Also found in later views, was AJ pointing out that again, the CW springs up that it has interviewed another witness recently..( Fanning ) without disclosing that fact in their motion or to the defense prior to court today. Another violation clearly. KR and team wanted desperately to be able to interview Fanning, prior to the jurors removal, but the court denied KR that right. And, suddenly today, it is made apparent that Fanning was interviewed? Only by the CW ?

I've been following, I'm pissed, I'm worried, and I'm too overwhelmed at this point to be able to eloquently and concisely explain, factually, a retort (not the right word, I know) for the infamous "grave concerns" re: Defense. Would someone mind helping me out? I get flustered trying to have conversations with people [in the flesh]. Below is an example of of what I mean. Pulled from the comment section in the linked article.

Those who are Anti-Karen Read will argue regardless: but, I talked about it a little bit in my post above —-
The defense stated that they didn’t pay ARCA for the work they did. Which, is true.
The Feds did.
Mind you, this could have been avoided if Bev would have just allowed them to actually explain who hired them for the work they did, rather than walk around the truth.
I haven’t seen any evidence that the defense team were under the impression they would be billed for having them testify. I’m sure, if that had been communicated prior — we wouldn’t be here today.

This judge scares me!! Seriously! I have been taught to "trust the legal system". The innocent will go free. Nope! Not true! The amount of leeway the CW is given in every instance; and conversely, the amount of distain the defense is shown!! Someone tell me how this happens?! Someone please tell me why this judge is allowed to continue to try this case and a new unbiased judge hasn't been brought in?!!

Apparently this happens all the time all over the country according to Andrea Burkhart, atty on YouTube, but we don't see it recorded like we see this trial. Very depressing.

True! In comparison, this Court's demeanor and attitude toward the defense is like never seen before. One can hear the Court's heavy sighs during the defense argument while Special Prosecutor Brennan is allowed to speak without interruption or requirement to cite page numbers, etc.,.... SMH!

This hearing troubled me a lot (circling back to the case after a long absence)

As someone who was very sceptical of the dog bite defence, I always felt the inverted video was deeply problematic, and frankly I would have been pleased to see stern sanctions for it or even the whole case tossed.

It's my suspicion, deepened by this hearing, that the prosecution sought to manufacture evidence - how else does such a video ever get into evidence? And now I learn more videos were not disclosed.

Even if Read is guilty (of something), I just don't think you can have this stand. I get that the defence still has a bit of a hill to climb to show it amounts to actual prejudice but how can the case ever be proved BARD now? And doesn't the prosecution in fact deserve the harshest sanctions for this conduct?

One thing that really stood out to me about the testimony yesterday from the CW is the declaration over and over again that Proctor had the videos. That Proctor turned over the videos one at a time. We know that Proctor was a problem. I also highly suspect that Proctor planted evidence trying to secure a guilty verdict - one example is the tail light pieces and the one piece of glass on the bumper

Not to rain on anyone's parade - but what does being an alternate juror have to do with anything? She would've had access to the exact same information that anyone else (you, me, etc.) would've had and would have no knowledge of the goings on/deliberations in the jury room - outside of after-the-trial heresay... which anyone else could, too.

If she did, then that's a big no-no.

Essentially, she's a lawyer that has an opinion. Great.

She's an attorney that sat in person through the whole trial and has an opinion based on other trial experience and tribal knowledge. I would say I trust her opinion over many others. I also would say her access to information would have trumped mine since she was in person in the courtroom. No, she didn't sit through deliberations, but she had first hand knowledge of the courtroom / sidebars / emotions that we wouldn't have experienced through the computer. IMO

ETA - I actually trust her opinion even more now that I think about it. She didn't have all of the outside information and noise from the media and pundits. She just has her actual knowledge of the trial and information presented by both sides. Add to that - she is an attorney and understands the law better than I do.

Of course Cannone is GOING TO ALLOW Dr. Crosby ( the made up dog bite "expert" and "doctor" he's neither) to testify for the CW. This is the same judge that had a well known and Nationally recognized dog expert Dr Russell spend 2 whole days under the gun because Brennan called her work "junk science"!!!!!!!!!!!!! But this clown is going to be allowed to testify without even taking the stand for the Defense to question his "expertise". The same judge that told Dr. Renschler, that he couldn’t comment on causation of injuries because he was not a medical doctor!!!!!

Oh, oh lets see, she writes 3 pages on her decision about Dr. Russell and Crosby's is barely 1 paragraph!!!

I just can't anymore. It is painfully obvious to me that the fix is in at this point. HOW IS THIS ALLOWED TO HAPPEN????

Yes @friendlysleuther ….. and IMO after watching much of the court’s work and ruling in this case during the first trial and thereafter, keep hoping that eventually the court and judge will be called out for possible error or procedural error. Maybe upon appeal or other reversal, or perhaps other ruling(s). IANAL. MOO

Your information is not correct.

I thought the wildest part of her decision is not even an acknowledgement that this is a reversal of the standards/requirements she set previously (which understandably makes sense but still)! I thought the defense had a chance at winning this motion, but this Judge went the other way….and even further by saying that this Doctor used methods and principles that were “reliable”. After all the defense did to show that the methods and principles weren’t even easily discerned from his report, she turns around and says she finds them to be reliable. Yikes. JMOO
