ok, I missed it... what was said that caused the objection/sidebar/mistrial ? Brennan said what about the DNA?

Note: I'm scanning through proposed jury instructions from both the defense and the Commonwealth -- it doesn't appear as though the defense is requesting a third party culprit instruction for the jury to hear, only a Bowden (insufficient police investigation) instruction. #WBZ

What this means is when the Judge gives the jury its instructions ahead of deliberations, she can give instructions LIKE the below, as requested by the defense. The defense has NOT requested that she give an instruction about considering other suspects in the case. #WBZ

There has been a lot of legal conversation about if/how defense strategy would shift in this 2nd trial, including how much lawyers would lean into the third party culprit theory. This request appears to answer that question (when reporters ask Read, often the answer is "TBD.")

He brought up the dog DNA or lack thereof. Alessi is arguing that the CW never brought this up during their examination-in-chief, and are intentionally bringing it up now when they have no basis to. He is arguing to dismiss because he said Brennan just tainted the jury beyond anything an instruction can fix.

I get what you're saying here. Last trial the FBI's case was still ongoing, so that's why it was not allowed to be mentioned. It's all still a total mystery. We still don't know the exact details of their investigation. I also think it's strange that the jurors weren't told that this is a second trial, but that has been unveiled during testimony, just like the FBI was with Devers. The court decides what the jurors can and cannot know.
Locally the word has been out forever that Morrissey is a target of the FBI - the KR trial was just tangental as I believe was the Sandra Birchmore case ( a homicide by cop being called a suicide) - they happened upon these things and stepped up with federal charges in Birchmore. I am not sure what the Federal charges would be here ianal.
In no way shape or form do I believe that the federal investigation is over.
Massachusetts is considered by the Fed Govt to be a "sanctuary" state. It votes D. I do not believe that the change of AG'S put an end to the FBI interest in Morrisey/Gov Healey or Mayor Wu.
Notice what's happening at Harvard.

Alessi just moved for a motion to dismiss with prejudice. He says Brennan intentionally brought up the dog DNA for the first time in open court today. He says the defense has not mentioned DNA at all.

He says there was no meeting or transcript where the DNA has been discussed.
Wow, I missed it this morning and just went to watch.

Poor pathetic Brennan…. he’s asking Russell if she saw in the photographs that she viewed the bushes, etc., where John laid. There were no photos of John’s body to determine where he laid IMO

I wonder if that has a lot to do with BA and BH not testifying? There is another motion requesting specific instructions to the jury about them not testifying and they can draw the conclusion that it would be negative for the CW case (not the exact words)

And yes someone proof read and made suggestions about format not substance. Thats it.
It was not ghost written lol
Just Brennan throwing out innuendo thats meaningless.
Why ? Because he has no case and he knows it

I have seen her eye rolls several times. It is extremely unprofessional and out of line. If the jury are specifically asked by the judge to temper their responses, a court reporter who is a professional should also have better behavior.

‘Brennan's too-cute strategy of deliberately concealing anything "bad" in his case in chief (Proctor, the Alberts, Higgins, and yes, anything related to Chloe the dog) has become a serious issue. There is no evidence of a dog DNA test (let alone the results or how and where it was collected) before the jury. This was a calculated choice by the prosecution. But Brennan just basically testified as an unsworn witness by suggesting that evidence exists as part of his effort to discredit Dr. Russell. Will the judge order a mistrial? Of course not. But what is the remedy here? Telling the jury to ignore what they heard? Past experience tells us that is probably all she will do.’

iMO you could say the FBI case has been “paused“ perhaps it’s waiting for the result of this trial and the Birchmore trial. Question would be will they do anything about it?

I sure hope so. I feel sorry for the people of Massachusetts. Historically Massachusetts, one of the original 13 colonies, has a wonderful presence and historic value. The founders have got to be ashamed of what is going on, especially in this area of the state.
