramer 1m1 minute ago
Dudley testifies that he lacks the information that would give him that certainty about #PhilipChism

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
Dudley talking about rendering of diagnosis, symptoms can impair behavior

Bob Ward Fox25Verified account ‏@Bward3 52s53 seconds ago
Dr. Dudley: My opinion he was suffering from this illness in Oct 2013, the time of the Ritzer murder.

Julie Manganis ‏@SNJulieManganis 51s52 seconds ago
Dudley says #PhilipChism was suffering from symptoms including auditory "command" hallucinations "so strong and compelling" unable to ignore

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
Dudley says he interviewed #PhilipChism to make diagnosis

allison manningVerified account ‏@allymanning 1m1 minute ago
Dudley is looking at the jury as he explains all this. Isn't saying #PhilipChism did x or y, but more generically describing the disease.

allison manningVerified account ‏@allymanning 47s48 seconds ago
Regan: during interview, do you discuss what's going on around the time of the offense? Dudley: yes.

Jill Harmacinski ‏@EagleTribJill 2m2 minutes ago
Dudley also spoke to him about time of the offense; what he was thinking, what was going on

allison manningVerified account ‏@allymanning 1m1 minute ago
Regan is being really careful to ask these questions so Dudley can describe the symptoms but not assign them to #PhilipChism.

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
Dudley met with #PhilipChism 7 times. Sometimes #PhilipChism wouldn't want to continue the sessions. Others ran 2 hours

I am calling BS on the idea that Philip thought he was a ninja and had voices telling him what to do since the age of ten and that nobody ever noticed or took him in for evaluation before he murdered someone in cold blood. Mental disorders just don't go down like that. When someone experiences their "first break" as a schizophrenic, it is exceedingly obvious, especially if they are as mentally ill as those symptoms would suggest. Plus, schizophrenics are rarely violent. If I were the ADA, I'd be getting my schizophrenia expert lined up to talk about the stats on schizophrenia, average age of onset, levels of violence offense, and early presenting symptoms.

  • #267
Seven times? That's quite a lot. I'm pleasantly surprised. It sounds like Dudley tries to be very thorough.

Dr. Dudley: #PhilipChism in interviews, his affect was flat. He was staring off to space, not paying attn to me. Mumbling to self

Defense just asked several questions that Judge has ruled cannot come in. Prosecution immediately said Objection and Judge sustained. Defense immediately said OBJECTION in a loud voice. Getting it on the record for appeal apparently.

Jill Harmacinski ‏@EagleTribJill 54s55 seconds ago
Hallucinations were making difficult for #PhilipChism to talk to him during interviews, Dudley said

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Side bar now as Dr. Dudley testifies to #PhilipChism 's voices in his head ebb and low in intensity.

Julie Manganis ‏@SNJulieManganis 51s52 seconds ago
.#PhilipChism showed flat affect, mumbled. Dudley believes he was suffering auditory hallucination at those times.

Regan: Did he have delusional ideas?Dr. Dudley: yes. They involved various powers..Objection. Sidebar.

Victoria WarrenVerified account ‏@vwarrenon7 2m2 minutes ago
Dr: #PhilipChism suffered delusional ideas. Lots of objections right now as testimony teeters close to prohibited statements.

Rupa Shenoy ‏@RupaShenoy 2m2 minutes ago Salem, MA
Dudley says #PhilipChism had delusional ideas. He was about to say what those ideas were, but prosecution objects. Another sidebar.

I think this is why the prosecution was mad - the defense did not disclose the evidence in a timely manner to alert them that this was the defense they were going to present. Otherwise they would have covered it with their experts ahead of time. Now they are scrambling to recall someone who may or may not be suited to opine on it.

I hope she's reading: Look into one of the folks at Western Psych in Pittsburgh. They have a bunch of experts on "first break".

Gosh, i was thinking "7 times" and it would have been more... it sounds more like he was treating Philip than that he was evaluating Philip. That is extremely thorough. The cynical side of me says that he was meeting with Philip as many times as necessary to get something he could use in court, though.

Dr. Dudley #PhilipChism auditory hallucinations made him feel humiliated, degraded. In turn, made him upset and angry,

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Dr. Dudley: Intensity of hallucinations made it impossible for him not to respond. This was during my interviews.

Bob Ward Fox25Verified account ‏@Bward3 59s59 seconds ago
Dr. Dudley: THere are some things he does not remember and some things he is unable to talk about.

allison manningVerified account ‏@allymanning 55s55 seconds ago

Totally agree, though leaving the bathroom a bloody mess feels sort of disorganized to me. How bizarrely lucky he inadvertently got that he had his own team of clean-up experts to wash away the evidence. :banghead:

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Dr. Dudley; reviewed Chism family history. His aunt and grandmother had long history of mental health difficulty

allison manningVerified account ‏@allymanning 1m1 minute ago
Dudley reviewed transcripts with 25 people who knew #PhilipChism in Tennessee.

allison manningVerified account ‏@allymanning 47s47 seconds ago
Dudley: #PhilipChism's time in TN "was probably the highest level of functioning during his childhood and early adolescent years."

Rupa Shenoy ‏@RupaShenoy 1m1 minute ago Salem, MA

Dr. Dudley: #PhilipChism move to Danvers, supportive community was disrupted.

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Dr. Dudley #PhilipChism didn't have immediate group to turn to here (danvers). He became more reliant on other things 2distract him.

I'm guessing it's more because Chism wasn't very compliant, and it took seven tries to get everything done. Chism seems very defiant to me. He must be a pain to deal with for his attorneys.

Moving to Danvers removed #PhilipChism support. "My opinion that once that was pulled out from under him he didn’t have anything."

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Regan: Why did #PhilipChism get quieter just before murder? Dr. Dudley: That withdrawal, is symptom of deterioration underway.

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Dr. Dudley: Its consistent with psychotic disorder with teens

Jill Harmacinski ‏@EagleTribJill 2m2 minutes ago
#PhilipChism withdrawal can be a symptom of his mental disease, will use music as a distraction

Bob Ward Fox25Verified account ‏@Bward3 53s53 seconds ago
Dr. Dudley IMO, his behavior before murder signal underlying psychotic disorder growing more intense.

allison manningVerified account ‏@allymanning 54s54 seconds ago
Dudley: #PhilipChism stopped responding to people, stopped celebrating goals. Indication that the psychosis was getting more intense.

Jill Harmacinski ‏@EagleTribJill 50s50 seconds ago
Dudley demeanor with Ritzer on day of murder is consistent with Dudley diagnosis. Mumbling, etc

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Dr. Dudley IMO as result of disorder, he couldn't conform his behavior to law. Doesnt mean lost intellectual capacity.

Another objection and sidebar as Regan tries to ask how Dudley used interview of #PhilipChism's mom, Diana Chism.

allison manningVerified account ‏@allymanning 46s46 seconds ago

His opinion is she cares about him and vice versa but decisions made were not necessarily in #PhilipChism favor

Julie Manganis ‏@SNJulieManganis 57s57 seconds ago
Regan just asked about DYS caseworker records and Dr Jackson opinion.

Dudley: diagnosis of psychotic symptoms in Oct 2015 was important finding. As was responsiveness to the prescription treatment

Rupa Shenoy ‏@RupaShenoy 1m1 minute ago Salem, MA
Dudley says #PhilipChism was responsive to medication, showing the psychosis symptoms were lessening.

Jill Harmacinski ‏@EagleTribJill 57s58 seconds ago
Dudley also reviewed prosecution paperwork, other tests and police reports, autopsy and video

Bob Ward Fox25Verified account ‏@Bward3 44s44 seconds ago
