I’m worried about jury selection, I hate high profile cases.
There’s the chance of stealth jurors.
People that haven’t followed along, have no knowledge and haven’t formed an opinion are the same people that live under a rock. I don’t have a lot of faith in them.

I wish there was a change of venue

It's not just Proctor who received disciplinary action!! Bukhenik and Tully were also disciplined for failure to supervise properly as they did nothing about the Proctor texts. Tully was transferred out of the DA's office in Norfolk and lost vacation days, while Bukenik just lost vacation days.

Kevin Albert was disciplined for drunkenly losing his fire-arm while out drinking with Proctor. Another glaring red flag in having Proctor investigate this case properly is he definitely knew the Alberts and lied about that. Just another conflict of interest that we have to ignore and roll with.

It might be easier to just list the police officers who WEREN'T under Internal Affair's investigations. And these very same officers were involved in the Sandra Birchmore investigation and we know what a thoughtful, thorough, honest job they did on that case. How anyone can take these Keystone Coppers seriously is beyond my comprehension.

And they are all going to be shown once again for their inept, incompetent, complacent investigation of this case - maybe even moreso than last trial actually. I imagine none of those players are excited to go through cross examination again!

No. Three young people testified to following KR's Lexus down Fairview Road where both vehicles stopped in front of the Albert's house. They parked behind her for up to 5 minutes. They saw no damage to the rear taillight, even though they noticed the lights were all on because her SUV was idling. They each testified that while pulling out and passing by her SUV in front of them, they saw only one person in her vehicle. They saw her dome light was on, with her sitting in the driver's seat with hands at 10 and 2 on the steering wheel. All three of them saw no sign of John O'Keefe anywhere, not in the vehicle nor outside the vehicle and not on the ground.
The timeline of when those witnesses showed up at the home indicates she then must have left immediately after they pulled away because she logged into John's internet at 12:36 AM IIRC.
Where was John all that time while they were parked behind her? She says he went into the house and she was waiting for him to come back out. He never came back out, according to her.

It's really extraordinary that a photograph was not taken of that tail light when they picked the Lexus up in her parents yard to tow it, and again when it arrived at the sallyport. Unbelievable really. At what point did they begin taking photos of it?

I am not familiar with SOP in these situations.

I'd be surprised if the Sallyport video was ever used in evidence normally. I would have thought that vehicles would be photographed at the accident scene, or if they leave the scene, then immediately on being tracked down? But what do I know.

I can see that in the ordinary course, towing it away and examining it forensically at the garage would also be acceptable. This is a strange case.

The thing is, the people investigating this case did things that were so bizarre, some of us can't help but wonder if they have been getting away with taking "shortcuts" for a long, long time but have never been caught or questioned about it before now.

They didn't think twice about not photographing evidence from start to finish, using used paper bags and (used?) plastic cups to collect evidence, using a weed blower to blow snow, holding onto evidence for months, no tracking of evidence to know where it was, inverting evidence, wiping out data on electronic devices, calling the defendant awful names, looking for nudes, and on and on and on.

It's funny, but it's not funny. Keystone Cops.

The defense said that wasn’t correct & that the police miscounted the events. Not that a backup didn’t occur; it just didn’t occur when the police say it did.

My guess is after Proctor messed with it. I agree—pics should’ve been taken before & after the tow. Everything should’ve been documented.

It did show that, but the defense claims that the key cycle data shows that that action happened AFTER the vehicle was seized and in the possession of the police. I agree with this. I think LE themselves purposely performed that action with her vehicle in an attempt to recreate what might have happened if she had hit him.

That Judge is super impressive. It was funny at the end how he just cut Yanetti off and made it clear he didn't want to hear anymore grandstanding about who was the most ethical!

In any event it's the correct decision - but I hope a warning to D teams who engage in this strategy.

IMO they might as well just have an official YouTuber on team D. Pretending TB was independent really opened the door to all this.

I don't believe he was bitten by a dog. I agree something bizarre happened, involving KR's vehicle. I'm not sure she knew what she had done, but I don't know, maybe she did, cos she went straight to him. JMO

This is where I got stuck in trial 1 because for me the ARCA witnesses = reasonable doubt. So I threw my hands up in the air and gave up.

I think what HB has to achieve in this do-over is have a much more convincing reconstruction and ultimately i suspect he needs much better analysis of the Lexus data to seal the deal. But my understanding from trial 1, is the Lexus data which really should have disposed of this case one way or the other is a hot mess. That might not be fixable.

So let's see.

My take on Ashley Vallier's testimony is that there is no evidence any extraneous pieces from other tail lights were planted at the scene.

I wonder if this claim was made elsewhere by the defence in a motion or closing that we can refer to?

The key stroke data proves that the backing up at 24mph happened while in police custody. It is extremely clear if you look at that spreadsheet with the data. I also believe that the video of her leaving John's that morning shows her taillight in tact, not broken out. I hope that the defense really spends time on getting these critical pieces of information through to the jury. I would be interested to see what the first jury understood and/or believed from the first trial.
