Casey Anthony cut off from 'fed up' George, Cindy, WESH reports
posted by halboedeker on Sep 1, 2009 6:09:46 PM
<snipped>
Casey Anthony is no longer getting any letters from her parents, and George and Cindy Anthony are fed up, WESH-Channel 2 reported today.

Defense attorney Jose Baez has controlled the correspondence between his client and her parents, Brad Conway, the attorney for the parents, told WESH's Bob Kealing.

But George and Cindy Anthony plan to start mailing letters to their daughter despite Baez, Conway said. "It's been terrible all along for them," Conway said. Andrea Lyon, the new defense attorney, says the parents should have a video visit with their daughter, Conway said.

Baez did not respond to WESH, Kealing said.

The WESH reporter called attention to a new sign at Orange County jail warning attorneys that personal letters are contraband, and said that policy was having "a ripple effect" on the Anthonys. Casey Anthony is charged with the first-degree murder of her daughter, Caylee.

Anthonys To Mail Letters To Casey Despite Policy
Bar Clears Baez Of Ethics Claims
POSTED: 4:30 pm EDT September 1, 2009
UPDATED: 6:28 pm EDT September 1, 2009
<snipped>
The Orange County Jail said Tuesday that its re-emphasis on the ban for lawyers bringing personal letters into the jail has nothing to do with Casey Anthony's attorney.

Administrators have posted a sign strongly reminding lawyers visiting the facility that it is a felony to bring in contraband items, including personal letters.

Brad Conway, the attorney for George and Cindy Anthony, confirmed that Baez has a standing policy of controlling letters going between Casey Anthony and her family. Conway said his clients are cut off from their daughter.

Conway said the Anthonys are breaking that agreement and will begin mailing letters directly to their daughter. Conway said that defense team member Andrea Lyon agrees that the Anthonys should be able to have a video visit with Casey Anthony.

Officials deny that it was Baez or his actions that prompted the jail's re-emphasis of the rules.

Casey Anthony: Jose Baez says ethics allegations motivate him to fight harder for client who says she is not guilty
posted by halboedeker on Sep 1, 2009 6:49:51 PM
<snipped>
After being cleared of several ethics allegations, Casey Anthony's attorney Jose Baez was speaking out on WKMG-Channel 6 tonight. The CBS affiliate scheduled the exclusive interview at 6:30 p.m. to compete with national news on ABC and NBC.

"Jose Baez says he knew he did nothing wrong, so it came as no surprise to him when he received this letter from the Florida Bar clearing him of an ethics complaint," WKMG's Mike DeForest reported.

Baez insisted that he never told former private investigator Dominic Casey to do anything unethical, DeForest said. Baez had no idea why the private eye would make such a charge. Baez was cleared after a four-month review by the Florida Bar.

"It's discouraging to hear your name thrown around like mud, especially when you work so hard," Baez told DeForest. "I know what it's like to be accused of something you haven't done. So what it does is it really motivates me to fight harder."

That feeling evidently has cemented the bond between Baez and his client. Anthony is charged with the first-degree murder of her daughter, Caylee.

"My client has told me she's not guilty, and I'm working hard and doing everything that I can as her legal counsel to put the state to its burden," Baez said.

Padilla Tapes May Be Released In Casey Case
Posted: 4:54 pm EDT September 2, 2009

New tapes could be released as early as Friday in the case against Casey Anthony. They are recordings of bounty hunter Leonard Padilla and his team.

Investigators interviewed them in California last year and there are more than three hours of recordings.

The defense tried to stop the release of the tapes by saying Padilla was part of their team. However, a judge shot that down and approved the release.

Casey Anthony: Leonard Padilla tapes to be released

Coming soon: the Leonard tapes.

Investigators' interviews with bounty hunter Leonard Padilla and his team could be released as early as Friday, WFTV-Channel 9 reported this evening.

Casey Anthony's defense team had tried to block the tapes' release, but a judge has OK'd making them public. Anthony is charged with the first-degree murder of her child, Caylee. Padilla and his team could offer insights into Anthony's reactions and comments when she was at home last summer.

The tapes run more than three hours, and investigators talked to Padilla's people last year in California, WFTV reported.

But did Padilla remove his toothpick during the interview?

UPDATED: Judge will set Casey Anthony's check-fraud trial date in near future
Casey Anthony's defense argued that preparing for the check-fraud case would hamper her legal team's ability to prepare for her murder trial.
11:19 a.m. EDT, September 3, 2009
<snipped>
The spokeswoman for Casey Anthony's attorney Jose Baez said the defense team's reaction to the judge's ruling is "disappointing."

"All our resources need to be focused on defending Casey Anthony from the State's determination to seek the death penalty," spokeswoman Marti Mackenzie said in an e-mail to the Orlando Sentinel.

In support of its motion, the state offered an affidavit from Amy Huizenga, Casey Anthony's friend and victim in the check fraud case. Strickland wrote in his order that he found Huizenga's affidavit "compelling."

"The affidavit states that the duration of this legal process over the last year has caused her a great deal of mental stress," Strickland wrote.

"After considering all of the factors and argument of counsel, this Court feels that the best resolution is to set the matter for trial in the near future," Strickland wrote. "In terms of legal skill and analysis, this case is rather simple."

Also this morning, the State Attorney's Office notified the media that more evidence will be released tomorrow morning. The information will include several audio and video clips. It is expected to include an interview with California bounty hunter Leonard Padilla.

UPDATED: Casey Anthony Faces Fraud Trail First, Then Murder
Friday, September 04, 2009 6:19:44 AM
<snipped>
Casey Anthony’s defense team learns Casey's check fraud trial will not be put on hold until her murder trial was over.

Orange County Judge Stan Strickland ruled Thursday Casey will have to face check fraud charges before her murder trial.

Her defense tried to fight the motion but prosecutors won the day by arguing the victim wanted swift justice.

Legal experts said something else may be at work.

To win a death penalty case, prosecutors need aggravating circumstances, one of which is a previous felony.

"They want to do it so they can have aggravating circumstances,” said Cheney Mason, a defense attorney. “If they get a conviction, they can pursue the death penalty. The statute requires the state proving aggravating circumstances."

More documents in the Case against Casey are scheduled to be released Friday.

UPDATED: Casey Anthony’s trial for check fraud
Updated: Thursday, 03 Sep 2009, 5:31 PM EDT
Published : Thursday, 03 Sep 2009, 11:14 AM EDT

On Thursday the court announced that Casey Anthony’s trial for check fraud will be scheduled before her murder trial.

The Defendant argued that the forgery case would divert attention currently being paid to preparation of the capital case.

In terms of legal skill and analysis, the check fraud case will be rather simple. Few witnesses will be called, and excluding jury selection, should not take more than a day or two. The Defendant argued that the real problem will be jury selection. The State offered to go "non-jury" with a simple bench trial.

More discovery is expected to be released tomorrow.

UPDATED: New Trial Date Request Granted In Casey Case
Posted: 11:04 am EDT September 3, 2009
Updated: 5:05 pm EDT September 3, 2009
<snipped>
If prosecutors have their way, Casey Anthony will already be a convicted felon before she stands trial in her daughter's murder. A judge ruled Thursday he'll schedule her check forgery trial before her murder trial.

WFTV legal analyst Bill Sheaffer believes there are unspoken reasons the defense wanted to put off Casey's 13-count check fraud trial. First, if Casey has any intention of taking the stand during her murder trial.

"If I were the prosecutor I would ask, 'Have you ever been convicted of a crime?'" Sheaffer said.

If she's convicted of stealing Huizenga's checks, she'd have to say yes.

"As soon as a jury hears that, it would be as though what a dog hears when you talk to a dog after you say its name, it's just blah, blah, blah," Sheaffer said.

If Casey is convicted of stealing the checks, it could hurt her chances of fighting the death penalty if she's convicted of the premeditated murder of her daughter Caylee.

"The greater likelihood that, one, you're going to have the jury recommend death and, two, the sentence of death would be upheld on appeal," Sheaffer said.

Speedy Trial Request Granted In Casey Civil Case
Check Fraud Trial To Take Place Before Anthony's Murder Trial
POSTED: 11:15 am EDT September 3, 2009
UPDATED: 11:23 am EDT September 3, 2009
<snipped>
Judge Stan Strickland has ruled on the state's request for a speedy trial in the forgery case against Casey Anthony.

The defense argued that holding this trial before Casey Anthony's murder trial would hamper its ability to prepare for the murder trial.

The state offered a plea from Amy Huizenga, who is Anthony's friend from whom she allegedly stole money.

Huizenga said this has caused her mental stress; her name pops on the Internet in connection with the case which embarrasses her. Also, she worries it will hurt her chances of finding a job.

Strickland has approved the motion for a speedy trial, so the forgery trial will go before the murder trial.

Strickland will set a date for the trial in the near future.

The state has offered to go non-jury with this trial, allowing a judge to hear the testimony and rule on the charges.

BREAKING: Casey Anthony trial to start in the "near future"
September 3, 2009 10:21 AM
<snipped>
It turns out Casey Anthony will be put on trial soon, but not for the murder of her daughter Caylee.

Judge Stan Strickland ruled Thursday that Anthony's trial for check fraud charges should be held "in the near future." In his order, Strickland wrote, "in terms of legal skill and analysis, this case is rather simple. Few witnesses will be called, and, excluding jury selection, should not take more than a day or two."

Strickland acknowledged jury selection could be difficult given the attention paid to Anthony's murder investigation, but ruled "that is not a sufficient reason to delay this matter until after the murder trial. Further, the state has offered to go 'non-jury,' with a simple bench trial."

Strickland said the trial date will be set in the coming days.

Anthony is accused of stealing checks from her then-friend, Amy Huizenga.

The Orange County state attorney's will release new evidence in the case Friday. It could include tapes of bounty hunter Leonard Padilla and his team.

Judge Makes Ruling On Casey Trial Date
Anthony's Check Fraud Case Will Be Tried Before Murder Case
POSTED: Thursday, September 3, 2009
UPDATED: 11:46 am EDT September 3, 2009
<snipped>
Casey Anthony will face trial on check fraud charges “in the near future” -- long before her capital murder trial on the death of her daughter, an Orange-Osceola Circuit Court judge ruled in an order released Thursday.

Judge Stan Strickland granted the state’s motion to set the check fraud case for trial before the murder trial, which is expected to begin next summer.

Strickland said in his three-page order that he “cannot justify making the victim wait even longer to have this matter resolved."

The victim, Anthony’s former friend Amy Huizenga, argued in an affidavit that the matter has caused her a great deal of mental stress, great embarrassment and fears it will hurt her chances for gainful employment -- arguments Strickland said he found “compelling.”

Anthony is charged with 13 felony counts stemming from her allegedly forging and passing checks on July 10 and 15, 2008, after Huizenga left her check book in a car she let Casey use while Huizenga was on vacation in Puerto Rico that month.

The maximum penalty for each third-degree felony is up to five years in prison.

Casey Anthony: Could she be a felon by time of murder trial?
posted by halboedeker on Sep 3, 2009 12:25:30 PM
<snipped>
The date for Casey Anthony's check-forgery trial will be set soon, WKMG-Channel 6 reported at noon today.

What does it mean? "Casey Anthony could be a convicted felon by the time she faces trial next summer for her life in the murder of her daughter, Caylee," WKMG's Tony Pipitone said.

Anthony's defense team had asked for the check-fraud case to be delayed after the murder trial. Pipitone said the defense team told him today that it was disappointed in Judge Stan Strickland's ruling and that it needs to focus on the murder trial.

Pipitone speculated that the check-fraud trial could start this month or next. Anthony faces 13 felony counts in the forgery case, and each is punishable by up to five years in prison, Pipitone explained.

Strickland said that Amy Huizenga, the check-forgery victim, made a compelling argument to get the case over, Pipitone explained. Huizenga is Anthony's former best friend.

Casey Anthony: WKMG says duct tape on toddler was rare make
posted by halboedeker on Sep 3, 2009 6:47:49 PM
<snipped>
The duct tape found on Caylee Anthony's remains is rare and could be a major setback for Casey Anthony's defense, WKMG-Channel 6 reported tonight.

The defense has argued that Henkel duct tape was the best seller in the country, WKMG's Tony Pipitone said. Yet the tape attached to the toddler is a special make.

"This specific, industrial, fire-resistant tape is a tiny fraction of all the tape sold by Henkel," Pipitone said in a first-rate, eye-opening report. "We tried to buy some today. We couldn't find any."

And what does this mean? "It is extremely rare" and "a crucial find," Pipitone said of the duct tape.

Prosecutors said today in a court papers that they will explain how rare that tape is. And Pipitone said the prosecution will argue that the tape is a link between the body and Anthony. WKMG earlier reported that the tape found on Caylee's remains was similar to tape on a gas can in the Anthony home.

The station held its big find until 6:30 p.m. and teased to it several times. WKMG anchor Jacqueline London said "just within the last few hours" the station "exclusively uncovered how the state plans to use" the tape at the murder trial.

There was more bad news today for Anthony's defense team.

State: Duct Tape In Anthony Case 'Rare'
Prosecution Plans To Link Tape Found On Caylee's Body To Gas Can
Tony Pipitone
POSTED: Thursday, September 3, 2009
UPDATED: 7:35 pm EDT September 3, 2009
<snipped>
Duct tape found both on Caylee Anthony’s body and a gas can found in the Anthony family home is a rare, industrial fire-resistant tape, according to a court filing Thursday by the Orange-Osceola State Attorney’s Office.

Investigators believe both the gas can and the body were at one time in the trunk of Casey Anthony’s car.

The industrial fire-resistant tape, marketed as “Fire Guard DUCK,” was manufactured by Henkel Consumer Adhesives, of Avon, Ohio.

Until it recently sold its duct tape division, Henkel was by far the largest manufacturer of duct tape in the nation, according to its Web site.

And, when Local 6 first revealed the same brand tape was found on Caylee’s body and in the Anthony home, her defense team dismissed that, noting how widely Henkel tape is sold.

But assistant state Attorney Jeff Ashton contacted the Henkel company, now known as ShurTech Brands, and discovered the tape found with the body and on the gas can was actually an extremely rare type of industrial fire resistant tape.

Only 134,719 rolls were sold in 2006 and 2007 in North America, according to the records submitted to the court Thursday.

That constitutes less than 0.2 percent of all duct tape sales during those years, based on more than $100 million in duct tape sales reported by the industry in 2002, the last year for which Local 6 was able to obtain data.

The odds of two pieces of randomly discovered duct tape manufactured in 2006 and 2007 being of that same, rare type approach 250,000 to 1. The odds of such a coincidence are much higher, if you factor in all the duct tape in existence, regardless of when it was manufactured, and determine how much duct tape sales have grown since 2002.

UPDATED: Padilla: Casey Never Shed A Tear That I Saw
Interviews Shed Light On What Happened Inside Anthony Home
POSTED: 6:59 am EDT September 4, 2009
UPDATED: 2:42 pm EDT September 4, 2009
<snipped>
One of the interviews conducted was between investigators and Tracy McLaughlin, who was allowed to stay in Casey Anthony's home following her release on bond.

One of the first questions McLaughlin was asked was about Anthony's homecoming following her initial release from jail.

"She comes in. I'm a little bit nervous to meet her because I'm thinking that ... she's got to be upset ... she comes in happy as can be, 'Hey, hi, gives me a big hug and just, 'I want to take a shower,' not a word about Caylee, nothing," McLaughlin said. "She's not even upset. Not a word about her daughter, and George (Anthony) didn't say anything, and Cindy (Anthony) didn't say anything ... It was just unbelievable."

After Anthony took her shower, McLauglin said her attention turned to dinner.

"It was like she had gone to Iraq or something and just got back," McLaughlin said. "There was still nothing about Caylee."

Padilla said he had no interaction with Anthony after he questioned her story about Zenaida Gonzalez the nanny taking Caylee from Blanchard Park and she said to him, "If you're going to talk to me like a cop, get out of my house."

Padilla said he never once saw Anthony shed a tear throughout his time around her.

"I saw more tears shed amongst my people that were there than her family and her all put together," he said.

This is one of the new photos of Caylee Anthony released on Friday.

UPDATED: More evidence set for release in Anthony case
Updated: Friday, 04 Sep 2009, 5:12 PM EDT

Among the discovery released Friday is the police dispatch call from December 11, 2008 when the remains were found.

Also in the discovery we hear from bounty hunter Leonard Padilla and two of his employees. They were the ones that bailed Casey out of jail drove her to and from her attorney Jose Baez's office.

On the CD's there are recordings of police asking them what went on behind closed doors and why Bounty hunter Leonard Padilla paid a half million bucks to bail her out.

Leonard Padilla: “My thinking was she would talk to us and eventually we'd bond and she would give up the info because my thinking was the baby is alive.”

Tracy McLaughlin worked for Padilla and lived in the Anthony's home while Casey was out of jail the first time and actually slept in Casey's bed.

McLaughlin describes Casey's behavior as odd from the moment she met her. “It was the serious and most emotional that I'd seen her. I'm a little nervous to meet her. I'm thinking she's got to be upset. She comes in happy as can be, hey hi gives me a big hug. Oh I want take a shower, not a word about Caylee nothing. I want take a shower.”

UPDATED: Casey Anthony: State releases interview with bounty hunter in Casey Anthony case
The State Attorney's Office made more evidence public in the case against Casey Anthony.
2:10 p.m. EDT, September 4, 2009
<snipped>
She(Casey) talked a lot about herself, signing autographs for money and going on a radio show, but didn't bring up the subject of her scrutiny -- her missing 2-year-old Caylee Marie Anthony, said Tracy McLaughlin, an associate of a California bounty hunter who helped bail Casey Anthony out of jail.

McLaughlin said one night, the topic of GHB -- known as the date-rape drug -- came up. McLaughlin asked Casey Anthony if she knew what the drug was and its effects.

"She said like roofies . . . or chloroform," McLaughlin said. "Roofies" is slang for Rohypnol, a date-rape drug.

McLaughlin said that statement was made before chloroform ever came out publicly as being linked to Casey Anthony's car. McLaughlin said it didn't mean anything to her at the time.

Anthony also liked being on TV, McLaughlin said. It was a game to her.

"She liked the attention," McLaughlin said.

"She'll tell a story and she has such a belief in herself. She has no grasp on reality. This is where her problem is. She has no grasp."

McLaughlin gave one scenario about Casey Anthony's quest for the limelight: McLaughlin said she would comment on a photo about Caylee, but Casey would turn the conversation onto herself.

"It was like it was competition. She wanted the limelight. It was sad. You couldn't talk about anything else. It just had to be her."

Asked about the first car ride to defense attorney Jose Baez's office, McLaughlin said, Casey Anthony talked about herself.

"She didn't talk about Caylee at all."

She talked about signing photos of herself for money, and even mentioned going on a radio show.

Three hours of audio and video recordings, as well as few photos are included in the release.

Among the items are:

-- Zenaida Gonzalez, the mystery babysitter, held Casey Anthony down at an east Orange County park and handed her a list of things to tell the cops moments after kidnapping Caylee Marie.

-- Home videos shot by private investigator Jim Hoover and his family. An hour long clip shows a mishmash of events.

-- One video, presumably taken by Hoover, depicts private investigator Dominic Casey prodding the thick brush and ground with a metal rod near the Anthony family home.

-- An interesting aspect of the latest records release is that of Padilla.

UPDATED: Bounty Hunter: Casey Said Nanny Told Her To Lie

In another interview, Casey’s mother, Cindy Anthony, said she did not trust Orange County Detective Yuri Melich, saying she did not like his lines of questioning to Casey.

“I’ve always believed in the system, but I don’t believe in it now,” Cindy Anthony said. “I don’t believe that judges do justice by predeterming before you even walk into a hearing.”

Cindy Says She Doesn't Trust Detective
Right off the bat, Cindy made it clear that she was upset with the way Detective Yuri Melich questioned Casey and her family and that she was not going to take a polygraph.

"I'm going to cooperate as much as I can, but I don't have to take that polygraph and I'm not going to -- not the way I was treated last night (by Yuri).

"I don't trust Yuri. I read through his line of questioning (of Casey) through the discovery. ... I was appalled. ... He's not asking her questions, he's telling her stories. He's tellling her a scenario and wants her to respond to it. ... She's told us from Day 1 he never listened to her. Now, granted, she did some tell some lies, but again a couple times he actually cut her off when she tried to tell him things," Cindy told Irwin.

When Irwin said Casey's disappearance could have been the result of an accident, Cindy said she didn't believe that for a second because Casey would come to them even whe Caylee skinned her knee.

"I realize Casey lied, but bottom line is it still doesn't change my beliefs that Caylee is not dead, that Caylee is still alive and is out there and I'm not changing those beliefs until someone brings me proof beyond a reasonable doubt otherwise."

Irwin reassured Cindy that authorities never considered her, her husband George, or her son, Lee of having a role in Casey's disappearance
