There were 30 TSE’s in an 8 month period for Karen’s car - the 8 months she owned her car before John died.

Alessi is asking if Burgess would conclude there were 30 collisions. Burgess says no.

There were two triggers 1/29/22 - 1162-1 and 1162-2. Burgess says he can’t tell if 1162-1 was a collision or not. He also referred to 1162-1 as a three point turn.

Alessi is pointing out to the jury that there is no fact or data Burgess has to conclude there was any supposed collision for 1162-1. So why can he say 1162-2 is? Slamming on the brakes or any kind of unusual driving can trigger one of these TSE’s - they’re not collision events.

Burgess just conceded that there is nothing in the black box indicating a collision - ‘not by itself’…

I'm not sure if you missed recent events? During the hearing where judge cannone ordered she would allow burgess to testify to info in his newly altered report, she gave a 'remedy' to the defense because the altered report was only received by them on May 11th. And because the defense had already crossed other witnesses using burgess' prior timeline per Jan 2025.

As I understand matters, Alessi was given up to four days to cross examine this witness on an extended range of areas. He is doing his job and doing it well. IMO

The interest for me lies in how well Alessi is representing and defending his client, how politely he is doing it, and how informed and well prepared he is, despite the disadvantage of late changes to Burgess's report mid trial. Moo

There was no collision history in Karen’s Lexus, PERIOD. In her entire 8 months of owning the car - including the night John died.

Now discussing Burgess criticizing Maggie Gaffney, the defense expert who did the chip-off extraction.

Burgess criticized Gaffney for failing to extract the micro SD card in the original chip-off process. He even tried to blame Ms. Gaffney for the ‘bits/bytes’ because he assumed ‘a competent expert’ (Burgess’ words) would not have overlooked the chip, so he was then confused on the rest of the process (LOL).

Burgess showed several examples of video evidence yesterday that contradict his own analysis. He says the Lexus clock is slow; you have to add 21-29 seconds to get the correct time.

But when you apply that to Karen leaving 1 Meadows to look for John around 5:07, we see that even in the video presented, the Lexus is leaving the garage before his alleged power on event.

It's actually huge because he is being presented as an expert by the CW and it turned out he lied about his qualifications. Now he is being caught in all kinds of errors.

Once it was established that this guy has no expert credentials why are we still questioning him? Shouldn't he have been dismissed by CW or the judge? So we are going to go hours and listen to what he has to say? Makes no sense.

Because Burgess’ report is the entire basis for Welcher’s report. MOO.

So Ms. Gaffney did nothing wrong. At the time of the initial chip off, Berla didn’t support the micro SD card. She had no need to take it, because Berla didn’t provide the technical support needed to address the info on the SD card.

This guy is a freakin' disgrace. Horrible liar, horrible science practices, and just flat out lazy. I can't take anyone seriously who makes excuses for this clown, including brennan. Every single thing this guy vomits out of his mouth is questionable at best and completely laughable.

I also can't take Aperture seriously as a business. Any company that allows this type of analysis to go on without an checks and balances is complicit in fraud IMO. Any customers who used their services should ask for a refund and anyone who was convicted of a crime because of what they said, needs to go back and look through everything they did and question their findings. If they are this sloppy and reckless, chances are their data was false, and their cases might be over-turned.

And because odd as it is, some people feel that just because he is a fraud doesn’t mean his conclusions are wrong - so better to be crystal clear that not only is he a fraud, his findings are also fraudulent. Jmo
