Three questions -
1) Timeframe for OUI charge 12:45 or 5am?
2) Are video clips of KR interviews evidence? How can we consider them?
3) Does convicting guilty on subcharge convict overall charge?
the 1st one... I kinda wondered that too... they could easy find her guilty of driving at 5am with the blood alcohol level IMO

Stupid verdict slip. Of course they have questions on the sub charges with the overall charge.
Surprising no one except Judge Cannone, apparently.

I think they’re arguing on whether or not to convict on OUI, and that’s it.

Why not? Then they can have the police remove anyone standing out there. They won't though because we have this little thing called the First Amendment in this country. IMO

These questions are positive for Ng on all charges involving hitting JO. They may do what the defense offers as a way out and Ng on the Oui only. They want to make sure they are not convicting for Manslaughter if they tick the lesser OUI. Jmo

I think the jury understand there is no case BARD JO was ever struck by a vehicle and they believe the defense's experts. I feel they are close.

going down exactly as expected. Drunk at what time? Should we take her words about drinking as evidence? Clearly confused and wanting to go with count 5 but uncertain if it implies manslaughter. It is clear they are close and think it will be 5.

It’s absolutely ethical. Our right to gather and protest is protected speech. Absolutely! Are you from the US? You can’t block one’s right to gather and protest because you don’t like the message. They are abiding by the buffer zone.

That would be my thought too... the only reason to be concerned that it means she is guilty on the other charges if they find her guilty on that would be if they don't think she is guilty of 1 2 3 4 ... IMO

I still think she should be NG on all charges but if they do just find her guilty of DWI then it is a win for her and after all she has been through she will be able to move on with her life.

Which also makes me believe that not all of them are convinced she was drunk at 12:45am ish

The defense tried hard to get Cannone to recognize the verdict slip read the exact way the jury is asking the question. They want to make sure she’s not guilty of manslaughter if they possibly vote guilty on OIU. IMO.

FYI - OUI in Massachusetts for First Time Offense can be up to 2.5 years in jail. I would imagine Bev would get the call on that.

Wow I’m not surprised at these questions. That verdict form was a huge issue. Sounds like only thing they are talking about is driving while intoxicated. Which imo shouldn’t have even been a charge by itself as an option. 🙄

Since I mistakenly didn’t realize she was charged with a simple OUI, I can’t even remember what was testified to in this trial about her actual drinking. Was it just this “reverse BAC” and the vid clips?

The whole thing with the verdict slip is so annoying. BC could have and should have remedied this issue especially in light of prior issues in 1st trial.

Exactly! Putting NG and G boxes by each separate charge was obviously less confusing but Judge/CW wants it confusing
