I haven’t really been watching this re-trial, but have been watching some this morning. This witness (Whiffen) seems to be waffling on cross from his previous testimony as brought up by this defense attorney imo.
Whiffen has been evasive and uncertain about his own testimony even in T1. He never seemed to have confidence in his own report. And Allessi is spot on in pointing out the discrepancies.

Every single thing that is shady, underhanded, deceitful, questionable...etc, etc, etc all comes from the CW's side. All their witnesses, all their evidence, comes with a caveat. Nothing just "is" there is a problem with practically EVERYTHING the CW does. There is nothing they present that doesn't require the suspension of belief or fact.

It's like the CW is on trial here. Every witness has some kind of excuse, some kind of memory loss, some kind of problem with their testimony. If you didn't know it, one would think it's the CW trying to get away with murder.

Like the 1st trial the CW is spending all their time defending jen mcabe, the Alberts and the police. Nothing has been presented yet that shows how KR murdered JOK. I just can't believe that this is their strategy AGAIN!
That rock should not be admissible. It wasn't brought up or even there for what we know in the first trial. Any anti Karen Read person could have placed it there. I'm sure people go to that location daily. The bottom line was that due to shotty police work that crime scene was never and has never been secured. The fact that the jurors saw it is unacceptable. If it was evidence and there which I highly doubt the first go around. it should have been collected. MO
Agree. The fact that the rock was allowed to remain there while jurors were viewing the property is ridiculous

Exactly right! The CW uses their own shade and tries to project it onto the Defense. That whole voir dire of ARCCA witnesses yesterday was a laugh. Hank so sure they were being underhanded (because he and the CW are) and could not prove anything!

AND another CW witness falls short. What kind of analyst does not even bother with outdoor and freezer temps for his "experiment". Scientists everywhere laughing their a's off!

Alessi has completely dismantled the Whiffin testimony in terms of reasonable doubt

Whiffin is clearly squirming and appears unconfident in his own findings

So he cant tell the phone was answered ? Any one look at the records and call bs ? Takes about 30 seconds to see the problem with his not being able to tell if the call was answered.

Someone should have done an experiment with the phone temp on frozen ground with an 80 degree body on it. I get what Alessi is trying to do, but I think a body on top might alter the temp drop.

I’ve thought on that too, but either way it renders Whiffin testimony or testing extremely questionable aka in doubt

Seems to me Dr Wolfe kept referring to the defense attorney as Alan yesterday. So they must be friends too.

It’s easy to twist witnesses words and catch them off guard; however, the science and data evidence speaks for itself.

Wolfe admitted he received information about witness testimony before testifying in trial one. Testimony from Wolfe admitted to Alan's preference being to communicate through Signal. He (Wolfe) also stated not knowing that Signal app automatically deletes text. Yes, an engineer does not know this. Lol

Furthermore, apparently Alan never intended to preserve communication for discovery, as required for the case. He deliberately chose a method to hide communication, its encrypted messaging allowing for instant messaging and for voice calls, and video calls, which includes one to one users or group messaging.

Just a matter of opinion

Look back to the previous thread. That is exactly what was suggested by some that believe KR is guilty. We are pointing out the ridiculousness of the arbitrary rules/prejudices that apply to KR’s team and witnesses, but somehow never to the CW and theirs.

I feel the case will now come down to how tightly the CW can tie the Lexus data to the cell data.

IMO it's rock solid JOKs phone never moved after 12.32. If the Lexus high speed reversing event is also at 12.32 that is a hell of a powerful coincidence.
Agree 100% - Take the human element out of it...and there should be little technical reason (in a perfect world) why a team from Apple/Google/Lexus couldn't wrap this case up fairly fast. But as we all know, we don't live in a perfect world, so only time will tell how this will all play out.

How so?

I'd agree she'd have to go faster than the speed limit but it doesn't seem like she had a problem with breaking the traffic codes
