it is in the testimony, not cut out, it is in re-cross by Brennan. Law and Crime went down for about 1-2 minutes at the very end of his cross then went to break right away.
Ok so it was well before that "break" happened, the whole Brennan hoodie thing?

yes that was just normal procedure. otherwise Brennan would have to call the same witness twice. so for efficiency reasons he doesn’t have to do that.

Alessi made that motion for the internet. This was different. Brennan made a genuine mistake.
So Alessi must be dirty but dear old Hank made an innocent mistake. Interesting................

I believe him. I can't see a special prosecutor deliberately creating a situation where it's going to make the commonwealth look bad for having put incorrect information to a witness. Of course he would expect Karen Read's team to pick up on an error as big as that, if he was going to do it deliberately. Much as I think this defence team is grasping at straws, I wouldn't even accuse them of lying either, if they'd done the same.

It seems reason has gone out the window when I see twitter defense attorneys posted here calling it a deliberate lie.

it’s strange Alessi would ask for a mistrial. if the D was confident in their case he would not want to have to run the trial yet again.

My guess is they realise ARCCA landed badly.

I respectfully don't agree with you. Test E very much agrees with Dr Welcher's testimony, which I found extremely compelling and informative, as well as few other prosecution witnesses testimonies. MO
I’m wondering when you decided KR was guilty? I find it so interesting that you and I are watching the same trial and our opinions are diametrically opposed. Imo

Ok so as I'm understanding it, Brennan didn't lie, he made a mistake 😳 and the judge is instructing the jury on the facts of the holes. A whole lot of extremes by the defense about nothing very earth shattering really. AJMO

I’m sure this would be the feeling if a relative was on trial for their life JMO

As in hastily scribbled that made me think is she actually writing anything of fact?? What is she really writing, so off the cuff and quickly and not pleased as we all saw. IMO
Wait a minute @keek ….. does this mean that the judge did not go research case law or other legal reference materials or prior occurrences in this trial before making a determination and statement on the record? MOO

He asked for a mistrial with prejudice. That means the case would not be re-tried. So no, it had nothing to do with wanting any kind of redo.

KR would not be able to be tried for this again if it was granted.

But now I literally cannot understand how anyone could not think this case is complete, absolute 100% horse manure.

Throughout the entire CW case, all we heard from Judge Cannone was how ahead of schedule they were. But now when the defense is on, she’s suddenly apologizing to the jury for having to be so patient. Oh, and the entire hold up with the medical examiner today is on Hank, who has had Dr. Laposata’s resume and report since MARCH.

Not to mention the amount of time it took to get to the decision to undo Hanks "misunderstanding"
aka stunt.
If I am on the D I would stand up next time and tell her - stop with the time BS - in a nice way of course

No Judge would grant that with prejudice. Obviously he should have just asked for a jury direction but he decided to play to the cameras.

So Hank Brennan knew that there were holes in the back of JO'K sweater, but didn't know that the cause of them was the CW's own criminalist? And then questioned DR Wolfe in good faith asking if they could have been caused by the incident on 1-29-2022?
