Did I just hear her right? She is charging the driver with murder?
All the others are being charged with assault and manslaughter - which is what I thought.

But the driver is charged with murder?

That's how I was hearing it???

I'm very glad to hear her state that this is I no way an indictment on the department overall.

Oh...did she ever mention data from the GPs on the van?

I get it - I do. All along I kept thinking manslaughter but murder?

Murder carries intent to kill and I just can't wrap my head around this driver INTENDING to kill him. Hurt him, rough him up, whatever - but I don't believe there was any intent to kill.

And, yet, even though I agree with her, she had to bring up the grandfather, and his racial accolades. STOP it, FGS. A crime is a crime and people are people, or so I hear from certain quarters.

The only thing I don't like about this is she seems very angry, which infers it's way too personal.

So no reason to riot huh. I for one sure would not want to be on this Jury. These are charges not convictions as we know.

second degree murder
n. a non-premeditated killing, resulting from an assault in which death of the victim was a distinct possibility. Second degree murder is different from first degree murder, which is a premeditated, intentional killing or results from a vicious crime such as arson, rape or armed robbery. Exact distinctions on degree vary by state.

Surprised it didn't go to a GJ like most cases.

I'm dumbfounded we are hearing this today. I thought it would be awhile before we heard.

I listened on the radio, she sounded to me like she was angry, but angry about how many times they could have belted him in and angey about the number of times he asked for medical help. Just my opinion but that is when I noticed it. jmo idk

I caught that anger too. She is very young and very angry. Her micro-expressions were almost scary.

Ok - murder with no intent - then what distinguishes that from manslaughter?

K, talking head expert on FOX right now saying 2nd degree means there was intent. I think what he's trying to say is that premeditated is completely different than "intent."

Paraphrasing....

Jurors would have to be swayed to believe there was "intent to harm."
