I believe it was last week I mentioned about the carpet (link below) the defendant had been housing from 34F.

However...
  • There was no carpet in the basement
  • If there was any truth to the defendant having carpet from 34F, there's no doubt it would have already been swabbed for blood evidence. That would have been important evidence to clear defendant; and it is important to get the sample tested quickly. Would have shown JOK in the house, only problem, he never went into the house.
  • Thats why no one on defense team talks about the "carpet"...
  • Guess it makes more sense to spend the money by housing the lawyers and defendant.

10/30/2024

The article also reveals that Read housed her lawyers, David Yannetti, Alan Jackson and Elizabeth Little, and herself in the same hotel leading up to and during her trial, at a cost of $1.2 million. She used a combination of her savings, $500,000 from her legal fund and $400,000 donated by friends and family to cover the costs.

Near the end of the piece, Miller includes a conversation from her final night with Read, saying Read talked about a temperature-controlled storage unit she's paying for to house carpeting torn from the Alberts' home after they sold it. She said she hopes to get enough money to swab the carpet at some point for blood and DNA evidence.
She spent over 1 mil for hotels and is paying storage fees for the carpet, yet she can't afford to pay for the DNA testing of the carpet? Something is wrong with this picture. Can this be correct? Sounds like a money raising scam if true.

We seem to be gearing up for something with defense witness Tom Beatty. Way more focus on him in JM’s testimony.

I dunno sounds like desperate actions and lofty thoughts of a woman accused of murdering her cop boyfriend in front of his cops friends house , I am sure she feels underdoggie and in over her head. Picture had this happened to someone without the means to make it though this bs without that advantage.

Yes, thought the same. Beatty and his daughter Erin were on the defense list last time but for some reason never called. They're on the list again. Brennan must be worried about them because Jen never mentioned them the last time.

And maybe John was a jealous boyfriend who didn't like the idea of Higgins texting his woman that night. MOO.

I do think the defense is going to spend more time this time on the Waterfall video. Especially at the very end when Higgins is yelling in John's direction and is restrained by one of the Alberts. (I think it was Chris, but of course he testified he was home in bed by then!)

It's hard to tell from the video, but the Waterfall is a really small place. I'm going to guess John heard Higgins loud and clear.
Oh yesssssss, one must see ALL of the Waterfall vid. esp Higgins at the end, J knew that he was being called out. Jenn telling and encouraging KR that she was coming WITH HER, it's a surpise.. ugh..

If it was, as suspected, carpet from the second floor bedroom level there may not be much point in the large expense of DNA testing. But I can understand her wanting to save it given her circumstances. Can't cost that much to store, and if she ends up (wrongfully, IMO) convicted, she may want to it explore further.

Now, carpet from the stairs leading to the basement, that's a horse of a difference color. But my guess is that if those stairs were indeed carpeted, Nick Marathas probably would have replaced that as well when he replaced the family room carpet in the basement. You know. So it matched nicely.

The most amazing thing about this case is the Commonwealth's inability to prove that JOK was even hit by a car. In the annals of Massachusetts court history, you'd be hard pressed to find another prosecuted second degree murder case - supposedly caused by a vehicle - where that basic fact can't even be established.
Which is why there should be no trial ...
I admit I am only watching because I -sorta, kinda feel this whole prosecution is a violation of America's justice structure.

1. BH was there for a while. Did not leave right away. And BA and BH were in family room.

2. Jen CALLED her sister before Karen got to her house.

3. Crack in tail light became missing pieces.

4. Karen told her at the bar that she had started new prescription.

For starters.
That’s not changing anything, that’s adding granular details

IMO

My bold. Yes, there had been carpet in the basement. It was removed and replaced by Jill Daniels' (Colin Albert's auntie) boyfriend (a local flooring contractor) at some point after O'Keefe was killed and before the house was put on the market. The new carpet can be seen in the Zillow realtor photos in the (at that point) empty room in the basement adjacent to the weight room.

The carpet Read has is carpet the new owners let her have after they ripped it all out whilst renovating the house. It's either from the stairs or the second floor. I agree its probably not relevent, but it's not accurate to imply there was no carpet in the basement the night O'Keefe died. And the removal of said carpet was done by someone directly connected to the family.
You have a source for all of that???

But then again, there are people who go out and drink responsibly and don't get drunk.
It can be dicey though.
One may believe they're not drunk and don't act drunk yet would fail a breathalyzer.

I imagine most people would be devestated and remorseful.

“are we watching the same trial?”

yes. yes we all are. i understand we are using this phrase rhetorically but imo, it really highlights the prosecution’s battle here in establishing their case beyond a reasonable doubt. there were far too many retroactively updated versions of events, investigative missteps, bad actors, and alternative explanations that all stem from the lack of critical info (whether due to this particular case or just plain negligence from the PD) breeding conspiracy with the public and probable doubt within the jury.

eta: obvi imo

It's not just in storage. It's in a climate controlled, sealed unit. DNA testing costs a lot. The CW only sent in 4 swabs from JOK's shirt. Those swabs were never identified as to where on his shirt the swabs were taken from. KR faces the same hurdle. Where on the carpet should she test? With her limited resources she needs to make sure that where she tests is going to generate accurate information. So she's doing what she can with it at this point and time. IF she can raise enough money to test everywhere on the carpet, she will obviously test it. It's a longshot for sure. But she has it in her back pocket for now and she is using her limited resource on other parts of her case.

Until then she has it and is taking as much care as she can to preserve it. Which is more than the CW did with all of the so called evidence that they collected. They left their evidence, unsupervised in a shopping bag along with other things for weeks in the evidence room.

It’s not true that no one knows where John’s shirt was swabbed - there’s detailed testimony of the collection as well as the results from T1

Was McCabe's testimony today that KR asked or said "Did I hit him? Could I have hit him?" multiple times BEFORE they got to Fairview new testimony? In the last trial I only remember her testifying that KR said that when they got to Fairview.

That is one of the more crazy things to pretend in this trial. Like forensics dont matter at all here ? really crazy to accuse the professional's of not knowing their basic duties.

It's evolved from "Could I have hit him?" at the scene to the multiple "I hit him!"

I'm sure Jackson will cover this all again with Jen very soon.
