In M00 the state’s case is so bad. All their witnesses are great for the defense and put the CW in the hotseat. Lol!! Especially, telling the jury that they’d prove he was hit by a car and the car doesn’t even have a crash event. 🥴🥴
And you would think that if the prosecution believed the tail light pieces caused the injury to JOKs arm, they would have a medical expert line the specific pieces up to his wounds. I don't know what they think caused the gash on his head? A rock maybe, well where is it? They have yet to prove he was hit by a car because they can't. Moo

It's the middle of the night and I can't sleep. I am re-watching Brian Higgins' testimony from T1.

BH testified he had 4 or 5 Jameson and Gingers at the Hillside Bar.

Then he had 2 or 3 more at Waterfall. 🫨 😲 😔

Thennn he drove to 34 Fairview.

So now he's 8 drinks to the wind. Then he decided... to drive to Canton and move cars. 🥴

After that he drove home and claimed to have had two more.

Its disgusting and the US taxpayers fund his salary. I can't imagine his employer, the Federal Government being happy about that. I would be surprised to know if he still has a job with them. I doubt it. Moo

Wow that's alot of booze. And I'd guess he had no concerns at all about being done for DUI of course. He was sinking them with other cops ie Brian Albert. Imo he would have had zero fears of a traffic cop throwing the book at him if pulled over. That whole group of people were/are deeply embedded in booze culture. Moo
It's the brotherhood. They don't give each other tickets and they will cover for each other until the end. Omo

For the head wound I think they are going to try and convince the jury the lawn dunnit.
The lawn would not be hard enough to cause that damage to the back of his head IMO. Earth does not get hard like ice or concrete. I would never think the ground caused his head wound. And I'd also like to know why he was laying with his head closest to the curb like the female EMS testified to (Katie McLaughlin). If he fell backgrounds on the ground, coming from the curb, wouldn't his feet be closest to the curb and his head be further into the lawn.

I feel a bit sorry for Shanon Burgess. He's like an everyday man, trying to get by in life. He seems like a nice enough chap, courteous and he hasn't become defensive throughout the past two days under Alessi's brilliant lawyering. I love his confident demeanor. I think he certainly knows his way around digital equipment. But IMO it shows he has no degree even though he has many other good skills. And because he has lied for so many years about his credentials, I don't think he can even be taken seriously now, at least in the area of forensics. I think his skills would be useful elsewhere, but never being asked to speak as an expert in court again. Maybe this will give him the push to finish that degree finally.

Brennan should have gotten out in front of the education issue with the witness - and he purposely did not bring up education with SB when going over his qualifications so I believe Hank knew there was an issue before the D brought it up.
On the other hand, the witness seemingly had no problem not bring entirely truthful in other areas and he seemed a little "allergic" to accountability.
If you fudge your resume to get a job what will you do to keep that job? Fudge your expert reports/tailor them to meet the clients needs?
SB was tailoring his resume to his audience -putting in a major that does not exist etc - enhancing his credentials
His LinkedIN page is now deactivated but he was active on that forum. He updated etc and you pay to be an IN member and get notifications when someone looks at your page. So he lied about that on the stand.
He presented to me as someone who has a casual relationship with the truth. So perhaps a career in Politics or Sales might be a better fir JMO

curious how she drove into the garage and of course that ring video is missing. Watching her skills when backing out of it, do we really believe she just pulled in without having to back up and straighten out? (wouldn't that register as a 3 point turn? and why do some 3 point turns register as a techstream event but not others? So many questions lol)
snipped and bolded by me. The VCH trigger event is called "accelerator pedal opening angle is medium or higher immediately after shifting to R" and is the same for both trigger events. So it's not necessarily a 3 point turn that creates an event, but an abrupt reversal. If you compare the actual data of each trigger event you can see that yes, 1162-1 is likely a 3 point turn because the car is in drive, shifted to reverse, then back to drive. The steering wheel angle also changes greatly throughout the trigger event, like you would expect for someone making a 3 point turn.

And using ‘Locard’s Exchange Principle’ as someone mentioned in the thread yesterday, if there was contact with the ground, his head would have trace evidence of that contact. But the ME testified that there was no dirt or grass in the wound.

I agree, but I think that's where Brennan is attempting to go. Arcca, Russell and Wing will eat Welcher alive. And the ME has already proved to be a friendly and useful witness for the defense's case. Imo. The CW's neurosurgeon expert I'm predicting will bleed when Alessi crosses him armed with the useful testimony from the ME. Jmo

Also in T1 BH claimed his reason for leaving 34 Fairview when he did was the only thing that was available for him to drink was beer, no Jameson and he admitted to having one beer.
What keeps running though my mind is if any of these off-duty guys were armed that night?

As I said previously, the digital forensic data stands. Its solid evidence.
No cross by the defense on the digital forensic data. Their only focus on whether Mr. Burgess had a degree or not.

Alessi would be more effective if he changed his tone and how he approaches a witness. His tone is all wrong, really creepy.

An eight hour day wasted by Alessi and ADA Brennan cleans up his mess in less than 15 minutes. Brilliant!

Hank Brennan seems to believe that evidence from John O'Keefe's cellphone is a better indicator of how he died than evidence from his actual corpse.

Are the jury seriously going to believe all the mental gymnastics they're doing with these experts trying to line up data from the Lexus and his cellphone to indicate a vehicle strike when there are much bigger and more obvious glaring questions which need answers and they are providing little to none?

Ime most cops or military carry when not on duty. I would be surprised if most of them weren’t. And that is scary when you take into account the amount of alcohol involved. Not just because of who they are, but anyone who is heavily drinking and carrying.
