So he dropped his phone by the flag pole, went inside and was killed in a fight and then they happened to dump his body on top of the phone out in the yard?

If Judge Beverly Cannone just lets this in then it’s truly disgusting. JMO
She’s going to let it in and say that it’s due to her ‘grave concerns’ about ARCCA, imo

Maybe a dog got him as he was searching for it or picking it up.
Its fun to speculate this far into a trial . I rarely see it happen.

My thought is that if he died in the house, it must have happened very quickly and then they would have placed his phone onto the lawn almost immediately afterwards, long before moving his body. Many of them have extensive law enforcement experience, they know how important cellphones are in providing evidence in things like this, smartphones are the closest thing we have to a blackbox recorder for the human body in the 21st century.

Not sure. I think there could be a scenario where he was "clipped", as KR worried at one point. But maybe not. The cell phone data indicates he never left the front yard. That's hard to reconcile with a fight occurring in the house.
One shoe is untied, John O'Keefe was a stickler for taking his shoes off, got to the door, was taking shoe off when incident occurred. So the witnesses can say he never came in the house, he came to the house.

Interesting question but she did the repeated calling very early on. He would have to have been killed very soon after entering the house and then she is already formulating a cover-up by trying to locate his phone so they can dump the body on it hours later? I agree that his injuries are not what you would expect from being hit by a car but I'm having a hard time getting the phone data to fit.

Just catching up... wow, cannot believe the CW just conveniently got a new report the day after the ARCCA report was due?!?

If the judge allows this, no doubt it would be an appeal issue, possibly before the trial is even done?

At the taxpayers expense no doubt. Boston Herald said it was 700,000 for trial 1.
Brennan will make that 700k amount alone imo, if not more, so this trial will prob cost the taxpayers (me and others) at least double of what the last one cost - I really am outraged.
So far, every P witness has really been a defense witness. The P has nothing substantial to base their case on.
You've got a defendant, in an unstable, highly emotinal state that morning after the incident , who is a mess for whatever reason, saying or not saying she did x y or z - and that is just not proof of anything in relation to how John died.
For all I know she had mixed ambien to sleep that nght in with the booze in her system in combo with whatever she takes for her other medical issues and that morning we were witnessing the out of control results.
She did get "sectioned".
If Brennan were not so underhanded, I would almost feel sorry for him. He either owed DA Morrisey a favor or he needed the money. I dont think there were many takers to be Special Prosecutor on this one.

But the cell phone would have started to heat up even if it was in the house for a short time. And still hard to believe a bunch of drunk cops came up with a plan like that immediately.

There is no compromise to the CW changing their timeline AGAIN.

The timing is one of the reasons I couldn't understand why they would retry her or was allowed to. That was a big thing in the 1st trial. Now in the 2nd trial they are yet again changing it, mid-trial.

Brutal.

My theory still works. Picking up the phone as the dog runs into hIS face ,knocking him out thus shattering the glass. Chloe bites him a few bites ,then realizing John is complying with her police dog commands ,stops and notices it lights out for John and paws at his arm a few times. Where she is rushed into witness protect programs in agreement with the DA and The MSP.

I think even if they were civs, they could have easily come up with the same ‘plan’. Really, not much of a plan at all is needed. And IMO it’s not like they had everything nailed down, we see the cover up forming with the early suggestions that John was hit by a snow plow. I think Karen’s hysteria was just a convenient way to pivot. All IMO.

There is no reason to feel sorry for Brennan. He's unethical, he's underhanded, he's greedy, he's in the role of prosecutor but is not interested in a just and fair prosecution. Instead, he's playing this as dirty as the judge will let him. No respect at all from me. Jmo

But the CW's own witness the ME doesn't think he was hit by car. So what do you think happened?

great point @bobbymkii - both BA gang unit and BH ATF have "back alley" type experience and have undoubtedly staged things in the past - they know how its done

It's not that the plan was hard to come up with but that it would have had to have been immediate.
