911 calls could be admitted into Casey Anthony murder trial

Casey Anthony may be face-to-face with her mother and brother this week if they take the stand in an Orlando, Florida courtroom. Cindy Anthony and her son Lee may testify at a hearing Thursday afternoon. The State is expected to argue that 911 calls placed by Cindy Anthony in July 2008 should be admitted at her daughter&#8217;s murder trial next year. The defense says the taped phone calls are hearsay and should not be admitted.

The hearing comes two years after two-year-old Caylee Anthony was reported missing on July 15, 2008. Casey Anthony&#8217;s family had not seen Anthony or her daughter since June 16, 2008. When Cindy Anthony found her daughter a month later, Caylee wasn't with her. Cindy Anthony threatened to call the police, hoping the threat would force Casey Anthony to describe where her daughter was. After two calls were placed to the police, Casey Anthony admitted to her brother that she hadn't seen Caylee in 31 days and that she believed her daughter was with the nanny, Zenaida Gonzalez.

The third and final call was placed immediately after Cindy Anthony overheard what Casey Anthony told her brother. Cindy Anthony appeared to be agitated and excited as she told the dispatcher that her granddaughter had been missing for a month and that her daughter&#8217;s car smelled &#8220;like there&#8217;s been a dead body&#8221; in it.

Cindy Anthony has since explained that the odor emanating from the car could have been from rotting garbage. However, the State believes that Caylee&#8217;s decomposing body was in the trunk of the car at some point in late June 2008.

Thursday&#8217;s hearing is also expected to focus on a motion from the defense. They&#8217;ll ask the judge to modify a ruling by Judge Stan Strickland, who stepped aside in April. The motion concerns a review of documents from Texas Equusearch, a private company that assisted in the search for then-missing Caylee. While Strickland&#8217;s order allowed the defense attorneys to review thousands of documents created by TES, the attorneys were prohibited from taking notes during the review. The defense maintains the current arrangement is inefficient and they&#8217;re seeking a more workable resolution.

Experts Examine Casey Anthony's Car
Defense Fights Release Of Evidence List

A team of experts for the defense examined Casey Anthony's car on Wednesday, a crucial piece of evidence in the first-degree murder case against her.

The car is the same one Anthony's mother told a 911 dispatcher smelled like it had a "dead body inside" when she reported Caylee Anthony missing in July 2008.

The defense is hoping its team of experts will find something in the car that proves Anthony's innocence in Caylee's death.

"Any time you get a chance to inspect something you've never seen before -- only in photos -- it's a completely different way of looking at things," defense attorney Jose Baez said.

Casey evidence inspection wraps up

The team of experts brought in to defend Casey Anthony is done reviewing evidence in the case after an all day meet-up Tuesday. Cheney Mason, one of Casey Anthony's attorneys walked around right after lunch time and said they were calling it a day. They had been inside for just more than 3 hours.

After a defense team huddle attorneys and experts called it "quitting time". Just 3 hours at the sheriff's office, attorney Cheney Mason said they were done. This ends a two day inspection of evidence being held by the orange county sheriff's office.

Lead attorney Jose Baez says they found things other investigators missed. "Without giving away any details, they are obviously plenty of things that you can see that you can't see in a photograph," Baez said.

The defense is allowed to test the evidence they've inspected, Baez said that is most likely what will happen.

The defense is fighting to keep the evidence list private. They will argue why in court Thursday.

Some of the experts will be back for evidence testing.

Cindy Anthony will testify about her 911 calls at the hearing, and her son, Lee, will testify, too. Casey Anthony, Cindy&#8217;s daughter and Lee&#8217;s sister, is charged with first-degree murder in the death of her daughter, Caylee.

On the noon news today, WESH-Ch. 2&#8217;s Bob Kealing said he had talked to Cindy&#8217;s attorney, Brad Conway. &#8220;He tells me &#8216;Cindy is doing well and she is ready to testify,&#8217; &#8221; Kealing said.

&#8220;Any time you get a chance to inspect something you&#8217;ve never seen before &#8230; only in photographs, it&#8217;s a completely different way of looking at things,&#8221; defense attorney Jose Baez told reporters. Baez&#8217;s comment that he wants a number of items tested grabbed the attention of WESH&#8217;s Kealing. &#8220;It certainly makes you wonder &#8230; how much material we&#8217;re talking about and could that further delay Casey Anthony&#8217;s trial,&#8221; Kealing said. The murder trial is scheduled for May.

WFTV-Ch. 9&#8217;s Kathi Belich said the defense wouldn&#8217;t say if it found &#8220;a significant amount of new evidence&#8221; in its examination. &#8220;They don&#8217;t want us to know exactly what they&#8217;re looking at even though the sheriff&#8217;s office is videotaping their examination of this evidence and we will see that videotape,&#8221; Belich said.

Cindy Anthony, Casey Anthony's mother, will testify at a hearing Thursday regarding a 911 call she made about her missing granddaughter, Caylee Anthony.

Also Thursday, Judge Belvin Perry will hear an objection by Anthony's defense to keep sealed any details about the evidence items they looked at.

Lee Anthony, Anthony's brother, is also under subpoena.

Sources told WESH 2 that Thursday's hearing will be the first time the entire Anthony family is in the courtroom since Casey Anthony was indicted in 2008.

Anthony defense attorney Cheney Mason said the team finished looking over evidence just after 1 p.m. on Wednesday. "Without giving away details there are plenty of things that you see in person that you can't see in a photograph," Anthony defense attorney Jose Baez said.

On Tuesday, the team looked at dozens of items from the evidence sheet at the Orange County Sheriff's Office.

Baez and Mason, along with insect expert Tim Huntington and forensics expert Henry Lee, were on hand again Wednesday to look through more evidence. Noticeably absent from the survey was defense counsel Linda Kinney Baden. Baden's out of town travel expenses are not picked up by taxpayers.

On Thursday, Judge Belvin Perry will hear an objection by the defense to keep sealed any details about the items they looked at.

Two years ago today, Cindy Anthony frantically called 911 to report her granddaughter Caylee had disappeared. Now that call is taking center stage in a hearing in the case against Cindy&#8217;s daughter, Casey Anthony. In the 911 call, Cindy says Casey&#8217;s car smelled like it had a dead body in it. Casey's lawyers do not want the 911 call used in the murder trial.

The main issue at hand Thursday afternoon was whether three 911 calls made by Casey's mother would be permissible as evidence in the murder case. The defense was fighting to have the calls disallowed as hearsay, and the prosecution called both Casey's mother and brother to testify. The defense lost that fight as Judge Belvin Perry ruled that all three calls are considered excited utterances, creating an exception to the hearsay rule, and will be allowed as evidence, therefore denying the defense motion.

Judge Perry, though, did give the defense one victory, granting their request to keep the list of evidence, which they reviewed over two days this week, sealed.

Judge Belvin Perry advised the court that the first issue to be heard is one involving Texas EquuSearch. Judge Stan Strickland had previously ruled on a defense motion seeking the names of all persons involved in the EquuSearch efforts in the search for Caylee (read previous order).

Baez then asked Judge Perry if he could speak with him before they started. After about 15 minutes of speaking with their microphones off, Judge Perry announced that Baez would be dropping his motion, but said that Baez and EquuSearch attorney Mark NeJame need to work together so the defense can see the EquuSearch records again. &#8220;They can inspect those documents again, they can take notes. I will appoint a special magistrate ... to supervise,&#8221; Judge Perry said.

Just before 5:00pm, Judge Perry announced a 10-minute recess. He said he'd then return with a ruling.

At 5:05pm, Judge Perry returned to the courtroom. "The court has before it a question of whether three 911 calls ... the defense raises several theories. The first theory is these calls are hearsay," Perry said, citing cases related to such a theory. "In this particular case, we have three calls. The state has indicated that calls one and calls two are not being offered for the truth of the matter as asserted within ... testimony presented at this particular hearing indicates ... it is quite evident ... that that statement was made before there was time ... the statement was also made at the time she was under the stress of learning that her granddaughter was missing and no one knew where she was ... it's quite clear that the third call fits the description of an excited utterance,"

Perry went on to state that the other two calls, as well, also were made under a stressful situation and ruled that all three 911 calls are permissible as evidence in the case against Casey Anthony and the motion was denied.

The judge ruled that 911 calls made by Cindy Anthony to report Caylee Anthony missing can be used in court in the murder case against Casey Anthony.

Judge Belvin Perry said the third 911 call made by Cindy Anthony fits the definition of an "excited utterance."

Perry found that the first two calls, which he described as frantic efforts of a grandmother to find the location of her grandchild, using the ploy to get police involved to extract a statement from her daughter, could be used. He said the calls are not being offered to prove truth of matter of asserted.

The state said the calls are being used to show the effect the calls made on Casey Anthony and to place Casey Anthony's comments in context.

The judge in the case against Casey Anthony could make a ruling on a major issue Thursday: The frantic 911 calls Casey’s mother made in 2008.

Cindy Anthony, along with Casey’s brother, Lee Anthony, and Casey, herself, are expected in an Orange County courtroom for Thursday’s hearing, scheduled to begin at 2 p.m.

Casey’s defense team filed a last-minute memorandum with the court late Wednesday night, arguing the 911 calls Cindy made after learning Casey’s 2-year-old daughter, Caylee, had been missing for weeks, should not be admissible during trial.

Judge Belvin Perry is also expected to consider earlier rulings in the case involving Texas Equusearch, the group that helped look for Caylee’s body.

A 911 recording in which Casey Anthony's mother tells a dispatcher that her daughter's car smells like a dead body can be used during the Florida woman's first-degree murder trial.

Judge Belvin Perry, Jr. ruled during a pretrial hearing Thursday that the 911 recording can be introduced during the trial next May.

Casey Anthony's mother, Cindy, testified that when she called 911 in July 2008 she wanted to get the dispatcher's attention so that officers would come out to her house.

Judge Belvin Perry ruled that 911 calls made in the Casey Anthony case will be admissible as evidence during the accused mother's murder trial.

Cindy said that she felt law enforcement did not believe Caylee was alive at the time she was reported missing. She told the defense that she still believes Caylee is alive. "I still think Caylee is alive," Cindy said.

Lee Anthony took the stand to talk about when his mother made the 911 calls. "I was just trying to reason with Casey to answer my mom or do what she was asking and go to get Caylee,&#8221; Lee said. &#8220;It didn&#8217;t make sense not to.&#8221; Lee said he was "dumbfounded" and "shocked" when his sister admitted to him that she had not seen her daughter in 31 days.

Also today in court, Judge Belvin Perry will hear an objection by Casey Anthony&#8217;s defense to team to keep sealed any details about the evidence items they reviewed earlier this week.

WFTV-Ch. 9&#8217;s Kathi Belich said that Cindy Anthony &#8220;has changed the story around her frantic 911 call three times and we might see this afternoon what it&#8217;ll be today. We also might hear Casey brother&#8217;s Lee for the time since she accused him of sexually abusing her.&#8221;

The stations explained the fight over Cindy&#8217;s 911 calls and whether they&#8217;ll be included at the murder trial.

The defense says they are hearsay and inadmissible. WKMG-Ch. 6&#8217;s Mike DeForest noted that prosecutors say Cindy &#8220;displays raw emotion in those calls,&#8221; and that the recordings &#8220;should be allowed at trial under an exception to the hearsay rule called excited utterance.&#8221;

DeForest predicted that a lot of people will be watching Lee Anthony&#8217;s reaction since it has been close to two years since he has seen his sister.

"I can't wait...our heads will be spinning with it all! I'd be over hte moon just watching Cindy face off with the (state attorney). Wowsers!" one fan wrote.

*5:44 p.m.- Casey's defense is requesting feet shackles be removed. Defense team says after her accident, it's uncomfortable and painful.
*5:40 p.m. - Evidence list will stay private. Next week, defense will let state know which items (evidence) they will want to test. They will be sent to Dr. Timothy Huntington in Nebraska.
*5:20 p.m. - Motion denied, 911 calls will be allowed. Discussing evidence log now.
*3:56 p.m. - Casey is crying. Lee is on stand testifying. Lee Anthony mouthed I love you, Casey burst in tears. He's being questioned about how his mother reacted when Casey told them she hasn't seen Caylee for 31 days.
*3:48 p.m. - Cindy says she still believes Caylee is alive.
*3:26 p.m.- Cindy says Casey started crying when she admitted she hadn't seen Caylee for 31 days. Cindy said she then panicked.

When Lee walked up to the witness stand and saw Casey for the first time in a long time, the two had an emotional exchange.

Lee could be seen mouthing &#8220;I love you&#8221; to his sister, Casey.

&#8220;I&#8217;m assuming you weren&#8217;t speaking to me just now,&#8221; prosecutor Linda Drane Burdick responded.

Cindy Anthony was subdued, and Lee Anthony was giggly but succinct at a hearing today in Casey Anthony&#8217;s case. Some observers expected fireworks, but that drama never materialized, although there were some strange moments. Judge Belvin Perry ruled that Cindy&#8217;s 911 calls will be heard at the murder trial next year, giving the prosecution a victory.

In an analysis for WOFL-Ch. 35, Orlando attorney Diana Tennis theorized that Perry saw Cindy Anthony&#8217;s comments as &#8220;in-the-heat-of-the-moment statements&#8221; and took into account Cindy&#8217;s repeated statements that she had been hysterical. &#8220;That&#8217;s why he decided it wasn&#8217;t hearsay,&#8221; Tennis said.

WKMG-Ch. 6&#8217;s Tony Pipitone said Perry&#8217;s ruling &#8220;gives the state some wide latitude in how to tell a narrative, a story&#8221; about why Casey should be convicted. Pipitone cited Cindy&#8217;s testimony about how frantic she had been as key to Perry&#8217;s decision.

WOFL analyst Tennis said that prosecutor Linda Drane Burdick repeatedly had Cindy Anthony acknowledge that she recognizes the smell of dead bodies &#8212; undercutting the defense argument to keep her calls out. That made Cindy &#8220;look not as honest as she would like to have liked to look today,&#8221; Tennis said. &#8220;I&#8217;m hoping that the defense takes this as a little bit of practice for Cindy for when they get to trial and perhaps she&#8217;s not going to be so easily impeached at that point.&#8221;

Judge Perry also today granted the defense&#8217;s request to seal the list of evidence its experts examined this week, WFTV reported.

Anthony family gathers in court

The entire Anthony family was in court together for the first time.

Cindy Anthony re-told every detail of when her daughter Casey told her she hadn't seen little Caylee in 31 days. <"Cindy Anthony/ Caylee's grandmother">
"I was in shock,' said Cindy Anthony, Caylee's grandmother I couldn't believe what I was hearing."

Prosecutors wanted the 911 tapes to be used in the trial because it is the first time Caylee was reported missing. They say Cindy Anthony spoke with "excited utterances", which means she didn't have time to make up a story or fabricate what she was saying.

Casey Anthony broke down as her brother Lee Anthony took the stand to talk about what happened that day that led up to the 911 calls." said Linda Drane Burdick, assistant state attorney

Political analyst Will Jay says he's not surprised the judge ruled in the state's favor. "The state certainly is going to use them, and now that they have a pre-trial ruling that they're admissible you can maybe expect to see them in opening statements even," Jay said.

So while the defense team may want the 911 tapes to go away, it appears that they won't.
