Where did this come from? Who has the texts they are trying to get in from that group chat?
AJ made reference to it when he finished his cross of Proctor in Trial 1, shortly before the infamous "shame on you sir!" comment:

Oh I thought it was referenced today and I hadn’t seen it.

From the end of court today…
Starting about 7::20:15 is where Yannetti is arguing to the judge during a voir dire about these text messages from Proctor (Chip) in that text chain to his long term high school buddies

Ok.. I hope this will clear up the "pin it on the girl" thing. It was in a question to Proctor from Jackson in his cross examination in the 1st trial. I tried to grab a bit before the comment/question to give it context, and have linked it as well ;)

in a conversation with buddies after a friend writes, "something stinks", Proctor's response is "yeah, but there will be some serious charges brought on the girl"

Jackson then says just pin it on the girl in a question to him in the exchange:

5051 writes but I assume you guys are out to make it cut and dry since it involves cops, correct? yes

and bird/Berg (??) writes something stinks correct? correct

and then Trooper Proctor you responded, yeah but there will be some serious charges brought on the girl, isn't that right? that's right

so in that text exchange you were saying yeah we're out to make it cut and dry correct? no

you didn't write yeah we're going to follow the evidence wherever it takes us, you didn't, did you? I did not write that

you didn't write, yeah we're going to make sure that we investigate this thing fully and thoroughly before making any decisions, you didn't say that, did you? I did not

you wrote, yeah but there will be some serious charges brought on the girl isn't that right? correct

and the reason you wrote that is because you knew as the text above it says this has to be cut and dry because it involves cops right? objection. judge: I'm going to allow that, is that the reason you wrote it? no you're honor

and then you indicated we're going to put serious charges on the girl, who did you mean by the Girl by the way? the defendant

Karen Read? yes

sir so the way that you were going to make it cut and dry, pretty simple, just pin it on the girl right?

IMO She was the worst ME I have ever witnessed testifying. I personally have no faith in her or her opinions.
There are others that don't like her. Those others don't be because the ME had made it clear that she cannot rule JO's death a homicide. And stating, that the manner of death is undetermined. She stated the injuries aren't that of a car accident.

Why stop there? We also have:

Ian Whiffin: It’s possible John O’Keefe’s phone was inside the house.

Dr. Aizik Wolf: This looks exactly like the injuries we see when someone slips and falls on their head.

Dr. Judson Welcher: We don’t know exactly how he was struck. We just don’t have enough information in this case to determine that.

I think I read that the defense has another ME on their witness list. But no idea if they will call her, not sure they need to at this point.

But he still played magic marker with the purple paint. Why not use a rubber arm with cadaver bone inside like I saw a youtuber do. Many broken bones when arm hit the light enough to break it. Dr claimed John's hand hit the center of the tail lights

Yet, he avoided these kind of tests. Why?

Is she contradicting her own words, or is she playing out scenarios in her head? I watched the ID documentary. Frankly. I found her refreshingly honest and open. I’m from Massachusetts so maybe I see a kindred spirit where folks from other states and/or countries, might find her abrasive…..I’ve been thinking about that a lot lately….imo.
According to the officers that interviewed KR at her parents house, sitting on the couch with her mother and father, KR told LE she never saw JO go into the house. Then in the documentary "A Body in the Snow" after her arrest, securing lawyers and during her trial, KR changes her story to...she watched JO walk from the Lexus to the door and walk inside the house.

Massachusetts State Police Sgt. Yuri Bukhenik testimony on Day 8, 9th andx12th. I watched the Live Feed on Law&Crime Network.

And Brennan, surely as a rabid dog the entire cross, fails to discredit the witness and ends up just blowing up Aperture’s credibility if anything. Another self destruct!
Great witness clear and straightforward.
JMO

I agree! I felt the same way about him. Clear and concise.

What today's prosecution was like, paraphrased, for anyone who missed it or doesn't want to watch it -
Brennan: Your report might be wrong, correct?
Witness: My report was based on Burgess' report (POSTER NOTE: Burgess is a prosecution witness who lied about his credentials and is NOT an expert)
Brennan: But your report MIGHT. BE. WRONG.
Witness: If it's wrong, so is Burgess'.
Brennan: What's important SIR is that your report could be wrong! AND YOU ARE NOT AN EXPERT!
Witness: Never said I was an expert. My client is the defense.
Brennan: *thinks he achieved some a-ha moment while everyone sits confused knowing that he discredited his own witness by attempting to discredit this defense witness*

It was embarrassing to witness. Also, Brennan's weird, unbridled anger toward defense witnesses will never cease to amaze me. Yes, the defense all raise their voices to make points, but they are polite toward even the most suspicious of prosecution witnesses. Brennan just yells at them whenever something is bad for his case lol. We call that the Liar, Liar defense. "I object Your Honor! Because... it's BAD FOR MY CASE!"

Were these texts allowed in full, in context, at the first trial?

That sums it up lol

Half way through, all I could think was... if the jurors understood that all of the data in DiSogra's report was from Burgess and Welcher's reports (both CW witnesses), the jurors should have been questioning the questions being asked IMO

I kind of tuned out part way through cross because I couldn't believe he was going after the data LOL

The Defense is NOT going to call proctor according to Yanetti.

" On the way out of court, Read’s lawyer David Yannetti said it was a “team decision” to not have Proctor take the stand.

Instead, the defense plans to use people Proctor messaged as a way to introduce his crude texts in the trial. "

Too bad. I wanted to see him squirm again.
BBM

Dang, me, too.

Why ever not? Isn't he the cornerstone of the defense's whole SODDI?

Hopefully you don't have an unattended death in her jurisdiction.
