Let's Sleuth the theory that this Victim got drunk, was over served and got "tossed out" of the bar and refused entry using MSM or LE links as required by TOS;
Darn. Searching Google using keywords from the theories here, at least to start, I can't find anything but blogs and reader comments. Those are considered rumor per TOS so I cannot link here.
So use "Drink" as a keyword there are 2 right away;

So what about the theory that he got "tossed out" and the bar is to blame and should be sued.? Again, nothing I can find in MSM or LE. Lots of speculation in reader comments, SM and blogs.

So to assume he was bounced out we then have to assume that he lied to his cousin and was not going out for a smoke. Why didn't he say "the bouncer is making me leave"?
Lacking further information and looking at a theory I use Occam's Razor: The theory with the least assumptions is the best one.
I end up with a reasonably sober young man doing ordinary things with ordinary people who perished due to an unfortunate accident on an historically, and dangerously cold night in Boston.
I see no need thus far for considering liability, law suits or blaming the bar, the railroad, family, the victim, etc.
This is my theory based on the actual information we have and
