I don't think there was any argument put forth as to decency. I think it was the veracity which was the issue.

Weird that what he saw which reflects badly on CB is being questioned but what he said he did is accepted because it reflects badly on the police.
There were people posting, not you, what HB was actually convicted for, that it wasn’t much of a crime. He was given a seven year custodial sentence for people smuggling - taking advantage of poor people who had fled their home country.

Please provide the quote that explicitly or implicitly stated what he did was a bad reflection on the police. My point is that it should reflect badly on him, it seems obvious he was stealing items from CB which he could sell or used to commit other crimes.

I think there is a question mark over his truthfulness. I wouldn’t want him as prosecution witness and FF is clearly intimating that he will give him a very hard time if the prosecutors are relying on him as a key witness.

Do we know if DM had a cat? I often read that but CB in his statement said he stroked „a cat“ so not hers, which makes the cat transfer rubbish even more unbelievable
It’s inconceivable that such an argument was used when saying it got there when he was stealing her panties off the washing line or anything else would have been better.

I think it was probably CB knowing he was done for and saying it as a piece of immature self amusement.

Quite. Also, It’s been mooted that DM invited CB into her bed, but no attempt by him or his legal team to claim this was a consensual act, so I think we can knock that theory firmly back into the ground where it belongs.

Ah they'd have loved it. The evil cat put the hair there deliberately o_O
Hasn’t Roald Dahl been cancelled? What a sad reflection of current society.

Evidently they have enough to warrant charges though! A German judge won’t sentence somebody for life (preventative order) if they aren’t presented with evidence that the accused comitted the crimes. A German prosecutor won’t put somebody in front of a judge if they didn’t think the prospect of a conviction outweighed the prospect of a aqcuittal. Therefore (IMO) judging by their actions it seems pretty obvious that they’ll have evidence far beyond what some speculate they have. Because if the didn’t they wouldn’t have charged. They can have incriminating evidence without identifying the victims.
Well I hope you're right, and I hope the trial or trials are conducted transparently so we can see that you were right.

But imagine if these trials were taking place in Moscow or Beijing. Folks being convicted on the evidence of informants saying they saw videos that no longer exist. We in the 'democracies' would be chattering about show trials wouldn't we?

Transparency is important, or people will be concerned about methods being used. Unfortunately the German justice system doesn't seem to be awfully keen on transparency.

The media trial bizarre, very cagey and strategic IMO. Both sides are trying to pressure the other.

Several questions with this:

Was the room lit or was it dark?
Was HB masked (swimming goggles) or not?
Did she see her attacker close up?
Had she been drinking? (Please, Im not victim blaming just alcohol affects perception)

All can bring into question eye colour during the trial.
I listened to her RTE interview some time ago, but it stays with you because she spoke so lucidly about her ordeal.

She described her rapist and his MO in detail. This before CB was identified as any suspect in the crimes for which he is charged.

From memory, she wasn’t masked until the end, when the rapist covered her head with a sheet before he left.

No mention about lighting but I’d a hazard a guess the rapist wouldn’t waste his time by filming in total darkness.

If she saw and described his eyes, one can deduce she was close enough to do so.

She wasn’t drunk and in fact she left a social event early because others in her company had a fall-out.

All can vouch for her handle on the situation, I would say.

HazelB ‘did describe the fact that he had blond eyebrows and ‘‘piercing blue eyes” which she could see ‘even in the dark’.

German police investigating Maddie suspect “have eye on” 16-year-old Praia da Rocha rape case - Portugal Resident

So by her own account she had a clear and sure recollection of the man she says attacked her.

Then, after CB was identified as a suspect for MM’s disappearance:

"In fact, it was my brother who had spotted it first on RTE and sent me a link.

"The minute I saw it, I was certain he was my attacker. It made me sick to the core."

EXCLUSIVE: Irish rape victim reveals 'delight' at finally seeing Maddie suspect Christian Brueckner in court after '18 long years' - Olive Press News Spain

Just while I’m on the subject of HazelB, it’s worth remembering that she awoke to the rapist calling her name. In the RTE interview she says that ‘everyone’ in the resort knew her name, and knew who she was. Because she was the ‘kiddie rep.’ Looking after guests’ children. Meeting them at the anirport etc. And probably observed with those children out and about in the resort.

Just my thoughts on it.

You need to accept the fact that women don't always tell the truth.
But why would she want to take them both to court for a lie? What would she gain? And does it follow that this conviction was a mistake?

I’m sorry, I can’t follow the logic?

According to this, she lived alone with her cats for 17 years after her husband died, Hygge.

It’s a good response.

The only counter I have then is why was she unable to identify the scar/mark? It was light enough to film and identify eye colour and she had four hours to analyse her attacker.

I’ll listen to the interview, I knew that she had spoken out beforehand but have not listened to it before.

Bizarrely that cat link I just posted for Hygge also has a description of CB’s body scars. Topical.

‘Given his repeated offending, the file provides a vivid physical description of Brueckner who has a pockmarked face, pierced ears, a five-inch scar on his lower back, an eight-inch scar on his right arm, birthmarks all over his body and hands’, including chewed fingernails. It even details a distinctive scar on his groin.’

I can only add that hopefully we’ll have more information in court Denis - FX.

TY Okapi, haven’t seen this, interesting it is the same article it says CB is full of scars and marks including scar on his lower back.

Very similar description to the Salema beach attack.

with the difference here a 8 inch scar is mentioned on his right arm, the girl reported a bandage on his right arm

Besides the translation CB did for ALE when they were stopped for pepper spray at the airport, did he at any time act as translator for the PJ?

I would think a criminal record would preclude that. Why do you ask?

Adding to the debate here about consent, I think the victim's statement doesn't imply consent at all. It describes forcible oral SA. Her mouth was raped.

Where is the victim’s statement? There is no identified victim. I think you must be referring to the charge.

I don’t think that anyone is arguing that forced oral sex is not a criminal act.

However, without a victim, how can consent be established? It would be straightforward to argue doubt in this scenario.
