First trial juror.

snip:

"As we deliberated, we agreed that she was operating a vehicle, he died there on the lawn, and there was broken tail light pieces, there was an impact to the vehicle, maybe, somehow, that is why there was damage to the vehicle, he got injured and ultimately he died at that location, because of that, a little bit I swayed and said that is true, she operated the vehicle, etc., and then when you actually thought about it, the injuries he sustained were not consistent with what was provided to us as damage to the vehicle," he said. "There were too many unanswered pieces ultimately swaying me back to the opposite, which was not guilty."

Oh great back to the clips! More useless tactics and waste of time. Tell me, who remembers the 5th clip that hank showed early in the trial? What about the 8th one? or the 12th?

And now the desperate Hail Mary by the failing CW.... the kids!! Just to remind everyone, the juror's interviewed after the 1st trial said this left a bad taste in their mouths, but who's kidding who, good taste left the Canton a loooooooooooong time ago!
I was wondering how jury 1 felt about the kids. It’s horrific to bring them into this mess. There’s nothing for them to add and further traumatizes them. It’s frankly despicable.

What evidence logs?

You think the pieces weren't bagged up and logged in to the evidence room?

I am not aware that the D has ever claimed any issue that the pieces admitted in to evidence at trial are not the pieces found by SERT

is it possible that Jon had fallen down in the ice and snow, behind the car before he was hit? maybe he was trying to get up ..but she didn't see or hear anything..loud music etc. she's so jealous and weird, I am really surprised she didn't wait to see him go in and see who came to the door.
by the way, has anyone noticed that people on this site seem to have multiple profiles? maybe it's just me...

I wonder if the cw will be calling Vallier to testify as well or maybe they aren't going to get into the reconstruction of the taillight this trial. I still haven't been able to get an accurate count of how many pieces of taillight were actually collected, logged and when sent to the lab. The sert team found six or seven different pieces of taillight according to O’Hara. So which is it? And why was I under the impression only 3 pieces were sent to the lab and of that only 2 pieces were supposedly used in the reconstruction if I followed the progression of the reconstruction correctly. I have linked an interesting article on the trial 1 jury requesting to see the the sert report and the judge denied it. It seems that original jury might have been trying to figure out the puzzle as well. I'm thinking the cw should just leave that topic alone as the chain of evidence for the taillight pieces is just a mess. JMOO

What is a SERT report, and why did the Karen Read jurors want to see it?

BBM

jmo, as I don't know the legalities. But I wish the judge's explanation for denying the request from the jurors was clearer. There was no SERT report. She can't give jurors evidence that doesn't exist.

I don't believe she is saying it doesn't exist as I read through that article. Also, it's sop to write a report when discovering and turning in evidence. JMOO

Former Manhattan prosecutor Mark Bederow already represents Aidan Timothy Kearney

DEDHAM, Mass. —
Less than a month before the scheduled start of her second trial, Karen Read's request to bring an attorney who also represents the controversial blogger known as "Turtleboy" onto her team has been denied.

We’re back. Sgt. Zachary Clark is up, a CW witness.

According to the link for OP, neither party introduced it into evidence. It could have existed in discovery. Only a fraction of the evidence in the case is ultimately introduced in to evidence, IMO.

I’m so frustrated right now that the CW isn’t calling Higgins, Alberts, Proctor—people with relevant info and instead puts vulnerable kids on the stand. We already know Karen didn’t access the ring video so they don’t need to testify to how it’s accessed. We’ve seen the texts and know the relationship had run its course and John didn’t like Karen spoiling the kids. This won’t be lost on the jury, especially if they happen to be parents.

Oof. Trooper Clark already spreading misinformation that no two fingerprints can possibly be alike. Not that it’s important, because he just said no impressions of value were determined. But still.

ETA quote: ‘Yet it also became clear, over time, that fingerprinting wasn’t as rock solid as boosters would suggest. Police experts would often proclaim in court that “no two people have identical prints”—even though this had never been proven, or even carefully studied. (It’s still not proven.)’

Yeah - we know O'Hara wrote something because he talks about it on direct and X. At one point in T1, I recall Yannetti gets very focussed on a bunch of measurements that he must be getting from a report - but he doesn't admit that report so that O'Hara can see it to refresh memory. I never understood what was going on with that - I guess I will chase it down later.

@JHall7news

O’Keefe’s niece has completed her testimony and talked about growing tension in her Uncle’s relationship with the defendant . My colleague @MariSalazarTV was in the courtroom for part of this testimony. Reporters were barred from live tweeting during her time on the stand.

Yeah that's exactly how I felt about this prosecution tactic last trial and it's the same this time around. Yanetti did a beautiful job on cross with them (I think it was Yaneti but ICBW). Jmo. The first thing he said was how sorry he was that they had to be testifying. IIRC cannone had it struck, which is fair enough, but I believe it was a sincere gesture. Jmo

Plenty of loose ends to chase down. I'm weary of the chase. JMOO

Yeah, come on, it wasn't introduced in court but we just know it exists somewhere in the world. JMO

Yanetti is up to cross Trooper Clark.

  • #299
Clark is with the CPAC (Crime Prevention and Control) unit and was under Tully.

Immediate sidebar because Brennan doesn’t want it on record that Tully was removed from CPAC.
