I am beginning to wonder if Casey Anthony and José Baez could pull off the impossible.

Not exoneration from the jury but a death sentence from the judge.

We do not have executions by democracy, and if found guilty, Casey does not qualify for the needle.

This case demonstrates everything that is wrong about capital punishment.

Eric Patrick Fletcher shook his baby to death in Port St. Lucie. He got less than five years.

Michael Dubisky left his 4-month-old son blind, suffering from cerebral palsy, seizures and other problems. The boy died six years later. Dubisky left prison shortly thereafter.

Alexandra Tobias of Jacksonville shook her baby to death for interrupting her on a computer game. She got 50 years.

In Florida's history, only one woman has been sentenced to death for killing her child.
Ana Maria Cardona of Miami starved and tortured her 3-yr old before finishing him off with a baseball bat and dumping his emaciated 18-pound body. Her 1992 death sentence was overturned, and a second judge imposed a second one earlier this month.

Remember Susan Smith? She claimed a black man kidnapped her children. It later was learned she drowned them, one 3 years old and one 14 months, so she could have a relationship with a man. In other words, the children were infringing on her lifestyle. Does that sound familiar? She will be eligible for parole in 2024.

Casey has a cold heart and a sociopath's skill for lying. But in the world of monsters who kill their children, the accusations against Casey Anthony hardly stand out.

A death sentence for the murder of a child requires premeditation or aggravated child abuse.

The main evidence of premeditation in this case consists of computer searches Casey apparently made three months before Caylee's disappearance for terms such as "chloroform."

That's suspicious and interesting but hardly so irrefutable it warrants jabbing a needle in her vein.

Given the state of decomposition of Caylee's body, there is no evidence of how she died, so there is no evidence that her death was so heinous or cruel as to warrant a death sentence.

Late last week, "The View" announced that it is devoting a daily segment to the case with legal reporter Chris Cuomo -- the first time in the show's history it will focus on one subject for an entire week.

"We think that there is a genuine interest in this story in daytime television because, at its core, Casey Anthony's motherhood is on trial," "The View" executive producer Bill Geddie said on Friday in a response to an e-mail query.

Inevitably, the Anthony trial will draw comparisons to the OJ Simpson trial.

But what turns the case into such addictive TV is that the Anthonys are "not famous people," Safon says.

"On some level, this seems like such an unremarkable family. And yet, when you look underneath the hood, you're seeing this incredibly complex group of people and relationships."

A defense expert whose testimony upset Judge Perry Saturday may return to the stand today.


Perry was angered Baez tried to question forensic anthropologist Dr. William Rodriguez — in front of jurors — about an opinion that had not been shared previously with the prosecution.

It marked the latest time Perry used the "C" word — contempt — in reference to Anthony's lead defense attorney and the latest time Baez had been called out for an ethical or legal transgression.

In January, Perry slapped Baez with a fine and sanction for a "willful" violation of his court order to share expert witness testimony with prosecutors. At that time he spared Baez a contempt citation.

Meanwhile, a Florida Bar ethics complaint against Baez that surfaced at about the same time is still being investigated. The details of that grievance have not been disclosed.

And during the lead-up to the Anthony trial, Sheriff's Office detectives appeared to be investigating whether Baez had tampered with a potential witness in the case - a volunteer searcher whose testimony could have altered the trial's outcome.

Ashton said 9:25, while Baez responded 9:26. That prompted the judge to say, “that shows the two of you will never agree on anything.”

Defense Unable To Call Witnesses To Testify

The order came after the two witnesses who planned to testify for the defense Monday were blocked by the prosecution because of discovery issues.

Perry said earlier that he was tired of the games being played by the attorneys.

Perry was fuming after Ashton complained yet again that Baez had failed to disclose the expert opinion of an upcoming witness.

Perry said if discovery violations continue to occur he will consider excluding witnesses -- even if it risks a mistrial. He also said all attorneys need to start arriving in the courtroom at 8:30 a.m.

Perry only hinted at future punishments.

Judge Perry scolded defense attorneys and prosecutors on Monday during Casey Anthony's murder trial for wasting time as they argued about legal issues and recessed the court until 9:00am Tuesday.

Ashton asked the judge that defense witness, Dr. Rodriguez, not to be called first because he wanted to read over his deposition again. Baez asked the judge for sanctions against the state and said he feels they are unreasonable.

Rodriguez was turned away at the witness stand after prosecutors complained that Baez planned to question him in a way he had not disclosed in court, which is in violation of Perry's pre-trial order. Perry then threatened to hold Baez in contempt of court. Perry admonished the lawyers for wasting the jury's time with legal matters that should have been taken up before court began.

Day 23: Courtroom Meltdown, No Witnesses
Court Dismissed Earlier Because Of Witness Issues

There is no love lost between Ashton and Baez, but the dislike between the two has begun to affect the trial. Perry directed his tongue lashing not just at the defense but also toward the state. It was a rebuke that legal analysts said both attorneys deserved.

"There is no reason why they shouldn't have been ironing out these reports in private months and months ago, but they don't talk to each other, and that venom and that vitriole is becoming apparent now, and it's really affecting Ms. Anthony's due-process rights," attorney Jeff Deen said.

Deen said he believes personal sanctions from the Florida Bar and the court are likely for both Ashton and Baez.

Some legal experts said Judge Perry bears some of the blame because he has allowed Baez, an inexperienced attorney, to keep pushing the case forward despite the fact that, on paper, Cheney Mason, who is qualified to try capital cases, is the lead attorney.

"He does it on paper, but he's not doing it in the courtroom, and that is what's important, who is the lead attorney in the courtroom, and that's why I fault Judge Perry. I think he should not be yelling at Jose Baez but yelling at Cheney Mason, because at the end of the day, Cheney Mason is one who will be cited as lead attorney on appeal," attorney Richard Hornsby said.

Even if Casey Anthony ends up on death row, she'll never be executed

If she ever does make it to death row and gets in line behind the 399 inmates already there, she would be killed sometime in the 23rd century.

That is based on the execution rate since 1979. We're adding folks far faster than we're killing them.

For example, Jeb Bush stopped executions in 2007 after it took 34 minutes to kill an inmate because of a misplaced needle. By the time executions resumed 18 months later, more than 20 inmates joined death row.

Our last execution was 16 months ago. Since then, we have added 11 more.

I hate to point out the obvious, but this isn't working.

The Palm Beach Post calculated in 2000 that the death penalty cost Florida $51 million a year, or about $24 million per execution. The state has never crunched the numbers.

Various studies have concluded that the death penalty adds a minimum of $1 million to the cost of the average trial, often more. And then verdicts are automatically appealed. The appeals drag on and often succeed. So there are more trials and/or more sentencing hearings. And then they are appealed.

Botanist Discusses Caylee Remains At Anthony Trial

ORLANDO, Fla. -- Day 24 began with attorneys from both sides arguing whether a defense witness would be able to testify about DNA in the case.

Judge Perry said, he would be willing to hold a hearing later and revisit the issue.

The defense, called Jennifer Welch, questioned by defense attorney Sims.


The defense called Dr. Jane Bock, a forensic botanist.

"I have looked at photographs taken by the medical examiner and the Sheriff's Office crime scene investigators and visited the recovery area and read documents about the case," Bock said.

Bock told jurors that she believed the roots could have grown through the bones, skull and a laundry bag in two weeks. Prosecutors have said Caylee's remains had been in the woods near the Anthony family home since the summer of 2008.

While pointing to a photograph in front of the jury, Ashton asked Bock if she measured the amount of "leaf litter" in a certain area.

"No. Did anyone else?" Bock said.

"The neat thing about this is that you don't get to ask me any questions," Ashton joked.

Ashton pointed out that Bock said in her deposition that she couldn't say when Caylee's remains were placed in the woods. Bock then admitted that it's possible that Caylee's remains were in the woods for more than two weeks.

Ashton also said that Caylee's hip bone was found buried in 4 inches of muck, implying that Caylee's skull was likely in the woods for longer than two weeks. Bock suggested a dog or another animal could have buried the hip bone.

The defense then called DNA expert Dr. Richard Eikelenboom.

Ashton said Eikelenboom originally only submitted a half-page summary of his findings that contained no significant opinion, but now wants to present two written pages and 45 PowerPoint slides to jurors, which Ashton says is a clear violation of Perry's court order for all expert witnesses to submit detailed reports.


Perry decided that by not informing Eikelenboom that he needed to report his findings with a complete statement of opinions for the state, the defense's discovery violation was willful.


Perry informed the jury that Eikelenboom had stipulations for what topics he could testify about.

After sending the jury to lunch, Baez said he was just handed computer evidence from the state, which he thought violated the discovery order.

The state said it gave all the information from the Anthony family computer to Baez two years ago. Baez argued there was too much information and he did not know what to focus on.

Botanist: Caylee's Remains Could Have Been At Site Only 2 Weeks

Jane Bock, said she believed the root growth found in the "hair mass" and the skeleton could have accumulated in two weeks. But during cross-examination by prosecutor Ashton, she seemed less sure about the skeleton, saying she had only studied root growth on skeletons that had been in place for years.

Bock also told jurors on that fragments found on and in Casey Anthony's car did not match the vegetation seen at the scene where the remains were found.

"Bits of leaves, for the most part" were found in and on Anthony's Pontiac Sunfire, Bock testified, "especially from a camphor tree." Bock said that when she visited the place where Caylee's skeletal remains were discovered, she did not see a camphor tree at the site.

Meanwhile, wrangling between the prosecution and the defense continued before jurors were brought in Tuesday.
