This is interesting. According to this the knife does not necessarily have to be spring operated which means that any pocket knife would be considered a switch blade. I don't know how this prosecutor claim that this weapon was legal when it had a folding blade.

A pocket knife needs your fingers to open. Your fingers are NOT a device! I don't see it as ambiguous at all. If there is something that is on the knife that is designed to open or close it automatically...that's illegal. I am sure the wording is in there because manufacturers found a way to make a knife open that is not an automatic spring.

If I am understanding correctly the charges are stemming from an illegal arrest. If that is the case and it goes in front of a judge that decides it was a legal arrest and drops the charges will the SAO be able to recharge them under something else, or would that be double jeopardy and the cases closed?
I have seen mentioned on tv by a lawyer that basically said the had the right to stop him because he ran from them in a high crime area. Can a judge at their arraignment decide they had probable cause and end it right there?

They had probable cause to stop him but the SA is saying not to arrest him, if I am remembering everything correctly.

On Fox , Shepard Smith said ( verbally so no link ) that one of the officers arrested had severe mental problems, so severe that at one point they ( le ? ) took his gun and he was admitted to hospital ( mental ? ) . If that is the case, then why was he back on the force in a capacity that dealt with public ?

Also, I 've been thinking about this 'illegal arrest'. It sounds to me like what they are saying is since the arrest was illegal, then there is no protocol to follow like how to treat a detained or handcuffed man . That is no longer leo's vs. prisoner but now is just human v human. I mean I wonder if they are removing any ' on duty' behavior by the leo's and saying it's as if 6 men walked up to 1 man at church and did this to him, then the results would be these charges. Did my post make any sense? It's hard for me to explain. :S

As far as discussing the knife

My hubby had a knife (a long time ago) that even though originally you had to "pull it open" - over the years it became so lose that all you had to do was "flick" your wrist and it would pop out = just like a switchblade. So, what would that knife have been called under this law?

It goes back to what someone said earlier... why insert racism into this case when it appears racism has nothing to do with what happened to FG.

I'm not sure exactly what you mean here? There are knives that made that open without an automatic spring, both spring assisted, and gravity knives. Spring assisted is what FG was carrying.

Aside from the few facts we do know I am stumped as to how these Officers thought they would get away with this?

I'm still wondering what they would be getting away with. Obviously some sort of negligence but I'm still waiting on any hint that a murder was committed.

C3,4 and 5 cause immediate death. So this injury was below that. Per CNN

My lovely Bravo, this is not exactly correct. High C spine fractures, like C1 and C2 more often cause death. Xo

The point about why he ran is a good one. Overall picture is that FG had some type of issues as a result of previous lead poisoning. Had been in special ed. Was not an especially big person. Wouldn't these issues have made him a target of bullies when he was younger? Would he still have been a target of bullies?

It's out there that LE thought they were observing a drug deal going down. Hence both guys fleeing. TIFWIW

Clearly it wasn't or it wouldn't have been an illegal arrest. The SA said the knife was legal. Just because you heard it was a switchblade from LEO or reports from sources, does NOT make it true! Is this something that confuses people? That reports put out by LEO or sources close to LEO are often erroneous?

If there is a device that makes the knife open by pressing it or manipulating it, that is illegal.

I guess I am confused why this isn't clear! LOL!

Tobin calling him out. Rightly so IMO b/c CW is speaking as if he's read the MEs report, and last time I checked hog tied meant hands and feet tie together behind the back, this is not at all what it sounds like happend???

This whole thing is very messy!

That's EXACTLY what I have thought ever since I saw FG's record. He was known to LE - his last arrest had just been 3/13 - so there ya go.

Shades of the MB case where that crazy ME said he was shot in the back and witness said the same.
