I am sure if this where they are talking but checking out barriers again you cant slip and end up over an 8 foot protective barrier you fall down on the link fence

Didn't I read he was walking on the tracks. I can see gaps in the train tracks here. Could he have slipped in between the tracks?

hi Ninj!!

I am hung up on word "entered". If I saw someone, on vidoe fall throught the RR tracks , I would use we saw him fall.

Entered just sounds like walking in -- but that pic I just saw,, I must confess quite scary

Oh my my my does this shot fit in with any of the names this pier that bridge etc etc casue sh$t, that looks really easy to step into goodness me oh my!

Some theories die hard. But I think this will prove to be a tragic accident .

man that hole is one heck of a hole, If that is where it happened the Marrs arein to money land. That is unacceptable in terms of just mainence for the trains themsolves

IMo, unless there is note on him, this will be not foul play and they will forget it just like all the others except the one where they blaently caught by forensics, But that family I would had the resources to as they say fight city hall

Yes this is what appears to be a sad ending. I really feel for his family. I just cant even imagine.

I think you guys are dead on with the thinking that he fell through the tracks. That picture with the cops huddled around being the dead giveaway.

But oh Zach what the hell were you doing over there? I would say drunken fun walk on the train tracks sounds like a good theory but given the weather it just doesnt make sense. I can only surmise that this had to be intentional. Zach made a bee line for the water it seems. Just no real explanation for him to be over there

Very sad all around. I think the only thing that will bring peace and comfort to his family and friends will be that so many people cared and the thought that Zach is with his beloved grandmother again

Thinking it was the shortest route to catch the train makes sense. Plenty of better places to enter the water if that's what he had in mind. Being, scared, cold and afraid he might miss the last train... I think he convinced himself he had found a shortcut, and over estimated his capacity to manage it.

I'm nearly positive that's the Nashua Street Park. Isn't it pretty? William Hurley drowned there after a Bruins game. And an elderly homeless woman more recently--I can't even find an article about her.

Yeah, that makes sense with all the new information added on to what we knew before.

It fits the LE description of the video too--walking on the bridge, disappeared. Because he fell through the hole.

If you look closely at the picture, you can see it isn't a hole inthe tracks, it's a gap between the two sets of tracks. Not a maintenance issue at all.

Plus, he's trespassing, and I will just about guarantee that word will be in the final report.

I agree.

I'm sure there is plenty of signage warning trespassers. Not only that, but physical barriers such as the fences. I can't see any lawsuit succeeding against the owner of the railroad ROW (right of way).

It can't be argued that the signals were malfunctioning like a lawyer could possibly make at an at grade crossing (where a road crosses tracks) and being hit by a train. From what we know at the moment, the railroad doesn't seem to be negligent here. IMO.

Found it, never mind. It is the Zakim Bridge.

I have been following this case, not posting, but felt certain the result would be an accident of some kind. Very sad, hope the family is able to receive some sort of finality soon.

It's been mentioned before, but I think the use of the word "entered" is just to remain neutral and report the basic facts. If I was a family member or friend and an article said he had "fallen through a gap in the tracks" I would find it fairly horrifying to imagine his final moments. Not to mention those of us who like to pick apart every word might then start going on about liability or that poor maintenance killed him, for example.
