I can see that JMc and Matt Mc make a perfect pair.

This is the 3rd witness I've noticed say, "I wish I did" in response to if they saw JOK lying on the front lawn. Other than the infamous butt-dials of three of them, this is another catch-phrase of the trial. Rehearsed.

Free KR trial supporters will be out strongly at the Dedham court house tomorrow. Signs and all. MA friend spreading the word. Looking forward to finding out who the first witnesses are. DO not want to miss McAlberts..I assume they are on that list. Work gets in the way of lifffffffffe and warm sunny days to be out on the porch. Make sure my phone is well charged for out there.

Yes it's self evident IMO. The two mins were the perfect window for the 12.41 arrival. But at trial it became clear that 12.36 is the arrival, so you can't maintain the argument.

This illustrates Yanetti's skill to attempt to exploit the "missing video" in this way. But of course the alternative is she never drove past the library. And lucky for the defendant, testimony by counsel is not admissible trial evidence - even though he point blank claimed it as a fact!

For me the much more interesting question is what the defendant was doing between 12.36 and 12.41
There is a route from Fairview to JOK's house that would not have involved going past the library. I'd call it the "Pleasant St route". JOK's house is at the corner of Pleasant and Meadows.

How fast KR could have (and did) get from Fairview to Meadows may be a more directly contested issue in this trial. From Brennan's statements at the 3/20 hearing, the CW is going to attempt to nail down, with additional device data, that the fatal collision happened shortly after JOK exited the Lexus. In doing so, the CW may have to acknowledge that the collision happened somewhat later than it was willing to concede at the first trial, possibly as late as 12:32.

In Jackson's closing argument, he asserted that it was "undisputed" that the drive from Fairview to Meadows would take six minutes. This was an instance of counsel asserting a fact not in evidence; obviously, how long the drive takes is subject to driver decisions and discretion. The CW avoided the issue, but may have to take it on directly in this trial.

Yeah i agree - the timeline is going to be quite important IMO, more so because the defendant now has a positive version on video tape, which isn't compatible with the 12.36 arrival. So perhaps Brennan looks to focus on that. I tend to agree she did not drive past the library - hence why there is no footage.

Not only that but she then managed to drive back to JOK's house in 4 minutes while being completely wasted off her a** with 12 drinks in her!!!! If she pulled all of that off get her in a World Rally Championship car and set her loose on some of the most challenging roads in the world!

I'm hoping that will not stand. The defense seemed totally taken aback by that ruling.

I think it is because she's not hearing the ARCCA motion re discovery issues until end of day today, because the jury's waiting, and it appeared AJ hadn't complied with her order to produce texts. So if there was non-compliance it seems ARCCA might not be allowed into evidence, and therefore no mention in their opening speech. Maybe they sorted it at sidebar.

Maybe the Judge just reviewed the texts in chambers? I guess we will find out soon what the decision was?
